HomeMy WebLinkAboutResolution No. 4295RESOLUMON N0. 4295 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON- VENIENCE, AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC USE FOR RESERVOIR PURPOSES AND FOR RIGHTS OF WAY THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines, and declares that the public interest and necessity require respectively the acquisition of the fee title to certain real property and easements for rights of way purposes over certain real property, all as hereinafter described for the respective uses hereinafter set forth for the respective parcels of real property described, each of said uses being for a public use as described. That the location of the land for said improvements has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council hereby finds, determines, and declares that in order to acquire the interests in said prop- erty hereinafter described and use the same for the purposes here- inafter set forth, the public interest, convenience, and necessity require the acquisition of titles and interests by the City of Azusa to that hereinafter real property described as set forth for each of said descriptions; and the City Council hereby declares it is the intention of the City of Azusa to acquire in its name the respective interests and titles to the respectively hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. 0 0 SECTION 3. That the said real property, the acquisition of which is required by the public interest, convenience, necessity, and the purposes for each which said parcel is to be acquired and the title or interest to be acquired, is respectively as follows: Parcel 1 The acquisition of a right of way in, on, over, under, and along the hereinafter described real property for vehicular and other access to, and egress from, that certain property described as parcel 3 herein. Said real property is described as follows: (a) That portion of the south half of the southwest quarter of Section 23, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, accord- ing to the official plat of said land filed in the District Land Office April 60 1876, more particularly described as follows: Beginning at a point in the south line of said southwest quarter, distant thereon South 890 19' 13" East 857.34 feet from the southwescorner of said southwest quarter; thence North 16 11' 20" East 61.94 feet; thence South 730 48' 4o" East 12.50 feet; thence South 160 11' 20" West 58.47 feet; thence North 890 19' 13" West'12.97 feet, along the said south line, to the true point of beginning. (b) That portion of the south half of the southwest quarter of Section 23, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land Office April 6, 1876, more particularly described as follows: Beginning at a point in the south line of said southwest quarter, distant thereon South 890 19' 13" East 909.22 feet from the Southwest corner of said southwest quarter; thence North 160 11' 20" East 48.06 feet; the$ce North 730 48' 40" West 12.50 feet; thence South 16 11' 20" West 51.53 feet; thence South 890 19' 13" East 12.97 feet, along the said south line, to the true point of beginning. (c) A strip of land 25 feet wide being a portion of the south half of the southwest quarter of Section 21. Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land Office April 6, 1876, more particularly described as follows: -2- 0 0 Said 25 -foot wide strip of land lying 12.5 feet on each side of the following described centerline: Beginning at a point in the south line of said southwest quarter, distant thereon South 890 19' 13" East 883.28 feet from the southwest corner of said southwest quarter; thence North 160 11' 20" East 240.00 feet; thence North 230 41' 20" East 221.02 feet; thence North 470 34' 45" West 79.00 feet to the beginning of a tangent curve concave to the southeast and having a radius of 50 feet; thence northwesterly, northerly and northeasterly along said curve, through a central angle of 1110 35' 37", a distance of 97.38 feet to the beginning of a compound curve concave to the southwest and having a radius of 35 feet; thence easterly along said curve, through a central angle of 830 501 18".. a distance of 51.21 feet; thence South 320 08! 50" East 36.56 feet to the beginning of a tangent curve concave to the northeast and hav- ing a radius of 45 feet; thence southeasterly along said curve, through a central angle of 570 101 23"2 a distance of 44.90 feet; thence South 890 19' 13" East 17.62 feet to the beginning of a tangent curve concave to the southwest and having a radius of 70 feet; thence southeasterly along said curve, through a central angle of 500 44' 05, a distance of 61.98 feet; thence South 380 35' 08 East 9.22 feet to the beginning of a tangent curve concave to the northeast and having a radius of 40 feet; thence southeasterly along said curve, through a central angle of 6a° 03' 29, a distance of 46.82 feet; thence North 74 21' 23 East 1.30 feet to the beginning of a tangent curve concave to the south and having a radius of 175 feet; thence east&rly along said curve, through a central angle of 22 09' 09", a distance of 67.66 feet; thence South 83° 29' 28" East 47.45 feet to the beginning of a -tangent curve concave to the west and having a radius of 27.50 feet; thence easterly, northerly and westerly along said curve, through a central angle of 1900 52' 09" a distance of 91.61 feet; thence South 850 38' 233' West 45.50 feet. The side lines of the above described 25 -foot wide strip of land are to be prolonged or shortened so as to terminate in a line bearing South 440 451 12" West and passing through the westerly extremity of said last mentioned course, so as to terminate at their points of intersection and so as to terminate in the said south line of said southwest quarter. Parcel 2 The acquisition of a right of way in, on, over, under and along the hereinafter described real prop- erty for the purposes of a water pipe line and electric line purposes. Said real property is described as follows: -3- 0 0 A strip of land 25 feet wide, being a portion of the south half of the southwest quarter of Section 23, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land Office April 6, 1876. Said 25 -foot wide strip of land lying 12.5 feet on each side of the following described centerline: Beginning at a point in the south line of said southwest quarter, distant thereon South 890 191 13" East 883.28 feet from the southwest corner of said southwest quarter; thence North 160 ill 20" East 240.00 feet; thence North 230 41' 20" East' 298.11 feet; thence South 890 191 13" East 99.22 feet; thence North 460 36, 16" East 5.31 feet. The side lines of the above described 25 -foot wide strip of land are to be prolonged or shortened so as to terminate in said south line of said south- west quarter, so as to terminate at their points of intersection and so as to terminate in a curved line passing through the northeasterly extremity of the above described centerline, said curved line being concave to the southwest and having a radius of 130 feet; a radial line of said curve passing through said northeasterly extremity bears North 250 02' 06" East. Parcel The acquisition of the fee title of the following described real property for reservoir purposes. Said real property is described as follows: That portion of the south half of the southwest quarter of Section 23, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land Office April 6, 1876, described as follows: Commencing at a point in the south line of said southwest quarter, distant thereon South 890 191 13" East 883.28 feet from the southwest corner of said southwest quarter; thence North 16v 111 20" East 240.00 feet; thence North 230 411 20" East 298.11"feet; thence South 890 191 13" East 99.22 feet; thence North 46 36, 16" East 5.31 feet to the true point of beginning, said true point of beginning lying on a curve concave to the southwest and having a radius of 130 feet, a radial line of said curve through said true point of beginning bears North 250 021 06" East; thence northwesterly along said curve, through a"central angle of 20 41, 12', a distance of 6.10 feet; thence North 60 401 47" East 139.19 feet; thence North 160 561 24" East 125.00 feet; thence South 890 19' 13" East 140.00 feet; thence South 170 33' 20" East 156.52 feet; thence South 440 451 12" West 169.65 feet; thence South 690 o4l 00 West 61.51 feet to a -4- 0 0 point on said previously mentioned curve, a radial line of said curve through said point bears North 480 47' 33" East; thence northwesterly along said curve, through a central angle of 230 451 27", a distance of 53.90 feet to the true point of begin- ning. Parcel 4 The acquisition of a temporary right of way in, on, over, under, and along the hereinafter described real property for access to, and egress from, the parcels of land hereinabove described for construction purposes for the period ending July 31, 1962. Said real property is described as follows: (a) That portion of the south half of the south- west quarter of Section 23, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land Office April 6, 1876, described as follows: Commencing at a point in the south line of said southwest quarter, distant thereon South 890 191 13" East, 883,28 feet from the southwedst corner of said southwest quarter; thence North 16 111 20" East 240.00 feet; thence North 23° 411 20" East"110.00 feet; thence South 660 18' 40" East 12.50 feet to the true point of beginning; thgnce North 510 41, 20" East 50.00 feet; thence North 23 41, 20" East 50.00 feet; thence North 190 44' 53" West 35.16"feet; thence South 230 41, 20" West 120.00 feet to the true point of begin- ning. (b) That portion of the south half of the southwest quarter of Section 23, Township 1 North, Range 10 West, San Bernardino Meridian, in the County of Los Angeles, State of California, according to the official plat of said land filed in the District Land Office April 6, 1876, described as follows: Commencing at a point in the south line of said southwest quarter, distant thereon South 890 191 13" East 883.28 feet from the southwes8 corner of said southwest quarter; three North 16 11' 20" East 240.00 feet; thence North 23 411 20" East 298.11"feet; thence South 890 19' 13" East 99.22 feet; thence North 460 36, 16" East 5.31 feet to a point on a curve concave to the southwest and having a radius of 130 feet, a radial line of said curve through said point bears North 250 02' 06" East; thence southeasterly along said curve through a central angle of 230 45' 27". a distance of 53.90 feet; thence North 690 041 00" East 61.51 feet to the true point of beginning; hence South 14° 241 37" East 35.32 feet; thence South 6 301 32" East 17.50 feet; thence South 830 29' 28" East 115.00 feet; thence North 60 301 32" East 100.00 feet; thence North 840 001 43" West 89.25 feet; thence South 440 45' 12° West 62.00 feet to the true point of beginning. -5- 0 0 That the City Attorney of the City of Azusa and the firm of Burke, Williams & Sorensen hereby are authorized, empowered, and directed to prepare, institute, and prosecute in the name of the City of Azusa such proceedings in the proper court having jurisdiction thereof as are necessary for the condemnation and the acquisition of the titles and interests hereinabove described. Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an Order of Immediate Possession for the use and occupancy of said property and the deposit of any money by the City necessary therefor is hereby approved and authorized. SECTION 4. The City Clerk shall certify to the adoption of this resolution.
