HomeMy WebLinkAboutResolution No. 2127RESOLUTION N0. 2127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA AUTHORIZING AN EXCEPTION AND VARIANCE UNDER SECTION 16 OF ORDINANCE NO. 342 TO C. C. PERRIN PERSONALLY ATM APPLICABLE TO LOTS 25, 26,x.27 and 28 IN BLOCK 52 OF THE CITY OF AZUSA. The City Council of the City of Azusa does resolve as follows: WHEREAS C. 0. Perrin is the owner of Lots 25 to 28 Inclusive Block 52 in said City of Azusa, same being located on the southeast corner of Fifth Street and Azusa Avenue in said city; and WHEREAS a Petition for Exception and Variance has been duly filed praying for an exception and variance as to the aforesaid property changing the use thereof to a restricted use which is set forth in Zone C-3 of Ordinance No. 342 of the city of Azusa thereof, the granting of which petition has been recommended to the City Council by the City Planning Commission of said city upon certain conditions and restrictions; and WHEREAS the City Council of the city of Azusa has found and hereby finds, determines and declares that no further notice of the filing of said petition or of the hearing thereof is necessary or required; and WHEREAS said exception and variance is hereby found and determined to be necessary for the preservation and enjoyment of the substantial rights of the petitioner and is not materially detrimental to the public welfare or injurious to the property or improvements in the zone or district which said property lies nor is it injurious to the property or improvements in other zones or districts; NOW. THEREFORE BE IT RESOLVED that an exception and variance be and the same is hereby ordered and made under Section 16 of Ordinance No. 342 of said city permitting the location, erection, use, operation and maintenance on said lots by C. C. Perrin, only of any buildings, structure or - 1 - improvements for the purpose only of a gas and service station and light repair shop and that this variance shall not be (%n -cit .,edas an open variance for any structure or use provided under Zone C-3 except only the use as hereinbefore indicated. This variance is granted upon the further condition that all set back lines as prescribed by the Planning Commission of the City of Azusa shall be conformed with and that the consent of said Planning Commission as to the location of the buildings and structure upon said lots shall be obtained before construction of any improvements are begun. That all other recommendations of the Planning Commission be complied with and if the conditions of this variance are not complied with the City of Azusa reserves the right to cancel the same. BE IT FURTYIR RESOLVED that the Hayor shall sign this Resolution and the City Clerk shall attest to the same and certify to the adoption thereof. ATTEST: ity Clerk of the City of Az a. Hynes, City Clerk of the City of Azusa, Los Angeles County, California, do hereby certify that the foregoing Resolution was duly and regularly adopted by the City Council of the City of Azusa at a regular meeting of said City Council held in the regular Council Chambers of said City Council in said City on the 15th day of September, 1947, and that the same was passed and adopted by the following vote of the Council: AYES: NASSER, JUMPER, WMIMESHEIMER, MALONE, LAMM.
