HomeMy WebLinkAboutResolution No. 2152 1/20 RESOLUTION NO. 21521, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY; CALIFORNIA AUTHORIZING AN EXCEPTION AND VARIANCE UNDER SECTION 16 OF ORDINANCE N0. 342 TO E. L. OSBORN AIND HTS SUCCESSOR AND APPLICABLE TO LOT 7 AND THE NORTH 45 FEET OF LOT 8 IN BLOCK 84, CITY OF AZUSA. The'City Council of the City of Azusa does resolve as follows: WHEREAS, E. L. Osborn is the owner of the following property, to -wit: Lot 7 and the north 45 feet of Lot 8 in Block 84 in the City of Azusa, and WHEREAS, the petition for exception and variance has been duly filed praying for an exception and variance as to the afore- said property changing the use thereof to uses prescribed in Zone R-4 for the purpose of erecting an apartment house thereon, the granting of which petition has been recommended to the City Council by the City Planning Commission of said City; and WHEREAS, the City Council of the City of Azusa has found, and does hereby find, determine and declare that no further notice of the filing of said petition or of the hearing thereof is necessary or required, such further notice being hereby dispensed with; and WHEREAS, said exception and variance is/are hereby found and determined necessary for the preservation and enjoyment of the substantial rights of the petitioners and is/or are not materially detrimental to the public welfare or injurious to the property or improvements in the zone or district in which said property lies, or injurious to the property or improvements in other zones or districts. NOW, THEREFORE, BE IT RESOLVED that an exception and variance be and the same is/are hereby ordered and made under Section 16 of Ordinance No. 342 of said City permitting and directing the location, erection, use and maintenance on and in said Lot 7 and the north 45 feet of Lot 8, Block 84, by E. L. Osborn or his successor, of an apartment house to conform substantially to the plans and specifi- cations which are attached to and made a part of the petition; and BE IT FURTHER RESOLVED that the set -back for said apartment house or houses will be a distance of 10 feet from Eighth Street and that said apartment house nor either any part thereof shall be nearer than a distance of 8 feet from said Eighth Street. - 1 - 0 - -- It is understood that this variance is a limited variance only for the erection and maintenance of an apartment house as herein provided. This variance is further granted upon the condition that said E. L. Osborn, or his successor, shall grant to the City of Azusa an easement for highway purposes and across the north 30 feet of said Lot 7 and the north 45 feet of Lot 8 without any charge therefor to the city and that said E. L. Osborn or his successor reimburse the city for the cost of Improving the said street. BE IT FURTHER RESOLVED that the Mayor shall sign this resolution and. the City Clerk attest same and certify to the passage and adoption thereof.
