RESOLUTION NO. 4727
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA FINDING AND DETERMINING THAT THE PUBLIC
INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC USE
FOR STREET AND HIGHWAY PURPOSES. (Todd Avenue)
The City Council of the City of Azusa does resolve as
follows:
SECTION 1. That the City Council hereby finds, determines
and declares that the public interest and necessity require the acqui-
sition of an easement and right of way in, over and under the herein-
after described real property for street and highway purposes.
That the location and alignment for said easement and right
of way has been planned and located in the manner which will be most
compatible to the greatest public good and the least private injury.
SECTION 2. That the City Council hereby finds, determines
and declares that, in order to acquire said easement and right of way
and use the same for said purposes, the public interest, convenience
and necessity require the acquisition of the right of way by the City
of Azusa in, over and under that real property hereinafter described,
and the City Council hereby declares it is the intention of the City
of Azusa to acquire in its name said right of way in, over and under
the hereinafter described real property by condemnation in accordance
with the provisions of the Code of Civil Procedure and the Constitution
of the State of California authorizing the exercise of the right of
eminent domain.
SECTION 3. That said real property, the acquisition of an
easement and right of way in, over and under which is required by the
public interest, convenience and necessity for the purposes set forth
in Sections 1 and 2 hereof, is described as follows:
Those portions of Lots 33, 34, and 42, Subdivision No.
2 Azusa Land and Water Company as recorded in Book 43,
Page 94 of Miscellaneous Records in the office of the
County Recorder, County of Los Angeles, State of Cali-
fornia, more particularly described as follows:
PARCEL NO. 1
A stri of land 10 feet in width (measured at right
angles the easterly line of said strip being the
easterly line of said Lots 33 and 34, and bounded northerly
by the southerly line of the Pacific Electric Railway
Company's right of way (100 feet wide) as it existed
on August 25, 1964, and bounded southerly by the
northerly line of Foothill Boulevard (100 feet wide)
as it existed on August 25, 1964, together with that
portion of Lot 33 bounded easterly by the westerly line
of said 10, strip, bounded southerly by the northerly
line of Foothill Boulevard (1001 wide as it existed on
August 25, 1964) and bounded northwesterly by a curve
concave to northwest, with a radius of 25 feet, said curve
being tangent at its northerly end to the westerly line
of the 101 strip and being tangent at its southerly end
to the northerly line of Foothill Boulevard (1001 wide
as it existed on August 25, 1964).

PARCEL NO. 2
A strip of land 60 feet in width (measured at right
angles the westerly line of said strip being the
westerly line of said Lot 42, and bounded northerly
by the southerly line of the Pacific Electric Railway
Company's right of way (100 feet wide) as it existed
on August 25, 1964, and bounded southerly by the
southerly line of the north 1/2 of said Lot 42.
SECTION 4. That the City Attorney of the City of Azusa and
Burke, Williams & Sorensen hereby are authorized, empowered, and directed
to prepare, institute and prosecute in the name of the City of Azusa
such proceedings in the proper court having jurisdiction thereof as are
necessary for the condemnation of the said easement and right of way
described herein.
Said attorneys hereby are authorized and empowered to take
such procedure as may be necessary to secure an order of immediate
possession for the use and occupancy of said property, and the deposit
of any money by the City necessary therefor, is hereby approved and
authorized.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
