Vasquez The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 East Foothill Boulevard, Azusa, CA 91702. Mayor Rocha called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. CEREMONIAL Call to Order Roll Call Also Present Ceremonial Council presented certificates to Daniel Polarek II and Kyle Carter for their achievement in earning the Certificates Eagle Scout Awards. Eagle Scouts Council presented certificates of achievement to the 2015 Southern California Municipal Athletic Certificates Federation (SCMAF) Track and Field Meet Qualifiers. Dickerson gave an update on students' achievements. Comments Ms. Jeri Vogel announced the 3rd Annual Scrabble Night Fundraiser, sponsored by the Foothill J. Vogel Learning Alliance and the Azusa Chamber of Commerce, on June 25, 2015, 6:00-9:00 P.M., at the Comments Azusa Library. Mr. Hector Elizalde, Congresswoman Napolitano Representative, announced the 4th Annual Veterans H. Elizalde Forum, on July 11, 2015, 8:30 A.M., at the Azusa National Guard Armory. Comments Mr, Christopher Padilla, newly elected First Commander to the Azusa American Legion, announced C. Padilla ' the Board's desire to further their community outreach. Comments COUNCIL BUSINESS AND ANNOUNCEMENTS, STAFF REPORTS, UPDATES Rprts/Update Dr. Dana Hester, Citrus College Social Behavioral Sciences & Distance Education Dean, gave a Citrus College presentation on the Centennial Celebration of Citrus College, which included the history since it was Centennial established in 1915, as well as academic achievements. Presentation Mr. Michael Cacciotti, Air Quality Management District (AQMD) Boardmember, gave a presentation M. Cacciotti update on air quality, clean air funding available, and programs offered by AQMD. Presentation Mayor Pro -tem Alvarez thanked the Veterans Committee for the Memorial Day Event held on May E. Alvarez 25, 2015, and Mr. Hector Elizalde for putting together the Veterans Forum to be held on July 11, Comments 2015, at the Azusa National Guard Armory; he announced the Azusa Youth Program (AYP) Barbecue (BBQ) fundraiser on June 6, 2016, 5:00 P.M. at Memorial Park North Recreation Center. Councilmember Gonzales announced the AYP BBQ fundraiser on June 6, 2015, at Memorial Park. R. Gonzales Councilmember Macias congratulated the 2015 Azusa graduates, and reminded everyone about Flag U. Macias Day, on June 14, 2015. Comments Councilmember Carrillo congratulated the 2015 Azusa graduates. A. Carrillo 'Mayor Rocha announced that the meeting would be adjourned in memory of Mr. Jose Palos Carmona, J. Rocha Korean War Veteran, Mr. Danny "Disco Dan" Martinez,. Sr. and Ms. Alicia Irma Bonilla; he Comments congratulated the 2015 Azusa graduates; he announced: Azusa Beautiful Edgewood Shopping Center Clean up, June 6, 2015, 8:00 A.M.; Yard Sales, June 6 and 7, 2015; Be -A -Walker, June 13, 2015, 8:00 A.M., at Veterans Freedom Park; and Azusa Cares Workshop, June 20, 2015, 10:00-12:00 P.M., Azusa Library Conference Room; he asked everyone to keep service men and women in daily prayers. City Manager Butzlaff announced that the former fresh & easy site at Citrus Crossing Shopping T. Butzlaff Center, may be -sold to Pacific North West Grocery chain, known as Grocery Outlet. The following Resolution No. 2015-C24 was adopted and entitled: Reso 2015-C24 Warrants A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The Human Resources Action Items, in accordance with the City of Azusa Civil Service Rules H.R. Action and applicable Memorandum of Understanding(s), were approved as follows: Item ' Merit Increase and/or Regular Appointments: E. Ibanez, Assistant Planner; T. Bailey, Human Resources/Risk Management Analyst, Rehire: B. Hale, Community Improvement Inspector. Flexible Staffing Promotion: M. It was approved to appropriate $30,000 to Account # 10356430006301, Legal Services, from the Silver & Wright General Fund, to increase the contract amount with Silver and Wright, LLP, for Code Increase Enforcement Legal Services to complete an ongoing litigation. Contract Amt 6. Staff was authorized to solicit Request for Qualifications/Proposals for professional services for RFP-CDBG the CDBG Single -Family Residential Rehabilitation Grant Program and the "HOME" Single- Rehab &Loan Family Residential Rehabilitation Loan Program. Program 7. The following Resolution No. 2015-C25 was adopted and entitled: Reso 2015-C25 Refunding RESOLUTION OF THE CITY OF AZUSA PRELIMINARILY CONSIDERING THE Bonds ISSUANCE OF COMMUNITY FACILITIES DISTRICT NO. 2005-1 REFUNDING BONDS; APPOINTING FINANCIAL AND LEGAL CONSULTANTS IN CONNECTION WITH THE PROPOSED REFUNDING; MAKING CERTAIN DETERMINATIONS RELATING THERETO; AND AUTHORIZING CERTAIN OTHER ACTION IN CONNECTION THEREWITH. ORDINANCE/SPECLAL RESOLUTIONS Ord/Resos Councilmember Carrillo offered an Ordinance entitled: Ord 2015-03 LID Strategies AN ORDINANCE ADOPTING AN AMENDMENT TO CHAPTER 60 OF THE CITY OF AZUSA MUNICIPAL CODE TO EXPAND THE APPLICABILITY OF THE EXISTING STORMWATER AND URBAN RUNOFF POLLUTION PREVENTION REQUIREMENTS BY IMPOSING LOW IMPACT DEVELOPMENT (LID) STRATEGIES ON PROJECTS THAT REQUIRE BUILDING PERMITS AND/OR ENCROACHMENT PERMITS. Said track shall be laid, constructed and maintained in all respects under the supervision and to the satisfaction.of the Superintendent of Streets of said City. 2. That said grantee shall at its own cost and expense pave or macadamize the said street between the rails of said track and for two feet on each side thereof with the same material and in the same material and in the same manner and under the same specifications as the adjoining portions of said street are now or ,may hereafter be improved and. shall also at such times as future improvements of said street shall be made adjoining said track simultaneously improve said street between the rails of said track and for a distance of two -feet on each side thereof with the same material and in the same manner and under the same specifications as the adjoining parts of said street shall be improved and shall keep the same constantly so paved or macadamized or otherwise improved and in repair, flush with the street, and shall make the roadbed conform at all times to the established grade of said street. 3. That said grantee shall construct all necessary culverts and conduits for the free passage of water under said, track wherever and whenever so required to do so by the City Council of said City of Azusa, at such points as may be designated by and in accordance with plans and specifications approved by said Board of Trustees. - 1 - 4. That no cars shall be allowed to stand upon said track in said street in such manner as to obstruct the use of such street by vehicles or pedestrians. 5. That if rock, gravel, sand or other material shall fall from any cars on said track into the said street, said grantee shall, upon being notified so to do by the Street Superin- tendent of the City of Azusa, remove such rock, gravel or sand from -said street. 6. That said grantee shall, before moving or propelling any engine, train or car across said Center Street, give due warning to persons traveling along said. street by a flagman, or such other means as the said City Ofthellaof the City of Azusa may determine will be necessary, of the approach of such.engine, train or car. 6j. That said grantee shall install and perpetually ' maintain at a point between 50 feet and 100 feet'Northerly of and from said Center Street, on its said track, a derailing device which shall be satisfactory to the City Engineer of the City of Azusa. 7. That any failure, neglect or refusal of said grantee, its successors or assigns, to comply with any of the terms and conditions hereof shall thereupon immediately ipso facto effect a forfeiture of all rights hereunder, and said City of Azusa by its City Council may thereupon declare such rights forfeited and may exclude said grantee or its sucdessors or assigns from further use of said street under this ordinance, and said grantee or its successors or assigns shall thereupon immediately surrender all rights in and to the same and all rights granted hereunder shall become and remain null and void. 8. The City of Azusa hereby reserves the right to oil, pave, macadamize or renew said street, or to lay sewers, gas pipes, water pipes, or other pipes, or to place conduits thereon, such work to be done so as to innure the said railroad track as little as possible. SECTION 3: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once in the Azusa Herald and Pomotropic, a weekly newspaper of general circulation, published and circulated in the City of Azusa, which newspaper is hereby designated for this purpose.
