A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA REQUESTING THE CALIFORNIA MUNICIPAL UTILITIES
ASSOCIATION AND THE LEAGUE OF CALIFORNIA CITIES TO
INITIATE AND SUPPORT LEGISLATION AMENDING SECTION
37901 OF THE GOVERNMENT CODE TO EXCLUDE MAINTENANCE,
REPAIR, EXTENSIONS AND SERVICE CONNECTIONS OF A
MUNICIPALLY -OWNED UTILITY SYSTEM FROM THE BIDDING
STATUTES.
WHEREAS, Section 37902 of the Government Code requires
public bidding for any public project which exceeds $2,000.00, and
WHEREAS, Section 37901 of said code defines a public project
as including "a project for the erection, improvement, and repair of
public buildings and works", and
WHEREAS, said definition is ambiguous and uncertain in that
it cannot be ascertained definitely whether or not it includes mainte-
nance, repair, extensions and service connections of municipally -owned
public utility systems, and
WHEREAS, the penalties for violation are severe and it is
essential that the said sections be capable of absolute and definite
interpretation, and
WHEREAS, it is impractical and not to the public interest
to require that routine maintenance and repairs to municipally -owned
public utility systems be accomplished by bidding and award of contracts,
and
WHEREAS, routine extensions to municipally -owned utility
systems and service connections such as the installation of transformers
and the like can be performed more promptly and economically by the
employees of the utility system, and
WHEREAS, by reason of additional expense and delay, it is
impracticable and highly undesirable to submit such extensions and
service connections to public bidding;
NOW, THEREFORE, the City Council of the City of Azusa does
resolve as follows:
SECTION 1. That the California Municipal Utilities Associa-
tion and the League of California Cities be and they are hereby res-
pectfully requested to initiate and support legislation to amend Section
37901 of the Government Code so as to remove the ambiguity contained
therein and exclude maintenance and repair and routine extensions and
service connections of a municipally -owned public utility system from
the definition of a public project within the meaning of the bidding
statutes.
SECTION 2. The City Clerk shall certify to the adoption
of this resolution and shall transmit a certified copy thereof to the
California Municipal Utilities Association and to the League of California
Cities.
Adopted and approved this 17th day of February, 1958.

adopted by the City Council of the City of Azusa at a regular meeting
thereof held on the 17th day of February, 1958, by the following vote
of the Council:
