RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, CALIFORNIA, DETERMINING
} RESULTS OF HEARING; OVERRULING PROTESTS;
,•: ` DETERMINING THAT THE'PUBLIC INTEREST,
CONVENIENCE AND NECESSITY REQUIRE CER-
TAIN WORK OR IMPROVEMENT SUBSTANTIALLY
AS SET FORTH IN REPORT ON PROJECT FILED
i UNDER THE SPECIAL ASSESSMENT INVESTIGA-
TION, LIMITATION AND MAJORITY PROTEST
ACT OF 1931 AND DETERMINING THAT SAID
PROJECT IS FEASIBLE.
WHEREAS, this City Council has heretofore, on
September 12, 19499 by Resolution No. 2339, taken the steps
provided by Sections 2821, 2822 and 2823 of the Streets and
Highways Code of the State of California (said sections being
a part of the Special Assessment Investigation, Limitation
and Majority Protest Act of 1931)for certain work or improve -
went consisting of certain proposed grading, construction of
driveways, curbs and gutters in the City of Azusa, California;
and'
WHEREAS, by said Resolution No. 2339, this City
Council directed the City Engineer and the Superintendent
of Streets to procure the required information and prepare
and present to this City Council the written report on said
work and improvement required by the Special Assessment In-
vestigations Limitation and Majority Protest Act of 1931 as
set forth in Division 4,.Part 2, Sections 2824 to 2830, in -
elusive, of said Streets and Highways Code; and
WHEREAS, said report has been presented to this
City Council and approved and ordered filed by this City
Council; and
WHEREAS, by motion duly seconded and carried on
the 12th day of September, 1949, this City Council fixed a
time and place for hearing by it on said report and;
WHEREAS, notice of said Yn aring was mailed as
required by said Special Assessment Investigation, Limita-
tion and Majority Protest Act of 1931; and
WHEREAS, at the time and place so fixed a hear -
Ing was duly held by this City Council at which no written
protests or objections were presented or read, there having
been none filed, and all persons desiring to be heard thereon
were heard, and this City Council gave all persons present
an opportunity to be heard in respect of any matter relat-
ing to said report, said work or improvement, or any of the
proceedings therefor; and
WHEREAS, all persons desiring to appear and be
heard were heard at said bearing and said hearing has been
closed; and
WHEREAS, this is the time and place designated
by this City Council for consideration of said report, and
this City Council has considered said report and is fully
informed in the premises;
NOW, THEREFORE, the City Council of the City of
Azusa DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER as
follows:

Section 1. That said report contains all the
matters and things required by law and that notice of
hearing on the proposed project generally described there-
in has been duly and regularly given.
Section 2. That no written protest has been filed
with the Clerk of this City Council by the owners of one-half
of the area of the property to be assessed for said proposed
work or improvement and that there is no majority protest as,
provided in Section 2931 of the Streets and Highways Code,
against only a portion of said proposed work or improvement.
Section 3. That all protests and objections
be and the same are hereby overruled and denied.
Section 4. That the public interest, conven-
ience and necessity require the work or improvement sub.
stantially as set forth in said report, and that the project
for said work or improvement is feasible.
Section 5. That this resolution shall be entered
in full upon the minutes of this City Council,
ADOPTED, SIGNED AND APPROVED this 7th day of Novem-
ber, 1949,

I, MAE A. HYNES, City Clerk of said City of Azusa,
Calfornia, DO HEREBY CERTIFY that the foregoing resolution
was duly adopted by the City Council of said city and was
approved by the Mayor of said city at an adjourned regular
meeting of said City Council held on the 7th day of November,
1949, and that it was adopted by the following vote:
AYES: Councilmen Nasser, Ortuno,
Memmesheimer, Malone,
Jumper.
NOES: Councilmen: None
