HomeMy WebLinkAboutResolution No. 37040 0 RESOLUTION NO. 3704 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, MAKING FINDINGS, OVERRULING PRO- TESTS AND OBJECTIONS AND ORDERING CHANGES IN THE WORK IN PROCEEDINGS UNDER RESOLUTION OF INTENTION, RESOLUTION NO. 3653• (Assessment District No. 1955-8) WHEREAS, the City Council of the City of Azusa, California, did, by its Resolution No. 3653, adopted on the 3rd day of September, 1957, declare its intention to order the construction of certain street work or improvement under the Improvement Act of 1911,_ Division 7 of the Streets and High- ways Code of the State of California, and in said resolution fixed the 7th day of October, 1957, at the hour of 7:30 o'clock P.M., in the Council Chambers of this City Council, as the time and place for the hearing before this City Council of protests and objections; and WHEREAS, said hearing has been duly held and all protests and objections, if any, were overruled; and WHEREAS, this City Council did, by its Resolution No. 3701, adopted on the 16th day of December, 1957, declare its intention to order certain proposed changes in the work pursuant to Sections 5230 et seq., of the Streets and Highways Code, and fixed the date for hearing on said resolution as the 6th day of January, 1958, at the hour of 7:30 o'clock P.M., in the Council Chambers of this City Council, as the 0 time and place for the hearing before this City Council of objections and protests to said changes; and WHEREAS, at the time and place fixed in said Resolu- tion No. 3701, a hearing was duly held by this City Council at which all written protests or objections, if any, were duly presented, and all persons desiring to be heard were heard, and this City Council gave all persons present an opportunity to be heard in any matter relating to any of the changes proposed in said Resolution No. 3701; and WHEREAS, all persons desiring to appear and be heard have been heard, and this City Council has taken evi- dence relating to the proposed modification in the work and is fully informed in the premises; NOW, THEREFORE, the City Council of the City of Azusa, California, DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: Section 1. That all protests and objections to the changes proposed by said Resolution No. 3701 are hereby over- ruled and denied. Section 2. That public interest and convenience require and the City Council hereby orders the following changes to be made in the work in the proceedings under and pursuant to resolution of intention, Resolution No. 3701, to wit: all those certain changes described in Section 1 of 2. 0 0 Resolution No. 3701, on file in the office of the City Clerk of said city.
