RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, CAL•I_FORNIA, DETERMINING
RESULTS OF HEARING: DIRECTING CERTAIN
OMISSIONS, DECREASES, ALTERATIONS AND
CHANGES IN THE WORK OR IM?ROVEMENT AS
SET FORTH IN REPORT ON PROJECT FILED
UNDER THE SPECIAL ASSESSMENT INVESTIGA-
TION, LIMITATION AND MAJORITY PROTEST
ACT OF 1931; OVERRULING PROTESTS; DE-
TERMINING THAT PUBLIC INTEREST, CON-
VENIENCE AND NECESSITY REQUIRE CERTAIN WORK
OR IMPROVEMENT SUBSTANTIALLY AS SET
FORTH IN SAID REPORT AND DETERMINING THAT
SAID PROJECT IS FEASIBLE.
WHEREAS, this City Council has heretofore, on
September 12, 1949, by Resolution No. 2341, taken the steps
provided by Sections 2821, 2822 and 2823 of the Streets
and Highways Code of the State of California (said sections
being a part of the Special Assessment Investigation,
Limitation end Majority Protest Act of 1931) for certain
work or improvement consisting of certain proposed grading,
construction of driveways, curbs, gutters and sidewalks
in the City of Azusa, California; and
WHEREAS, by said Resolution No, 2341, this City
Council directed the City Engineer and the Superintendent
of Streets to procure the.required information end prepare
and present to this City Council the written report on said
work and improvement required by the Sim cial.Assessment In-
vestigation, Limitation and Majority Protest Act of 1931 as
set forth in Division 4, Part 2, Sections 2824 to 2830, In-
clusive, of said Streets and Highways Code; and
WHEREAS, said report has been presented to this

City Council and approved and ordered filed by this City
Council; and
WHEREAS, by motion duly seconded and carried on
the 12th day of September 1949, this City Council fixed a
time and place for hearing by it on said report; and
WHEREAS, notice of said hearing was mailed as
required by said Special Assessment Investigation, Limits -
tion and Majority Protest Act of 1931; and
WHEREAS, at the time and placesofixed a hearing
was duly held by this City Council at which all written pro-
tests or objections which were presented were read, and all
persons desiring to be heard thereon were heard, and this
City Council gave all persons present an opportunity to be
heard in respect of any matter relating to said report, said
work or improvement, or any of the proceedings therefor; and
WHEREAS, all persons desiring to appear and be
heard were heard at said hearing and said hearing has been
closed; and
WHEREAS, certain property owners and persons inter-
ested in land within the proposed assessment district have
filed protests or objections and have appeared before this
Council and requested that the work and improvement proposed
in said report be changed and modified in the following
particulars, to wit, on both sides of Angeleno Avenue between
First Street and the north line of Lots 3 and 11, Subdivision
No. 1 of Lands of Azusa Land and Water Company as per map
recorded in Book 16, pages 17 and 18 of Miscellaneous Records

of Los Angeles County, by omitting the construction of Port-
land cement concrete sidewalks, and by substituting Portland
cement concrete pavement four inches thick in the construction
of driveway aprons in lieu of premix pavement two inches thick;
and
MiEREAS, this is the time and place designated by
this City Council for consideration of said report, and this
City Council has considered said report and is fully informed
in the premises;
NOW, THEREFORE, the City Council of the City of
Azusa, DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER as
follows:
Section 1. That said report contains all the
matters and things required by law and that notice of hear -
Ing on the proposed project generally described therein has
been duly and regularly given.
Section 2. That no written protest has been
filed with the Clerk of this City Council by the owners of
one-half of the area of the property to be assessed for said
proposed work or improvement and that there is no majority
protest as provided in Section 2931 of the Streets and High-
ways Code, against only a portion of said proposed work or
improvement.
Section 3. That the work or improvement proposed
to be done in said report be omitted, decreased, altered and
changed in the following particulars, to wit, on both sides
of Angeleno Avenue between First Street and the north line

of Lots 3 and 11, Subdivision No. 1 of Lands of Azusa Land
and Water Company as per map recorded in Book 16, pages 17
and 18 of Miscellaneous Records of Los Angeles County, by
omitting the construction of Portland cement concrete side-
walks, and by substituting Portland cement concrete pavement
four inches thick in the construction of driveway aprons in
lieu of premix pavement two inches thick; that said omissions,,
decreases, changes and alterations in the work or improvement
proposed to be done in said report will not cause the total
estimated cost of said work as stated in said report to be
increased by 110, or in any other amount, or at all; that
the City Engineer and the Superintendent of Streets be,, and
they hereby are, directed to estimate separately the cost of
each addition to, omission from or decrease in things proposed
to be done as set forth in said report and to file said estimate
with the City Clerk.
Section 1�. That the public interest, convenience
and necessity require the work or improvement substantially
as set forth in said report and that the project for said
work or improvement is feasible.
