HomeMy WebLinkAboutResolution No. 20940 0 I RESOLUTION NO. 2094 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING VARIANCE FOR PORTIONS OF LOTS 11 AND 12, SUBDIVISION #2 of AZUSA LAND AND WATER COMPANY, TO L. A. CROWS AND R. S. CROWE. The City Council of the City of Azusa does resolve as follows: WHEREAS L. A. Crowe and R. S. Crowe have heretofore filed a' petition with the city planning commission requesting a variance for that real property located in the City of Azusa, County of Los Angeles, State of California, described as follows: Portions of Lots 11 and 12 Sub -division #2 of Azusa Land and Water Company as per map re- corded in Book 43, page 9.4 of miscellaneous records in the office of the County Recorder of said County, described as follows: Beginning at a point in the Westerly line of Motor Ave. as shown on the map of Tract #8507 recorded in Book 102, page 78 of Map, 815.36 feet South from the NW corner of Tract #8507, thence South 00 12+ 02^ East 921.9%thence South 890 471 58^ 1� r5r No. 57 r/f.; sm.����y sF'-�• 9��.ag�, -East�945�ft.�to the point of beginning; Excepting therefrom, any portion included within the lines of any public street, highway, or alley: Also excepting that portion lying West of the East line of the land described in Decree of Condemnation recorded in Book 20066 page 335, official records of said County; -1- 0 P so as to permit the operation of a "Bakelite" type plastics manu- facturing plant and sales of finished products therefrom, together with a manufacturing plant for phenol and allied chemicals, and further requesting that a variance be granted placing said above described property in Zone M-2, as provided by the zoning ordinance of the City of Azusa No. 349. ; and WHEREAS it has been agreed that the following stipulations will be complied with as conditions subsequent for the continuation of said variance, to -wit: 1. Equipment shall be constructed upon open bare ground. 2. The following additional measures will be complied with with reference to facilities for the production of phenol: a. All phenol waste will be disposed of by hauling the same, in an approved vehicle to a sewer system which has an ocean outfall, preferably the sewer line, near Arcadia. b. Under no circumstances will any phenol waste be discharged on the surface of the ground or into the subsoil. c. The uncontaminated cooling water originating in this plant will be discharged into a cement sampling basin, from which samples may be taken to check any possible phenol content. From the sampling basin the water will overflow into an open, earth settling basin. d. To insure that no phenol waste will enter the ground through accidental spillage or leakage from tanks, piping or equipment, a reinforced concrete basin will be constructed under the phenol section of the plant. The basin will have no floor drains. The floor slab will have sufficient slope to allow any -2- 0 0 waste, solid or liquid, to be washed into a one foot sump at one end, from which the waste may be pumped to a waste tank. The contents of the waste tank will, as stated before, be hauled by an approved carrier to the county sewer having an ocean outfall. The basin will contain no expansion or cold joints. The floor slab, side walls, and footings will be poured at the same time to insure a good bond between them. Sufficient footings will be phced under the floor slab at tank and equipment locations to carry the loads involved. Any footings needed above the floor slab for equipment and tanks will be poured after the floor slab has hardened and will be held in place with re- inforcing steel from the sub -floor footings. Further details of the basin are: 1. Floor slab and walls, 6" thick with sfx inches 1/2" reinforcing rod spaced #wmxftat apart &ari1szMc longitudinally and tranversely. 2. Concrete mix -- 1:2:3 ratio, with 3/4 gravel to minimize the voids. 3. Volume of the basin will be equal to the volume of the tankage involved. e. To keep rain water out of the basin (since the county will allow no rain water to be discharged into the dewer) a roof will be constructed over the basin. City Health f. The plant will be open at all times to allow'the;_/ depart- ment and the County Health Department to make any in- spection; and -3- WHEREAS the planning commission has recommended that said pe- tition in all its terms and conditions be granted: NOW THERRFORE BE IT.RESOLQED by the City Council of the City of Azusa.. County of Los Angeles, State of California that the peti- tion of L. A. Crowe and R. S. Crowe be granted and that said Property above described is, by this resolution, permitted to be used as Bake- lite" type plastics manufacturing P0ant and for sales of finished Products, together with a manufacturing plant for phenol and allied chemicals, but with the express condition that in the event the above conditions stipulations, or any of them, shall at any time be breached or violated in any manner, then this said variance shall terminate and be of no force or effect; BE IT FURTHER RESOLVED that the Mayor shall sign this resolution and the City Clerk shall attest the same and certify to the passage and adoption thereof.
