HomeMy WebLinkAboutResolution No. 4045RESOLUTION NO. 4045 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "EASTERLY ANNEXATION DISTRICT NO. 38" BE IT RESOLVED BY THE COUNCIL OF THE CITY OF AZUSA: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Azusa, on its own motion, to annex to the City of Azusa all that uninhabited territory situate in the County of Los Angeles, State of California, hereby designated as "Easterly . Annexation District No. 38" and described as follows: That portion of the north half of the southwest quarter of Section 36, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land office on April 6, 1876, described as follows: Beginning at the intersection of the center line of Alosta Avenue with the center line of Ben Lomond Avenue as said center lines are shown on map of Tract No. 23427 recorded in Book 614 pages 44 and 45 of Maps, in the office of the County Recorder of said county (being the center of said Section 36); thence along said center line of Ben Lomond Avenue, South 00 06, 10" East to the easterly prolongation of the northerly line of Lot 4 of said Tract No. 23427; thence along said prolongation and along the northerly boundary line of said Tract No. 23427, South 890 48, 04" West to the northwesterly corner of Lot 25 of said Tract No. 23427; thence along the westerly line of said Lot 25, South 00 031 05" East 0.16 feet to the northeasterly corner of Lot 6 of Tract No. 21736, as shown on map recorded in Book 637 pages 79 and 80 of Maps, in said office of the County Recorder; thence along the northerly boundary line of said Tract No. 21736, South 890 48, 29" West 669.67 feet to the northwesterly corner of Lot 30 of said Tract No. 21736• thence along the westerly line of said Lot 30, South 0& 00, 01" West 28.92 feet to the southerly line of the northeast quarter of the northwest quarter of the southwest quarter of said Section 36; thence along said southerly line South 890 481 04" West to the northeasterly corner of Lot 7 of Tract No..16384, as shown on map recorded in Book 536 pages 49 and 50 of Maps, in said office of the County Recorder, being the northeast corner of the southwest quarter of the northwest quarter of the southwest quarter of said Section 36; thence along the west line of the east half of the northwest quarter of the southwest quarter of said Section 36, North 00 03' 05" East to said center line of Alosta Avenue being also the east and west center line of said Section 36; thence along said last mentioned center line, North 890 47f 15" East to the point of beginning. EXCEPT therefrom that portion of said land included within Ben Lomond Avenue, the westerly line of which is a line parallel with and 20 feet westerly, measured at right angles, from said center line of Ben Lomond Avenue, and also except- ing from that portion of said land included within Alosta Avenue, the southerly line of which is a line parallel with and 50 feet southerly, measured at right angles, from said center line of Alosta Avenue. -1- 4 O 2. That the Council of the City of Azusa desires to.annex said uninhabited territory to the City of Azusa for the following reasons: The territory is contiguous to the City of Azusa, is unin- habited, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed. 3. That the County Boundary Commission of Los Angeles County, California, did in session duly assembled on February 9, 1960, approve the proposed annexation boundaries of said "Easterly Annexation District No. 38` as above described, and as submitted to said Com- mission by the Council of the City of Azusa with certain revisions reflected herein. 4. That Tuesday, July 51 1960, at the hour of 8:00 P.M., in the Council Chambers of the City Hall in the City of Azusa, County of Los Angeles, California, is hereby fixed as the time and place when and where the City Council will hear protests made by any person owning real property within the uninhabited territory above described and pro- posed to be annexed to the City of Azusa. Such protests must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms. 5. The City Clerk of the City of Azusa is hereby authorized and directed to cause a copy of this resolution to be published at leasttwice, but not oftener than once a week, in the Azusa Herald and Pomotropic, a newspaper of general circulation published in said City of Azusa, the City to which it is proposed to annex the aforesaid territory, and also in The Los Angeles Daily Journal, a newspaper of general circulation published outside the City of Azusa, but in the County of Los Angeles, California, the county in which is located the territory proposed to be annexed to the City of Azusa, said publication to be complete at least twenty days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty days before the first public hearing on the proposed annexation. 7. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. 8. The proceedings hereby initiated are hereby declared to be alternative to the proceedings to annex the territory above described which were initiated by Resolution No. 4012 adopted March 7, 1960, and are intended to proceed only in the event said proceedings so initiated by said Resolution No. 4012 should be declared illegal or invalid or should be enjoined or terminated prior to completion; but if said pro- ceedings are completed, the proceedings initiated by this resolution shall be dismissed and terminated. This resolution is not and shall not be considered to be an admission, confession or concession that the proceedings initiated by said Resolution No. 4012 are in any way illegal, invalid or defective. -2- resolution. 9. The City Clerk shall certify to the adoption of this Adopted and approved this 16th day of Tray.:, 1960.
