HomeMy WebLinkAboutResolution No. 2098RESOLUTION NO. 20gg FORM OF RESOLUTION TO BE INSERTED IN MINUTE BOOK RESOLVED, that a copy of that certain Notice entitled 'Notice No. Z of Intention to Sell City of ,Azusa Owned Real Property and Inviting Bid or Offers Therefor.', dated the 14 day of July , 1947, be placed on file in the office of the City Clerk of said City for the purpose of identi- fication and reference; and BE IT.FURTHER RESOLVED, that. the City Council hereby approves said form of notice and does hereby invite bids or offers for the real properties therein described, as therein contemplated; and BE IT FURTHER RESOLVED, that the City Council hereby elects to sell said properties as described in said notice by private sale and on the terms and conditions as set .forth in said notice; and BE IT FURTHER RESOLVED, that the City Clerk be and she is hereby authorized to instruct to cause said notice to be published in the official newspaper of said City, to -wit: Azusa Herald and Pomotropic, in the time, form and manner required by law; and BE IT FURTHER RESOLVED, that the said "Notice No. Six of Intention to Sell City'of Azusa Owned Real Property and Inviting Bids or Offers Therefor.", which is on file as aforementioned and open .to public inspection is hereby referred to and by this reference expressly incorporated herein and made a part hereof. -0- zOyB NOTICE MD--�TX� OF INTENTION TO SELL CITY OF AZUSA O'NDiED REAL PROPERTY AND INVITING BIDS OR OFFERS THEREFOR. (Quitclaim Deed Only) PUBLIC NOTICE IS HEREBY GIVEN that the City of Azusa, California intends to sell at private sale and to convey to the successful bidder by quitclaim deed only and without guarantee of title, all of the following described parcels of real property or any portion thereof situated in the City of Azusa, County of Los Angeles, State of California, described as follows; Lot 40 in Chester R. Pyle's Mountain View Tract, as per Book. 12, Page =85 of Maps, Records of Los Angeles County. Lots 28, 29, 30, 31, 32, 330 34, 35, 36, 370 380 39, 42, 52, 53, 54, 55, 56, 570 58,.59, 60, 61, 62 and 63, all in Tract No. 9425, as per Book 128, Pages 3-4 of Maps, Records of Los Angeles County. Lots 6, 26, 50, 51, 52, 53; 54, 55, 56, 74, 75, 76, 77, 78, 79, 80, 81, 89, 98, 99, 100, 1010 1020 103, 104, 105, 124, 125, 126, 128, 129, 130, 131, 150, 151, 152, 153, 154, 155, 156, 157, 158, 159, 161, 162; 176, 177, 178, 179, 180, 181, 182, 183, 185, 186, 187, 188, 213, 214, 215, 216, 217 and Y, all in Tract No. 10660, as per Book 164, Pages 13-14 of Maps, Records.of Los Angeles County. NOTICE IS HEREBY FURTHER GIVEN that the City of Azusa has heretofore purchased by tax deed from the State of California its interest in and to said above described parcels of property; and that each and all of the said above described parcels of property have heretofore been tax deeded to the City of Azusa pursuant to the ordinances of the City. THAT THE QUITCLAIM DEED WHICH THE CITY OF AZUSA WILL EXECUTE AND DELIVER TO A SUCCESSFUL BIDDER WILL CONVEY TO SAID SUCCESSFUL BIDDER ONLY THE RIGHT, TITLE AND INTEREST THAT THE CITY OF AZUSA HAS IN,OR TO SUCH PROPERTY BY VIRTUE OF THE TAX DEED _ FROM THE STATE OF CALIFORNIA TO THE CITY CP AZUSA AND BY VIRTU OF THE TAX DEED TO THE CITY OF AZUSA AS PROVIDED BY ITS ORDIFiANCES. NOTICE IS HEREBY FURTHER GIVEN that all of said properties are to be sold by the City as above set forth and conveyed 1. • subject to conditions, covenants, reservations, restrictions, rights, rights of way, matters of record and ALL SPECIAL ASSESSMENT LIENS AFFECTING THE SAI4iE WHICH HAVE NOT BEEN CANCELLED OR WERE NOT INCLUDED IN THE AMOUNT NECESSARY TO REDEEM THE PROPERTY FROM THE SALE TO THE STATE OR FROM THE SALE TO THE CITY OF AZUSA. ALL BIDDERS ARE CAUTIONED TO EXAMINE ALL CITY AND COUNTY RECORDS PERTAINING TO SAID PARCELS OF REAL PROPERTY SO THAT THEY MAY BE FULLY INFORMED AS TO CONDITION OF TITLE, CONDITIONS, RESERVA- TIONS, RESTRICTIONS, RIGHTS, RIGHTS OF WAY, MATTERS OF RECORD AND SPECIAL ASSESSNMNTS, IF ANY, AFFECTING THE SANTE. Bids or offers for all of said properties, or for any of said properties, are hereby invited hereunder. One or more parcels may be included in the same bid, but each parcel must be bid upon separately. All bids or offers must be in writing and will be received at the office of the City Clerk in the City Hall of said City, in said City, and will thereupon be filed in his office. Envelopes containing bids should be sealed and plainly marked on the outside thereof "Bid on Real Property Under Notice of Intention No. Six". Bids must be for cash. Any sales made hereunder will be made subject to all the provisions of the ordinances of the City of Azusa now in effect or which may hereafter become effective prior to and including the date of said sale. That a certified or cashier's check for said sum of at least 25% of the bid price, payable to the City of Azusa, or order, must accompany the said bid or offer. Successful bidders must pay the full amount of the bid within 22 dad yys.from the date of acceptance of the bid., If such successful bidder fails to pay the full balance due within said 30 -day period,.the City, at the option of the City Council, shall be relieved of its obligation in respect thereto and the initial payment accompanying the bid shall be forfeited to the City as full and liquidated damages and said City shall be free and without liability to said successful bidder to sell said property to any other purchaser. 2. y While bids or offers under the provisions hereof may be filed at any time after the date of the publication of Notice of Intention to Sell, yet the Council hereby specifically notifies. all bidders that under this particular Notice of Intention to Sell the Council will not consider an opening bid unless said bid is sealed and presented to'the Council in writing, all as hereinbefore provided. At the time the written offer is opened and considered by the Council, the Clerk will call for oral bids, but no oral bid will be.considered by the Council unless the same increases the original written bid by at least 100 of the amount of said original written bid. Bidders are, therefore, cautioned to be present at the Council meetings at the time written offers to purchase property are opened and considered by the Council. The Council reserves the right to accept any bid or to reject all bids. It is provided, however, that in the event no bids are received at said first Council meeting,or if all bids so received at said first Council meeting on any such parcel or parcels are rejected, sealed bids may thereafter be filed as heretofore provided for consideration and action at the next succeeding or any subsequent Council meeting as in the first instance. All bidders are notified to specifically state in their bids the name, or names, of the person, or persons, to be named grantee in the deed to be issued and the manner in which title is to be vested. If the bid fails to contain such instructions, the property will be conveyed by the City to the successful bidder as named in the bid. All bidders are notified that the Council will not consider any bids of the real property described herein until twenty-one days from and after the date of the first publication of this notice. For any further information, bidders are referred to and may see the City Clerk at her office in said City Hall.
