A RESOLUTION OF THE CITY COUIvrCIL
OF THE CITY OF AZUSA, LOS ANGELES
COUNTY, CALIFORNIA AUTHORIZII.G AN
EXCEPTION AND VARIANCE UNDER SECTION
16 OF ORDINAL?CE NO. 342 AND APPLI-
CABLE TO LOTS 25-28 AND LOTS 30-36
IN BLOCK 43.
The City Council of the City of Azusa does resolve
as follows:
WHEREAS Joseph W. Charlton is the owner of
Lots 25, to 28 inclusive
and Lots 30 to 36 inclus-
ive in Block 43 in the
City of Azusa, Los Angeles
County, California, and
V1H EREAS a petition for exception and variance has
been filed, praying for an exception and variance as to
aforesaid property enlarging the uses thereof to the uses
permitted in Zone R-3 - Multiple Family Residence District
as said uses are defined in Ordinance No. 342 of the City of
Azusa and any amendments thereof, the granting of which .
petition has been recommended to the City Council by the City
Planning Commission, and
WHEREAS the City Council of said City of Azusa
has found and does hereby find, and declare that no further
notice of the filing of said petition or of the hearing there-
of is necessary or required, such further notice being, hereby
dispensed with, and
WHEREAS such exception and variance is/are hereby
found and determined necessary for the preservation and
enjoyment of the substantial property rights of the petitioner
and not materially detrimental to the public welfare or
Injurious to the.property or improvements in the zone or district
in which said property lies or injurious to the property or
improvements in other zones or districts:
YOW THEREFORE BE IT RESOLVED that an exception and

variance be and the same is/are hereby ordered and made under
Section)6 of Ordinance No. 342 of said city, permitting the
location, erection, use, operation and maintenance on and in
said property, by the present owner or owners thereof or by
his or their heirs, executors, administrators, lessees, grantees,
successors or assigns, of any building, structure or improve-
ment permitted under the classification of Zone R-3 - 11ultiple
Family Residence District as the said uses are set forth and
defined in Ordinance No. 342 and any amenddentt. thereof, pro-
vided however that this resolution shall not be construed or
be held to authorize or to permit, the location, erection,
use, operation and maintenance of any structure or improve-
ment or the carrying on of any activity in or on said property,
which is or may be detrimental to the health, peace or welfare
of the city of Azusa or of any of its inhabitants.
BE IT FURTHER RESOLVED that the I-'..ayor shall sign this
resolution and the City Clerk attest same and certify to the
passage and adoption thereof.

I, TIAE A. hYNES, City Clerk of the City of Azusa,
Los Angeles County, California, do hereby certify that the
foregoing Resolution was duly and regularly adopted by the
City Council of the City of Azusa at a regular meeting of
said City Council held in the regular Council Chambers of
said City Council in said City on October 21, 1946 and
that the same was passed and adopted by the following vote
of council:
AYES: Councilmen Nasser, Jumper, Mialone,
t"emmesheimer and Lamm.
NOES: None
ABSEiZT: None
I DO -FURTHER CERTIFY that the attest is a true and
correct copy of Resolution No. 2040 passed and adopted by the
City Council of the City of Azusa at a regular meeting thereof
held October 21, 1946.
