PUBLIC PARTICIPATION Also Present Flag Salute Invocation Public Part Ms. Barbara Dickerson, Boardmember for the Citrus College Board of Trustees, gave an update on B. Dickerson students' goals and accomplishments, and reminded everyone of the Citrus College Centennial Comments Celebration on June 3, 2015, at 2:00 P.M. Messrs. Zafar Alikhan, Max Chew, Fred Madjar, Peter Jonker and Arno Conley, and Mses. Vanessa Residents Alikhan and Helen Lau, addressed the Council regarding the Rosedale unmaintained water basins, the Addressed development of a new school, dust from the site of the future park, speeding vehicles and mid -walk Rosedale crossing at the promenade area, the opening of Citrus Avenue, potential increase of Home Owners Association (HOA) fees, and variances made to the original master plan. Messrs. Jerry Curcio, Joe Guarrera, Daniel Pantoja and Kelley Whitworth, and Mses. Maria Robles, National Little Raquel Moreno Castaneda, Melisa Padovano and Stephanie Mills, requested that Council reinstate the League Appeal Azusa National Little League fireworks permit that was denied by the City Manager. Ms. Phyllis Arispe addressed the Council expressing her opposition to the smart meters program, and P. Arispe requested that the City provide rain barrels for residents. Comments Mr. Brett Ross addressed the Council regarding two commercial parking citations that were issued to B. Ross his family at Sierra Madre Avenue and Todd Avenue, stating that in that area there are no signs of "No Comments Commercial Parking" posted, and requested that something be done regarding the citations. Messrs. Jorge V. Rosales and Chris Lenge, addressed the Council about the variances made to the J. Rosales & C. general plan of the proposed hotel on Azusa Avenue by the 210 Freeway, regarding increased height, Lenge Comment 24 hour McDonalds operation, the hotel logo, and the increase in traffic in that area. City Manager Butzlaff responded to public comments stating that the smart meters program is still in the developing stages and no final decision has been made; the City has a $75.00 rebate program for rain barrels. Police Chief Gonzalez will contact Mr. Ross to provide him with information on the appeal process for parking citations. Regarding Rosedale residents concerns, the Police Department has been working on resolving the speeding vehicles; staff will contact the Developer to address the mitigation of the dust; staff continues to work with Glendora on the opening of Citrus Avenue, and hopes to come to an agreement on the curb alignment of the road prior to the opening of the Gold Line Citrus Avenue Station; In order for the City to maintain the basins, they have to be dedicated to the City, staff will search into the dedication; staff will discuss with the Developer the mid -block crossings as well as any other obligations that they may have, which the City will enforce; all other issues were matters to be addressed between the Developer, the HOA and the property owners. The hotel project was approved by the Planning Commission, if residents feel that the project should not move forward, the decision can be appealed, the process was to allow for relief and allow the Developer certain opportunities for variances from the general plan; the City Engineer will look at the increase of traffic on Paramount Avenue and Azusa Avenue. Foothill Blvd. Train Bridge City Manager Butzlaff responded to a request posed by Councilmember Macias stating that once the Artwork Gold Line Authority has approved the artwork for the train bridge on Foothill Boulevard, which will include the City Seal and Route 66 Logo, it will be presented to Council for their final approval. Councilmember Macias: Request for a certificate for Citrus College congratulating them for their Certificate 100th Birthday Celebration on June 3, 2015. Certificates Valleydale School Athletes SCMAF Comptition E. Alvarez Councilmember Macias requested that, during the summer school vacation, everyone be aware of E. Macias children out on the streets; he shared some of his experiences during his tour in Japan. Comments 'Mayor Rocha announced that the meeting would be adjourned in memory of the 100th Anniversary of J. Rocha the Armenian Genocide; he announced the Memorial Day Celebration, in front of City Hall, May 25, Comments 2015, 10:00 A.M.; he asked everyone to keep service men and women in daily prayers. Scheduled Items AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CHAPTER First Reading 60 OF THE AZUSA MUNICIPAL CODE TO IMPLEMENT LOW IMPACT DEVELOPMENT Ordinance (LID) STRATEGIES. 2015-03 LID Strategies Interim Public Works Director/City Engineer Bobadilla, presented the item stating that the ordinance proposed to amend Chapter 60 of the Azusa Municipal Code to implement LID strategies. On November 8, 2012, the Los Angeles Regional Quality Control Board adopted a new National Pollutant Discharge Elimination System (NPDES) permit; the order applies to all Cities in the Los Angeles County, and calls for updates to the regulations regarding Separate Storm Sewer System (MS4). One of the components of the new permit is for all Cities to implement LID strategies for new development and redevelopment projects, to provide a comprehensive approach to storm water quality issues, and for Cities to be stricter on water pollutants in runoff water through places such as channels and rivers. He gave examples of LID strategies and what type of projects qualified for the new regulations. Councilmember Macias offered an Ordinance entitled: 'AN ORDINANCE OF THE CITY COUNCIL ADOPTING AN AMENDMENT TO CHAPTER 60 OF THE CITY OF AZUSA MUNICIPAL CODE TO EXPAND THE APPLICABILITY OF THE EXISTING STORMWATER AND URBAN RUNOFF POLLUTION PREVENTION REQUIREMENTS BY IMPOSING LOW IMPACT DEVELOPMENT (LID) STRATEGIES ON PROJECTS THAT REQUIRE BUILDING PERMITS AND/OR ENCROACHMENT PERMITS. Moved by Councilmember Macias, seconded by Councilmember Gonzales, to waive further reading and introduce Ordinance No. 2015-03, by the following vote of the Council: YES: COUNCILMEMBERS NO: COUNCILMEMBERS ABSENT: COUNCILMEMBERS 05/18/2015 PAGE THREE GONZALES, MACIAS, ALVAREZ , ROCHA NONE CARRILLO APPEAL BY THE AZUSA NATIONAL LITTLE LEAGUE TO THE CITY MANAGER'S National Little DECISION TO DENY A FIREWORKS SALES PERMIT. League Appeal, Deny of City Manager Butzlaff introduced the item stating that the National Little League is a Legacy Fireworks Fireworks Permit Holder, and they submitted a timely application for the 2015 permit. Based on a Permit criminal investigation by the Azusa Police Department of alleged financial malfeasances related to profits generated from fireworks sales over the past two years, by a past Boardmember of the organization, he determined that a denial to the request for a permit needed to be made. The decision was made based on the Azusa Municipal Code (AMC) §30-105(2), which states that "No person other than the permittee or¢anization shall operate the stand for which the permit is issued or share or otherwise participate in the profits of the operation of such stand." The section also provides for the right of appeal by the league to the City Council. He recommended that Council consider the available the public comments received and provide appropriate direction to staff as to whether the City 'facts, Manager's. denial of a fireworks sales permit to Azusa National Little League should be overturned, overturned with conditions or upheld. Lengthy discussion was held regarding the investigation status by the Azusa Police Department, what Discussion steps the board took to better administer the league's funds, and options for managing the funds while the investigation is open. THE CITY COUNCIL RECESSED FOR A BREAK AT 10:00 P.M. AND RECONVENED AT Recess 10:13 P.M. Moved by Mayor Pro -tem Alvarez, seconded by Councilmember Gonzales, to overturn the City Approve With Manager's decision and allow the issuance of a fireworks permit for 2015, to the Azusa National Little Conditions League, for the year 2015, with the condition that the City of Azusa Finance Department manages all of the fireworks funds until the investigation on the alleged financial malfeasances has been completed by the Azusa Police Department, by the following vote of the Council: YES: COUNCILMEMBERS: GONZALES, ALVAREZ , ROCHA NO: COUNCILMEMBERS: MACIAS ABSENT: COUNCILMEMBERS: CARRILLO CONSENT CALENDAR: Moved by Mayor Pro -tem Alvarez, seconded by Councilmember Consent Gonzales, to approve Consent Calendar Items E-1 to E-6, by the following vote of the Council: Calendar YES: COUNCILMEMBERS: GONZALES, MACIAS, ALVAREZ , ROCHA NO: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: CARRILLO 1. Continued Item - a professional services agreement with Lance, Soll & Lunghard, LLP, for Agreement auditing services was approved, and the Mayor was authorized to execute, in a form acceptable to LSL, Auditing the City Attorney, the professional services agreement on behalf of the City. Services 6. Continued Item - a contract was awarded to Kalban, Inc. for the Sidewalk and ADA Contract Improvements Project No. 601662-14, and the Mayor was authorized to execute, in a form Kalban, acceptable to the City Attorney, the contract on behalf of the City. This action was exempt from Sidewalk & the requirements of the California Environmental Quality Act (CEQA) pursuant to Sections 15301 ADA (Existing Structures) and 15302 (Replacement or Reconstruction) of the State of California CEQA Improvements Guidelines.
