A Resolution of the City Council of the City of Azusa, declaring that the
Public interest, necessity, and convenience require that rights of way
be appropriated over certain portions of property owned by said City for
the purpose of constructing, operating, and maintaining public utilities
in, over, under, and along the same.
WHEREAS, the City of Azusa is the owner of certain property situated
within the City of Azusa, California; and
WHEREAS, the City proposes to sell said property to private persons,
firms, or corporation, but before doing so it appears to be in the public
interest to make provisions for rights of way in, along, over, and upon
certain portions of said property so as to enable the City at any time
in the future to construct, operate, and maintain poles, wires, and
other appurtenances for the transmission of electrical energy and for
telephone service without being compelled to obtain such rights of way
from private parties at some future time,
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the public interest,
necessity, and convenience require and it is hereby declared that rights
of way be and the same are hereby established for the use of and on
behalf of the City of Azusa for the construction, erection, installation,
maintenance, operation, repair and renewal of poles, wires and appurten-
ances thereto for the transmission of electrical energy and for telephone
service, with the right of ingress and egress to and from the same in,
over, under, above, upon, and along the following property owned by the
said City of Azusa in Tract No. 106.60 as per map thereof recorded in
Map Book 164, at pages 13 and 14, Records of Los Angeles County, California,
and located within the said City of Azusa, described as follows, to -wit:
(a) The southerly six (6) feet of Lot 6; Lots 50 to 58, both
inclusive; Lots 98 to 105, both inclusive; Lots 107 to 110, both inclusive;
Lots 150 to 159, both inclusive; and Lots 161 and 162.
(b) The northerly six (6) feet of Lot 26; Lots 74 to 84, both
inclusive; Lots 124, 125 and,126; Lots 128, 129, 130, and 131; and Lots
176 to 188, both inclusive.
IT IS HEREBY FURTHER RESOLVED, that all deeds granted by the City
of Azusa for the conveyance of any an0l/or all of the city -owned property
hereinbefore described to any person, firm or corporation, there shall
be incorporated in any such deed or deeds a reservation in favor of
said City of Azusa of a right of way over said property as herein de-
scribed and for the purposes herein set forth.
