A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, LOS ANGELES COUNTY,
CALIFORNIA, AUTHORIZING AN EXCEPTION AND
VARIANCE UNDER SECTION 16 OF ORDINANCE NO.
342 TO JAMES F. AYON PERSONALLY, AND
APPLICABLE TO LOTS NO. 28 and 29 IN BLOCK
77 IN THE CITY OF AZUSA.
The City Council of the City of Azusa does resolve as
follows:
WHEREAS James F. Ayon is the owner of Lots 28 and 29 in
Block 77 in the City of Azusa, same being 134 Azusa Avenue in
said city; and
WHEREAS a petition for exception and variance has been duly
filed praying for an exception and variance as to the aforesaid
property changing the use thereof from Zone R-1 to certain uses
prescribed and allowed under Zone C-2. The granting of which
petition has been recommended to the City Council by the City
Planning Commission subject to certain restrictions hereinafter
set forth; and
WHEREAS the City Council of said City of Azusa has found and
does hereby find, determine and declare that no further notice
of the filing of said petition or of the hearing thereof is
necessarily required, any further notice being hereby dispensed
with; and
WHEREAS said exception and variance is hereby found and
determined necessary for the preservation and enjoyment of the
substantial rights of the petitioner and that the granting thereof
conditionally is not materially detrimental to the public welfare
nor injurous to the property or improvements in the zone or
district in which said property lies or injurous to the property
or improvements in other zones or districts.
NOW, THEREFORE, BE IT RESOLVED that an exception and variance
be and the same is hereby ordered and made under Section 16 of
Ordinance No. 342 of said city permitting the use of the above
described property for the operation of a restaurant thereon and
for no other purpose;

following conditions provided that all buildings erected or to be
erected on said property shall be set back from the property line

at least a distance of ten feet and that loading and unloading
space shall be provided in the alley in the rear of said property,
and further, that there be provided sufficient parking space
on the said property or off the street upon which said property
Is situated so that the operation of said restaurant shall not
necessitate or require street parking by patrons. This variance
is further granted upon the condition that any buildings to be
erected on said property conform to Number 2 Fire Zone Restrictions
and that no liquor of any kind or character shall be sold or
served in said restaurant or upon the said property.
BE IT FURTHER RESOLVED that the acceptance of this variance
by the applicant, James F. Ayon, constitutes his agreement to
abide by all of the restrictions herein included and agrees that
if the restrictions are not complied with this variance may be
cancelled by the City Council.
BE IT FURTHER RESOLVED that the Mayor shall sign this resolution
and the City Clerk shall attest the same and certify to the passage
and adoption thereof.

city council of the city of Azusa at a regular meeting of said
city council held in the regular council chambers of said city
council in said city on October 20, 1947, and that the same
was passed and adopted by the following vote of the council:
