The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Mayor Rocha called the meeting to order. Call to Order ROLL CALL: Roll call was taken by City Clerk Cornejo. Councilmember Carrillo joined the meeting Roll Call at 6:40 P.M. after roll call. PRESENT: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT Also Present Elected Officials: City Clerk Cornejo. Staff Members: Interim City Manager Penman, City Attorney Martinez, Finance Director Paragas, Interim Human Resources Director St. Peter, Recreation and Family Services Director Jacobs, Information Officer Quiroz, Assistant/Deputy City Clerk Hernandez. CEREMONIAL Ceremonial Council presented proclamations to outgoing Commissioners thanking them for their service: Proclamations Ms. Lillian (Lil) Sass, Human Relations Commission 10/18/2010 to 5/2/2014, and Outgoing Ms. Shawn Millner Planning Commissioner 10/5/2009 to 9/30/2014. Commissioners Mr. David Santellan, Parks and Recreation Commissioner 1/16/1984 to 9/24/2014, and Ms. Blanch Weir, Architectural Barriers Commission, 10/1/2001 to 4/10/2014, where not present at the meeting to receive their proclamations. Council presented a proclamation to the Alvarez family, celebrating 100 years in Azusa. Proclo Alvarez Family Council presented a proclamation to the Duarte Elks Lodge #1427, proclaiming September 8-14, 2014, Proclo Duarte as National Patriotism Week. The City Council reconvened at 7:48 P.M., City Attorney Martinez announced that Items 4, 5 and 6 Reconvene were not discussed, they will be presented at a subsequent meeting, and Items 1, 2 and 3, Council heard City Attorney presentations on items 1, 2 and, and there was no reportable action. Report REGULAR MEETING Mayor Rocha called the meeting to order at 7:45 P.M. Staff Members: Interim City Manager Penman, City Attorney Martinez, Police Chief Gonzales, Finance Director Paragas, City Engineer/Interim Public Works Director Bobadilla, Police Captain Momot, Information Officer Quiroz, Assistant/Deputy City Clerk Hernandez. Pledge to the flag was led by Mr. Tony Garcia. Invocation was given by Mr. Burke Hamilton. PUBLIC PARTICIPATION Regular Mtg Call to Order Roll Call Also Present Flag Salute Invocation Public Part Ms. Jacquelyn Postell and Mr. Gustavo Solis, representatives for River Community in Azusa, J. Postell & G. addressed the Council giving a brief description of the program, and invited all to their open house on Solis Comment November 25, 2014 Messes Shawn Millner, Bridget Muniz, Alexandra Muniz, Diana Velez, Xilonin Cruz -Gonzalez, and Residents Messers Tony R. Garcia, Anthony Contreras, Burke Hamilton, expressed their support for Measure K, Supporting which is on the California Ballot for the November 4, 2014 State Election, and was originated by the Measure K Azusa School District. Messers Gregory Ahern Sr., Jorge Rosales, Zafar Alikhan, Art Morales, and Messes Stephanie Mills, Residents Madelyn Payne, expressed their opposition to Measure K, which is on the California Ballot for the Opposing November 4, 2014 State Election, and was originated by the Azusa School District. Measure K Mr. Jorge V. Rosales addressed the meeting regarding Consent Item D-7, a Site Lease Agreement, J. Rosales asking why the Planning Commission did not review the item, the proposed antenna is 70' high and Comments does not meet certain criteria of the Azusa Development Code. Mr. Richard J. Rodriguez addressed the meeting regarding excessive trash and graffiti at the Citrus R. Rodriguez Crossing Shopping Center and asked that the City contact the shopping center owners to address the Comments problems. 11/03/2014 PAGE TWO Police Chief Gonzalez and City Attorney Martinez, responded to questions posed by Mr. Rosales, S. Gonzalez & stating that the Police Department (PD) is exempt from the restrictions that he mentioned regarding the M. Martinez height of the LA-RICS monopole antenna to be placed on PD property; LA -RIGS projects, and all the Comment antenna components, were granted exemption by State Legislation, and under the California Environmental Quality Act, these antennas are exempt as long as there is an equal antenna in the vicinity, and it is for a Police or Fire Station, which was the case on both requirements; there would be options to help disguise the pole and make it more attractive; staff will abide by all restrictions and the permitting process. Interim City Manager Penman stated that Code Enforcement staff will approach the owner of the Citrus D. Penman Crossing Shopping Center to address Mr. Rodriguez's concerns. Comments ' REPORTS, UPDATES, COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rprts/Update Moved by Mayor Pro -tem Gonzales, seconded by Councilmember Carrillo, to approve a request by $200 Sponsor, Mayor Rocha for $200 to sponsor the Gladstone High School Band to assist with the purchase of new Gladstone High equipment and repair of existing equipment, by the following vote of the Council: Band YES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE Moved by Councilmember Macias, seconded by Councilmember Alvarez, to approve a request by the Certificates for Recreation & Family Services Department for certificates for Slauson Middle School Leadership, AID Recreation and Cheer, for their volunteer services at the Recreation Department's Community Events, to be presented December 1, 2014, by the following vote of the Council: YES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE Mayor Pro -tem Gonzales congratulated Recreation and Family Services for the well attended Trunk -or- R. Gonzales Treat event; he announced the Football Game of Azusa High v. Gladstone High, November 7, 2014, Comments 7:00 P.M., Citrus College, and the Marathon, November 15, 2014, street closures were posted on the Police Department's Web Site. 'Councilmember Macias stated that he was happy to see his High School Counselor, Mr. Tony Garcia, U. Macias at the meeting; he announced the inaugural event of the Marathon in Azusa on November 15, 2014, and Comments Citrus College Saluting Veterans Event, November 6, 2014, 11:00 A.M; he encouraged all to vote on November 4, 2014, and shared his experience while deployed in Afghanistan as he witnessed an Election; he requested, from Interim City Manager for the next meeting, an update on what preparations are in place regarding potential mud -slides due to the recent fires; he Congratulated Ms. Xilonin Cruz -Gonzales on her new baby. Councilmember Alvarez stated that he hoped everyone had a happy Holloween; he encouraged E. Alvarez everyone to vote on November 4, 2014; he announced that he will not be able to make it to the Comments marathon due to prior commitments, and asked everyone to be safe during the Veteran's Day Holiday. Mayor Rocha announced that the meeting would be adjourned in memory of Ms. Guadalupe "Lupe" J. Rocha Zarate and Mr. Kenneth Mark Aramburo, lifelong Azusa residents; he thanked Regency Theater and all Comments who assisted at the Bullying Workshop/Seminar on October 25, 2014, and thanked all the volunteers who assisted in the clean up of a residents backyard on Pasadena St., and the clean up at Atlantis Gardens, which will continue on November 8, 2014; he made the following announcements: Be a Walker, November 8, 2014, Azusa Veterans Park; Care Packages will be shipped to soldiers on December 6, 2014, donations can be dropped off at City Hall; Veterans Ceremonies, November 6, 2014, 11:00 a.m., Senior Center, and November 11, 2014, 11:00 a.m., in front of City Hall; 16th Annual Holiday Food Drive, in partnership with the Azusa Unified School District, on November 21, December 5, and 12, 2014; he asked to keep service men and woman in prayers. SCHEDULED ITEMS Sched Items APPROVING AND ADOPTING AN AMENDED CONFLICT OF INTEREST CODE. Conflict of Interest Code City Attorney Martinez presented the item stating that the resolution reflects minor changes to the Appendix of the Conflict of Interest Code; Cities are required to review their Code every other year, and make adjustments to ensure all positions have been updated and appropriate disclosure categories are assigned. Reso 14-C74 Mayor Pro -tem Gonzales offered a Resolution entitled: Adopting Amendment to RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING Conflict of AND ADOPTING AN AMENDED CONFLICT OF INTEREST CODE PURSUANT TO THE Interest POLITICAL REFORM ACT OF 1974. 11/03/2014 PAGE THREE Moved by Mayor Pro -tem Gonzales, seconded by Councilmember Macias, to waive further reading and adopt Resolution No. 14-C74, by the following vote of the Council: YES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE CONSENT CALENDAR: Moved by Mayor Rocha, seconded by Mayor Pro -tem Gonzales, to Consent approve Consent Calendar Items D-1 to D-8, with the exception of Item D-4, which was handled under Calendar the Special Call portion of the agenda, by the following vote of the Council: YES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA 'NOES: COUNCILMEMBERS: NONE 1. The minutes of the regular meeting of October 20, 2014, were approved as written. Minutes 2. Resolution No. 14-C75 was adopted and entitled: Reso 14-C75 Warrants A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The grant award from the Canyon City Foundation to the Azusa Library was accepted, and the Library Grant budget amendment associated with this grant award was approved 4. SPECIAL CALL ITEM. Spec Call 5. The following Resolution No. 14-C76 was adopted and entitled: Reso 14-C76, lnterfund A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AND Policy ADOPTING THE INTERFUND LOAN POLICY 6. The City Treasurer's Report for the month of September 2014, was received, reviewed and filed. Treas Report 7. The Interim City Manager was authorized to execute the Long Term Evolution (LTE) Site Lease Site Lease ' Agreement with the Los Angeles Interoperable Communications (LA-RICS) Joint Powers Agmnt LA - Authority. RICS 8. The Interim City Manager was authorized to execute an agreement with Enterprise Fleet Services Purch/Lease for the purchase/lease of 7 vehicles for a total cost of $257,031.62. SPECIAL CALL ITEMS NON-EXCLUSIVE FRANCHISE AGREEMENT FOR TOW TRUCK SERVICES. Police Chief Gonzalez responded to questions posed by Mayor Rocha stating that the contract gives the City the ability to do a security or integrity check, and a background check on the drivers, which would be done if complaints are filed, and handled on a case-by-case basis; towing companies have not given concern to their credibility, all have been with the City for many years; a new company was included in the new agreement, and they came with good recommendations by the Baldwin Park and West Covina Police Departments. Moved by Mayor Rocha, seconded by Mayor Pro -tem Gonzales to approve the Non -Exclusive Franchise Agreements for Tow Truck Services with Jan's Towing, Royal Coaches Towing and San Gabriel Valley Towing (formerly City's Towing), by the following vote of the Council: Special Call Franchise Agreement for Towing Services YES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE Mayor Rocha further requested that staff provide the Council, at the next Council meeting, a list of J. Rocha Taxi Cab Companies that operate in the City of Azusa, as he believes that there may be some Comments companies that are not licensed.
