A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, LOS ANGELES COUNTY,
CALIFORNIA, AUTHORIZING AN EXCEPTION OR
VARIANCE UNDER SECTION 16 OF ORDINANCE
NUMBER 342 IN FAVOR OF OMART INVESTMENT
COMPANY, LTD., APPLICABLE TO LOTS IN
TRACT NUMBER 13790 IN THE CITY OF AZUSA.
The City Council of the City of Azusa does resolve
as follows:
WHEREAS, 0MART INVESTMENT COMPANY, LTD., owners
of lots numbered from 1 to 19 both inclusive, and Lot 38 in
Tract 13790 in the City of Azusa, Los Angeles County, Calif-
ornia, has made verified application to the City Planning
Commission requesting an exception or variance under Section
16 of Ordinance Number 342 of the City of Azusa, known as the
Zoning Ordinance, so as to permit the erection, construction
and improvement which are permitted in Zones R-1, R-31 R-42
C-22 C-3 and M-1 and in addition thereto, all types of manufact-
uring or industrial establishments except any establishment
for the manufacturing of glue, size or gelatine; processes
involving recovery from sulphurous, sulphuric, nitric, hydrochloric,
and carbolic acid; acetylene gas manufacture on a commercial
scale; celluloid and cellulose products manufacture; the
manufacture of pyroxylin plastic material or of products there-
from; chlorine or bleaching powder manufacture; crematory, except
In connection with a cemetery; creosote manufacture; explosives,
fireworks, or match manufacture or assembly; fertilizer
manufacture or potash refining; rock crushers; petroleum refining;
oil storage in quantities exceeding 1000 barrels on one lot, or
in any tank above ground exceeding 500 barrels capacity and which
tank is within 50 feet of any lot boundary line; refuse disposal,
including the incineration, reduction or dumping of offal, ashes,
garbage, or refuse (except refuse wood products burned in a
suitable furnace), unless under the control and direction of the
municipality; sewage disposal plant conducted on a commercial
basis and not controlled and directed by the milnicipality; all
other uses which in the opinion of the Planning Commission and
the City Council are equally obnoxious or dangerous to the
community or to persons employed or living in proximity to such
uses, although such other uses be not enumerated herein, the
granting of which said application has been recommended to the
City Council by said City Planning Commission, and
WHEREAS, it has been made to appear to the City
Council that it is intended to have said lots used primarily
for manufacturing or industrial establishments that are not
prohibited by law, or ordinance except those herein set forth;
that notice has been given.to interested parties as to the
pendency of this proceeding; that no other or further notice
is necessary.
NOW THEREFORE BE IT RESOLVED that the aforesaid
application for exception or variance be and the same is
hereby granted and that an exception or variance be and the
same is hereby made in favor of OMART INVESTMENT COMPANY,
LTD., or its-euccessore in interest or title, and in favor of
any other owner or owners of .the afore described property,
under said Section 16 of said Zoning Ordinance so as to permit
the use of said properties as requested in said petition. Said
exception or variance is subject, however, to the following
terms and conditions, to -wit:
(A) Any and all activities carried on or
.things done under and by virtue of said
exception or variance shall be carried
on and done in a good,workmanlike,
peaceable and lawful manner and shall not
at any time or in any way constitute a public
or provate nuisance or be harmful or injurious
to the peace or welfare of the City of Azusa,
or of any of its residents and property
owners.
BE IT FURTHER
shall sign this Resolution
and certify to the passage

I, MAE A. HYNES, City Clerk of the City of Azusa,
Los Angeles County, California, do hereby certify that the
foregoing Resolution was duly and regularly adopted by the
City Council of the City of Azusa at a regular meeting of
said City Council held in the regular Council Chambers of
said City Council in said City on the 20th day of May, 1946,
and that the same was passed and adopted by the following
vote of the Council.
AYES: Councilmen: Nasser, Jumper, Memmesheimer,
Malone, Lamm.
NOES : Councilmen: None.
ABSENT: Councilmen: None.
