HomeMy WebLinkAboutResolution No. 4392RESOLUTION NO. 4392 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS AND DRAINAGE SYSTEMS KNOWN AS AZUSA - BEATTY CANYON CHANNEL HILLTOP DRIVE DRAIN FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT WHEREAS, the storm drain improvement and drainage system known as Azusa - Beatty Carryon Channel Hilltop Drive Drain, described In Exhibit A attached hereto, has been constructed within and accepted by the City of Azusa; and WHEREAS, the City of Azusa Is authorized and empowered to transfer and convey unto the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair and improvement; and WHEREAS, the Board of Supervisors of the Los Angeles County Flood Control District is authorized and empowered under Section 13 3/4 of the Los Angeles County Flood Control Act, as amended by Chapter 829 of the California Statutes of 1957, to accept on behalf of sold District a transfer and conveyance of storm drain improvements and drainage systems lying within the territorial boundaries of said District whenever the governing body of any public agency owning or having jurisdiction over such storm drain improvements and drain- age systema by resolution requests said Flood Control District to accept such improvements and systems, except that such Flood Control District shall not assume or be liable for any bonded indebtedness that may be against such storm drains or drainage systems; and WHEREAS, the public interest will best be served by transfer and conveyance of the storm drain improvements and drainage systems described in said Exhibit A from the City of Azusa to the Los Angeles County Flood Control District for future operation, maintenance, repair and improvement; NOW, THEREFORE, BE IT RESOLVED that the City of Azusa, by a vote of four-fifths of the members of its City Council, does hereby transfer and convey to the Los Angeles County Flood Control District for future operation, maintenance, repair and improvement, the storm drain improvements and drainage systems described in said Exhibit A, subject to the accept- ance thereof by resolution of the Board of Supervisors of the Los Angeles County Flood Control District, which Board of Supervisors Is the Board of Supervisors of the County of Los Angeles, acting ex -officio as the Board of Supervisors of said District; and BE IT FURTHER RESOLVED that the City Engineer of the City of Azusa shall prepare all necessary instruments and documents, including deed to effectuate said transfer and convey- ance and to obtain the approval thereof of the Chief Engineer of sold District, and that the Mayor acting on behalf of the City of Azusa is authorized and instructed to execute said instruments and documents, when approved by the City Attorney. Reference is hereby made to said Exhibit A for further data as to the exact locotlon, extent and description of said storm drain improvements and drainage systems.
