I RESOLUTION NO. 2038 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORKIA, AUTHORIZING AND INSTRUCTING THE MAYOR AIv'D CITY CLERK OF SAID CITY TO EXECUTE AGREEMENT OF SAID CITY AND THE BOARD OF SUPERVISORS, LOS ANGELES COUNTY, FOR PURCHASE OF THE STATE'S INTEREST IN TAX DEEDED PROPERTY. THAT WHEREAS, there are situated in the City of Azusa numerous parcels of real property which have been non -revenue pro- ducing for many years, and in all instances for six (6) years; and WHEREAS, each of said parcels has been separately deeded to the City of Azusa for non-payment of taxes; and WHEREAS, in the judgment of the City Council, it would be to the best interests of the City and all taxing agencies that the City of Azusa enter into an agreement with the Board of Supervisors of Los Angeles County to purchase the Staters title to said parcels of property; NOW, THEREFORE, the City Council of the City of Azusa does resolve, declare and determine, as follows: SECTION 1: That a copy of said 'Agreement for the Purchase by the City of Azusa, California, of the State's Title to Certain Lands Within said City as Provided by Division 1, Part 6, Chapter 8, Articles 1 and 2, of the Revenue and Taxation Code of the State Of California' 1, presented to this Council at this meeting, be placed on file in the office of the City Clerk for identification and reference. SECTION 2: That the Mayor is hereby authorized and directed to subscribe the name of the City of Azusa to said 1-tAgreement for the Purchase b the City y of Azusa, California, of the State's Title to Certain Lands Within said City as provided by Division 1, Part 6, Chapter 8, Articles 1 and 2, of the Revenue and Taxation Code of the State of California", with the Board of Super- visors of Los Angeles, subject to the approval of the State Controller of the State of California, and the City Clerk is hereby authorized and directed to attest the same and to affix thereon the seal of the City of Azusa; said agreement to be executed in septuplicate. 1. E SECTION 3: That the City Clerk shall certify to the Passage and adoption of this resolution, shall enter the same among the original resolutions of said City, shall make a minute of the passage and adoption thereof in the records of the pro- ceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted, shall attache: a certified copy of this resolution to the seven (7) executed Agreements and shall forward said seven (7) executed Agreements, with said certified copies of this resolution attached to each of said Agreements, to John F. Bender, Special City Attorney. SECTION 4: That John F. Bender, Special City Attorney for the City of Azusa, is hereby authorized and directed to appear before any board of commission in respect to this agreement, to file any written documents in respect thereto, said appearance to be made for and on behalf of the City of Azusa. A G R E E M E N T AGREEMENT FOR THE PURCHASE BY THE CITY OF AZUSA, CALIFORNIA, OF THE STATE'S TITLE TO CERTAIN LANDS WITHIN SAID CITY AS PROVIDED BY IDIVISION lo -PART 6, CHAPTER 8, ARTICLES.1 AND 2, OF THE REVENUE AND TAXATION.CODE OF THE STATE OF CALIFORNIA. THIS AGREEMENT, made on the day of , 1946, by and between the Board of Supervisors -of the County of Los Angeles, State of California, subject to the approval of the State Controller of the State of California, W I T N E S S E T H; i THAT WHEREAS, there are situated in the City of Azusa numerous parcels of real property which have been non -revenue producing for many years, and for at least six (6) years or more, and which are now tax deeded to the State of California for delinquent taxes; and which the City desires to acquire for resale; and WHEREAS, each of said parcels has been separately deeded to said City for non-payment of City taxes; and WHEREAS, there are special assessment liens against each and all of the parcels of property involved, said liens being issued for the improvement of streets, and bonds thereon having been issued pursuant to the Improvement Act of 1911, each of said bond liens now being delinquent for more than ten (10) years last past, and in most instances the amounts due on each of said bond liens being in excess of the value of the property; and WHEREAS, there are now pending three separate and distinct actions filed in the Superior Court of Los Angeles County in respect to the fee title to each of said parcels of'property, the validity Of the City's tax deeds in respect thereto, and the rights of the owners of.said street improvement bonds issued pursuant to said Improvement Act of 1911; that one of said actions above referred to is now in the Supreme Court of the State of California; and WHEREAS, it appears that in order,to accomplish the 'restoration of each and all of said parcels of properties to the tax rolls for the benefit of the County of Los Angeles and the City of Azusa and all other taxing agencies, that'the tax deed title of the State and of the City of Azusa should be merged into one title, 1. 0 0 thereby permitting the -State's tax deed rights to also be determined by said pending litigation. NUN, THEREFORE, it is hereby mutually agreed, as follows: 1. That as provided by the probisions of the Revenue and Taxation Code, the cost of giving the notice of this agreement shall be paid by the City of Azusa. 2. That the Board of Supervisors of .the County of Los Angeles agrees to sell to the City of Azusa each of the parcels of property hereinafter set out in Exhibit"A°, attached hereto and made a part hereof, which shall not have been redeemed as provided in the Revenue and Taxation Code, for the sum set out after each of said parcels of property and called "County Selling Price", and that the City of Azusa agrees to purchase each and all of said parcels of.property within thirty (30) days after this agreement becomes effective. 3. That prior to the resale of the property acquired pursuant to this agreement, the City of Azusa will publish a notice of the proposed sale on each individual parcel once a week for three (3) consecutive weeks in a local newspaper. 4. That if prior or subsequent to the execution of this agreement it is determined by the County of Los Angeles that all or any portion of the parcels included in said agreement are needed to conform with the Master Plan of Highways of Los Angeles County or any other public use by said County of City of Azusa, said City will reserve and dedicate such property or interest therein for said public use ,prior to resale.
