HomeMy WebLinkAboutResolution No. 37880 RESOLUTION NO. 3788 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "SOUTHERLY ANNEXATION DISTRICT NO. 31" AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF AZUSA: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Azusa, on its own motion, to annex to the City of Azusa all that uninhabited territory situate in the County of Los Angeles, State of California, hereby designated as "Southerly Annexation District No.31" and described as follows: Beginning at the intersection of the southerly boundary of the City of Azusa, as same existed March 1, 1958, with a line that is perpendicular thereto and that passes through a point in the north line of the south- east quarter of Fractional Section 3, Township 1 South, Range 10 West, S.B.B.&M., distant easterly thereon 340 feet from the northwest corner of said southeast quarter; thence southerly along said perpendicular line to a point distant southerly thereon 208 feet from the south line of Gladstone Street (formerly Gladstone Avenue, 60 feet wide), as shown on map of Tract No. 13824, recorded in Book 275, pages 1 to 4 inclusive of Maps, in the office of the Recorder of the County of Los Angeles; thence easterly parallel with said south line to the westerly line of the strip of land, 50 feet wide (formerly Little Dalton Wash), as described in deed to Los Angeles County Flood Con- trol District filed on June 12, 1930 as Document No. 189409 under provisions of the Land Title Act, and entered on Certificate of Title No. GG 60142 recorded in the office of the Recorder of said County; thence southerly and southwesterly along the westerly and northwesterly lines of said last mentioned strip of land to the easterly line of Lot 2 of Tract No. 14577, as shown on map recorded in Book 308, pages 35 and 36 of said Maps; thence southerly along said easterly line to the northwesterly line of the strip of land, 65 feet wide, as described in Parcel 160 of Final Judgment in favor of Los Angeles County Flood Control District, a certified copy of which is recorded in Book 37269, page 362 of Official Records of said County; thence northeasterly along said last mentioned northwesterly line to the easterly prolongation of said south line of Gladstone Street; thence westerly along said last mentioned prolongation to a point therein distant easterly along said last mentioned prolongation and south line 1287.76 feet from said northwest corner of the southeast quarter of said Section 3; thence northerly, perpendicular to said south line, to said southerly boundary of the City of Azusa; thence westerly along said southerly boundary to the point of beginning. 2. That the Council of the City of Azusa desires to annex said uninhabited territory to the City of Azusa for the following reasons: The territory is contiguous to the City of Azusa, and its -1- proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout; design and construction of streets, gutters, side- walks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Los Angeles County, California, did in session duly assembled on April 2, 1958s approve the proposed annexation boundaries of said "Southerly Annexa- tion District No. 31" as above described, and as submitted to said Commission by the Council of the City of Azusa. 4. That Monday, October 6, 1958, at the hour of 8:00 P.M., in the Council Chambers of the City Hall in the City of Azusa, County of Los Angeles, California, is hereby fixed as the time and place when and where the City Council will hear protests made by any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Azusa. Such protests must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms. 5. The City Clerk of the City of Azusa is hereby author- ized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Azusa Herald and Pomotropic, a newspaper of general circulation published in said City of Azusa, the city to which it is proposed to annex the afore- said territory, and also in The Los Angeles Daily Journal, a newspaper of general circulation published outside the City of Azusa, but in the County of Los Angeles, California, the county in which is located the territory proposed to be annexed to the City of Azusa, said publi- cation to be complete at least twenty days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the county, such notice to be given not less than twenty days before the first public hearing on the proposed annex- ation. 8. In the event there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause 50 written notice of such proposed annexation to be mailed to the govern- ing body of such district, such notice to be sent not less than ten days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
