HomeMy WebLinkAboutResolution No. 36421 2 3 4 5 10 11 12 13 14 15 16 17 is 19 20 21 22 23 24 re:p 26 27 28 29 30 31 32 0 0 RESOLUTION NO. 3642 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF IAS ANGELES, CALIFORNIA, WHEREBY AN OFFICIAL OF THE CITY OF AZUSA IS DESIGNATED TO CONDUCT A REFERENDUM RELATIVE TO COVERAGE UNDER OASI AND SETTING THE DATE UN WHICH SUCH COVERAGE SHALL BECOME EFFECTIVE. WHEREAS, the CITY OF AZUSA hereinafter designated as "Public Agency ", desires to include services performed by its employees in positions covered by CALIFORNIA STATE EM- PLOYEES RETIREMENT SYSTEM in the California State Social Security Agreement of March 9, 1951, providing for the coverage of public employees under the insurance system established by Title II of the Federal Social Security Act, as amended; and WHEREAS, State and Federal laws require, as a condition of such coverage, that a referendum first be authorized by the Board of Administration, State Employees Retirement System, and donducted among the "eligible employees" (as defined in Section 218 (d) (3) of the Social.Sbcurity Act) of the Public Agency; and WHEREAS, it is necessary that the "Public Agency" now designate any classes, -of positions covered by said retirement system which it desires to exclude from coverage under said insurance system; NOW, THEREFORE, BE IT RESOLVED, that the Board of Admin- istration, State Employeest Retirement System be, and it hereby is requested to authorize the foregoing referendum; and BE IT FURTHER RESOLVED, that upon receipt of authorization from the Board of Administration, a referendum shall be con- ducted in accordance with the requirements of Section 218(d) of the Social Security Act, and applicable State and Federal laws and regulations; that such referendum shall be held on the question of whether service in positions covered by said retirement system should be excluded from or included under an agreement under the Old -Age and Survivors' Insurance Program under Title II of the Social Security Act, as hereinbefore pro- vided, with such coverage effective as to services performed on and after January ,� 1g57 _; and BE IT FURTHER RESOLVED, that the following classes of positions covered by said retirement system of the "Public Agency" shall be excluded from coverage under said agreement: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 23 24 25 26 27 28 29 30 31 32 -2- BE IT FURTHER RESOLVED, that not less than ninety days notice of such referendum be given to all "eligible employees" as hereinaBove provided; and that JAMES MILLER, CITY CLERKCFTHE CITY OF AZUSA, is hereby designated and appointed to conduct such referendum on behalf of the "Public Agency" in accordance with law, regulations, and this resolution, including the giving of proper notice thereof to all such "eligible employees"; and BE IT FURTHER RESOLVED, that the Public Agency will pay and reimburse the State at such time and in such amounts as may be determined by the State the approximate cost of any and all work and services relating to such referendum. BE IT FURTHER RESOLVED, that the Mayor shall sign this Resolution and the City Clerk shall attest the same and certify to the passage and adoption thereof. allyoroor the City -of Azusa I.
