HomeMy WebLinkAboutResolution No. 2261III RESOLUTION N0. 2261 PJ A RESOLUTION OF THE CITY COUNCIL OF THE 3 CITY OF AZUSA, LOS ANGELES COUNTY, CALIF- ORNIA AUTHORIZING AN EXCEPTION AND VARIANCE 4 UNDER SECTION 16 OF ORDINANCE N0. 342 AND APPLICABLE TO LOTS 41, 42, 43 AND 44 IN 51 BLOCK 53 OF THE CITY OF AZUSA. 811 The City Council of the City of Azusa does resolve as follows: 10WHEREAS, Dorothy P. Dawson is the owner of the following described lands, to -wit, Lots 41, 42, 43 and 44 in Block 53 of 11 the City of Azusa, which lots are located on the east side of San Gabriel Avenue between Fourth and Fifth Streets; and 12 13 WHEREAS, a Petition for Exception and Variance has been duly filed, praying for an Exception and Variance as to the 14 foregoing property changing the use thereof from Zone R-1 to Zone R-4 for the limited purpose, however, of establishing and 15 maintaining a day nursery for children and for no other purpose; and 16 17WHEREAS, said petitioner has presented to the Planning Commission of the City of Azusa, her Variance, and the Planning 18 Commission has recommended to the City Council that a limited variance be granted permitting the use of said premises for day 19 nurseries only, and for no other use covered by Zone R-4; and 20 WHEREAS the City Council of said City of Azusa .has found 21 and does herety find, determine, and declare, that no further 22 notice of filing of said petition, or of the hearing thereof, is necessarily required, such further notice being hereby dispensed 23 with; and 24 WHEREAS, said Exception and Variance is hereby found and determined to be necessary for the preservation and enjoyment 25 of the substantial rights of the petitioner, and is not materially 26� detrimental to the public welfare or injurious to the property or improvements in the section of said city in which the above 27property is located. . 28NOW, THEREFORE, BE IT RESOLVED that a limited exception be 29 and the same is hereby ordered and made under Section 16 of Ordinance No. 342 of the City of Azusa, authorizing the petitioner Dorothy P. Dawson, to establish and maintain said properties for 30 the purpose of a day nursery for minor children only: 31 BE IT FURTHER RESOLVED that this Variance is personal with 32 Dorothy P. Dawson, and is not to be assigned and that the use of - 1 - 1 2 3 4 5 6 7 8 9 12 13 14 t 20 21 22 23 24 25 26 27 28 29 30 31 32 said properties in Zone R-4 be and is hereby restricted to that of a day nursery only. This Variance is not to be granted or to be applicable to any successors or assigns of the above property. No activity shall be carried on or in said property which is or may be detrimental to the health, peace, or welfare of the City of Azusa, or any of its inhabitants; BE IT FURTHER RESOLVED that the Mayor shall sign this Resolution and the City Clerk shall attest to the same and certify to the adoption thereof.
