HomeMy WebLinkAboutResolution No. 3866RESOLUTION NO. 3866 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "SOUTHERLY ANNEXATION DISTRICT NO. 35.° BE IT RESOLVED BY THE COUNCIL OF THE CITY OF AZUSA: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Azusa, on its own motion, to annex to the City of Azusa all that uninhabited territory situate in the County of Los Angeles, State of California, hereby designated as "Southerly Annexation District No. 35" and described as follows: Beginning at the intersection of the easterly line of the strip of land for Azusa Avenue, as described in deed to State of California filed as Document No. 7041-1 on April 10, 1941 under provisions of the Land Title Act, recorded in the office of the Recorder of the County of Los Angeles, with the southerly boundary of the City of Azusa as same existed on March 2, 1959; thence easterly along said southerly boundary to the westerly line of Tract No. 19685, as shown on map recorded in Book 505, pages 8 to 14 inclusive of Maps, in the office of said recorder; thence southerly along said westerly line to the south line of the north half of the southwest quarter of the southwest quarter of the southwest quarter of Fractional Section 2, Township 1 South, Range 10 West, S.B.B. & M.; thence westerly along said south line to said easterly line of Azusa Avenue; thence northerly along said easterly line to the point of beginning. 2. That the Council of the City of Azusa desires to annex said uninhabited territory to the City of Azusa for the following reasons: The territory is contiguous to the City of Azusa, is unin- habited, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed. 3. That the County Boundary Commission of Los Angeles County, California, did in session duly assembled on March 4, 1959, approve the proposed annexation boundaries of said "Southerly Annexa- tion District No. 35" as above described, and as submitted to said Commission by the Council of the City of Azusa. 4. That Monday, April 6, 1959, at the hour of 8:00 P.M., in the Council Chambers of the City Hall in the City of Azusa, County of Los Angeles, California, is hereby fixed as the time and place when and where the City Council will hear protests made by any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Azusa. Such protests must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms. 5. The City Clerk of the City of Azusa is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Azusa Herald and -1- Pomotropic, a newspaper of general circulation published in said City of Azusa, the City to which it is proposed to annex the aforesaid territory, and also in The Los Angeles Daily Journal, a newspaper of general circulation published outside the City of Azusa, but in the County of Los Angeles, California, the county in which is located the territory proposed to be annexed to the City of Azusa, said publication to be complete at least twenty days prior to the date set for hearing. 6. The owner or owners of all of the territory to be an- nexed having filed their consent to such annexation in writing with the City Council, said public hearing has been set less than forty days after the passage of this resolution and the City Clerk need not cause written notice to be mailed pursuant to subsections (a) and (b) of Sec- tion 35311 Government Code. 7. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. 8. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this 4th day of March, 1959.
