RESOLUTION NO. 4675
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA FINDING AND DETERMINING THAT THE PUBLIC
INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC USE
FOR STREET AND HIGHWAY PURPOSES,
The City Council of the City of Azusa does resolve as follows:
SECTION 1. That the City Council hereby finds, determines
and declares that the public interest and necessity require the acqui-
sition of an easement and right of way in, over and under the herein-
after described real property for street and highway purposes.
That the location and alignment for said easement and right
of way has been planned and located in the manner which will be most
compatible to the greatest public good and the least private injury.
SECTION 2. That the City Council hereby finds, determines
and declares that, in order to acquire said easement and right of way
and use the same for said purposes, the public interest, convenience
and necessity require the acquisition of the right of way by the City
of Azusa in, over and under that real property hereinafter described,
and the City Council hereby declares it is the intention of the City
of Azusa to acquire in its name said right of way in, over and under
the hereinafter described real property by condemnation in accordance
with the provisions of the Code of Civil Procedure and the Constitution
of the State of California authorizing the exercise of the right of
eminent domain.
SECTION 3. That said real property, the acquisition of an
easement and right of way in, over and under which is required by the
public interest, convenience and necessity for the purposes set forth
in Sections 1 and 2 hereof, is described as follows:
Parcel 1: That portion of Lot 42, Subdivision #2, Azusa
Land a Water Company, as recorded in Book 43, Page 94,
of Miscellaneous Records, in the office of the County
Recorder, County of Los Angeles, State of California,
described as follows:
Commencing north 300 feet from southwest corner of said
Lot 42; thence north on west line of said lot 100 feet;
thence east parallel with south line of said lot 337.99
feet to west line of Loren Avenue; thence south thereon
100 feet; thence west 337.38 feet to the point of
beginning.
Parcel 2: That portion of Lot 42, Subdivision #2 Azusa
Land and Water Company, as recorded in Book 43, Page 94,
of Miscellaneous Records, in the office of the County
Recorder, County of Los Angeles, State of California,
described as follows:
The northerly 240 feet of the southerly 660 feet of that
portion of said Lot 42 which lies westerly of the
northerly prolongation of the westerly line of Loren
Avenue.
Also the northerly 20 feet of the southerly 420 feet of
that portion of said Lot 42 which lies westerly of the
northerly prolongation of the westerly line of Loren
Avenue.
SECTION 4. That the City Attorney of the City of Azusa and
Burke, Williams & Sorensen hereby are authorized, empowered, and directed
to prepare, institute and prosecute in the name of the City of Azusa
such proceedings in the proper court having jurisdiction thereof as
are necessary for the condemnation of the said easement and right of
way described herein.
Said attorneys hereby are authorized and empowered to take
such procedure as may be necessary to secure an order of immediate
possession for the use and occupancy of said property, and the deposit
of any money by the City necessary therefor, is hereby approved and
authorized.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
Adopted and approved this 15th day of June , 1964.
I hereby certify that the foregoing resolution was duly
adopted by the City Council of the City of Azusa at a regular meeting
thereof held on the 15th day of June , 1964, by the following
vote of the Council:
AYES: Councilmen: Rubio, Cooney, Jackson; McLees, Memmesheimer
NOES: Councilmen: None
