HomeMy WebLinkAboutResolution No. 272140 0 ,Resolution NO 272. .A RESOLUTION OF THE BOARD OF 'TRUSTEES OF THE CI'T'Y OF AZUSA ADOPTING SPECIFICATIONS FOR THE PLAN'T'ING OF SPERCULIA (DiVERSIFOLIA) TREES TN THE SAID CITY. The Board of Trustees of the City of Azusa do ,resolve as follows; RB$OLVL,D, that there be adopted Specifications for the planting of Sperculia. (Diversifolia)trees and that said specifications shall be known and descritled as Specifications NO and shhll be in the words and figures as followe,.to6wit; Section 1. The work herein provided for is to be done in accordance with the plans, profiles and detail drawings on file in the office of the City Engineer of the City of Azusa, and all work shall , during its progress and on its completion, con- form to the lines, levels and grade which may, from time to time, be gived by the said City Engineer. Section 2.. The trees to be planted in conform- ity to these specifications shall,be Sperculia (Diversifolia) trees and shall be not less than two feet -nor more than.three feet in height above the official grade of the street upon which the same is planted after the completion of the plant- ing thereof, and the trunk of the trees at a point six inches above the official level of the ground surrounding said trees shall be not less -than 3/8 inches nor more than 3/4 inches in diameter. Such trees shall be free from scale and any and all disease and the roots thereof shall be free from any and all disease. Section 3. The holes for eaid trees shall be dug at a distance of 25 feet apart at the places s11ojvn therefor upon the aforesaidplans, profiles and detail drawings and shall be three feet in diameter and three feet deep. No tree shall be set closer than 25 feet to the intersecting street property lines. All rock, gravel, clay and other 0 '0 141 solis and materials other than good earth shall be removed and said holes filled back with good earth to a line six inches from the top of said holes. Said holes shall then be filled with water and left for two days, then enough earth shall be dug out from the center of said holes to allow the trees to be planted therein ih a perpendicular position. In planting the trees in such holes, they shall be filled with dirt up to the point on the trunk to the depth the trunk was in the ground when dug out of the nursery and such earth shall be carefully packed around the roots and trunks od said trees. Care being used not to in- jure said roots or scar said trunks. A rim shall then be constructed around said holes not filled frith water and allowed to soak away graduAlly. A specimen tree of the size to be subditted with the bid and that submitted by the successful bidder shall be placed in the City,Hall i.n a wooden box or other convenient receptacle and retained in said City Hall until the completion and acceptance of all said work. No tree will be Accepted which is irregular or deformed in appearance and all tree8 shAll be straight stalk to a height of two feet from the ground, and free from scars, bruises or other blemishes. GE,YIM L REQUIREMENTS. Section 4. All work shall be executed in every respect in a thorough and workmanlike manner. The Contractor shall preserve all stakes set for the linea, levels or measurements of the work, in their proper places until authorized to remove them by the City Engineer, and any expense incurred in replacing said stakes which the Contractor or his subordinates may have failed to preserve shall be borne by the Con- tractor. Any overseer, superintendent, laborer or other person employed on the work by the Contractor, who shall perform his work in a manner contrary to these specifications, shall be discharged immediately and such I a 142 • person shall not again be employed on the work. All loss or damage arising from any unforseen obstruction or sifficulties, which may be encountered in the prosecution of the wotk, or from any action of the elements, or from any act or omission not authorized by these specifications, on the part of the von - tractor, or any agent or person employed by him, shall be sustained by the contractor. No work which may be defective in its construe - tion, or deficient in any of the reauirements of these specifications will be considered as accepted in consequence of the failure of any officer of the City •or inspector connected with the work, to point out said defects or defidiency during con- struction, and the contractor shall correct any imperfect work, whenever discoveded, before the final acceptance of the work. The Contractor assumes all risk of variance in any computation or Statemant'oP amounts or quantities necessary to complete the work required by this contract, and agrees to furnish all necess- ary labor and materials, and to fully complete said work in accordance with the plans, profiles, detail drawings and cross-sections, bidders must examine and determine for them- seldes as to the location of the proposed work, and the nature of the excavation to be made and the work to be done. The contractor shall give forty-eight (4E) hours notice, in writing, when he will require the services of the City Engineer Ror laying out any portion of the work. Ile shall dig all stake holes necessary to give lines and levels. ` The Contractor shall not disturb any monuments or stakes found on the line of the improvements until ordered by the City I,ngineer, and he shall bear the expense of re -setting any monuments or stakes which may be disturbed without orders. The contractor shall remove, at his own ex - pence, all obsyrurtions such as trees, stones, • 143 debris, etc, that may be in the way of making the proposed improvements. The contractor shall observe all the ordinances of the City of Azusa in relation to the obstruction of the streets, keeping open passageways and protecting the same where they are exposed and would be dangerous to public travel. ]ie shall also erect and keep erected, by day and night, a fence or proper barrier along the line of the work and across the ends of the same, in order to guard the public effectively from danger of falling into trenches, or from upsetting their vehicles _ against the earth thrown up during the progress of the work, and he shall post all proper notices and signals to the public of the state of the street while the work is in progress. In case it should be necessary to move the pro- perty of any owner of a public utility or franchise, such owner will, upon proper application by the con- tractor, be notified by the street Superintendent to move such property within a specified reasonable time, and the contractor shall not interfere with said pro- perty until after the expiration of the time specified. The right is reserved to the owner] of public utilities and franchises to enter upon the street for the purpose of making repairs or changes of their property that may become necessary by the work. The City shall also have the privilebe of entering upon the street for the purpose of repairing sewers, or making house drain connections therewith, or repair - Ing culverts or storm drains. The contraetmr shall remove all surplus materials and rubbish from the work after its completion, and before he makes application for the acceptance of the work. The contractor shall notify the Street Superinten- dent when he desired a. final inspection of the work, when the latter will, as soon as possible, make the necessary examination, and if the work is found in 144 0 0 compliance with the above specifications, the street Superintendent will furnish thevcontractor with a certificate to that effect. n Whenever the word"Contractor" is used in these specifications, it refers to the party or parties of the second part in the agreement for the construction of the work herein specified. Whenever the word"Street Superintendent" or "City Engineer" are used in these specifications, they refer, respectively, to the Street. Superintendent or the City Engineer of the City of Azusa, or their authorized agents or inspectors. The foregoing Resolution was duly adopted at a regular meeting of the Board of Trustees of the City of Azusa, hold on the 28th day of April, 1913, by the affirmative vote of at least three 'Trustees of said City, to -wit; Ayes; Barnes Clark Roach Noes; Nose.
