A RESOLUTION OF THE CITY COUNCIL OF
3 THE CITY OF AZUSA, LOS ANGELES COUNTY,
CALIFORNIA AUTHORIZING AN:EXCEPTION
4 AND VARIAME UNDER ARTICLE 19 OF
OIDINANCE NO. 409 OF THE CITY OF AZUSA,
5 AND APPLICABLE TO A PORTION OF LOT 2
IN TRACT NO. 5115,

7 follows: The City Council of the City of Azusa does resolve as
8
WHEREAS, Gilbert Harold is the owner of that portion
9 of Lot 2, Tract 5115 in the City of Azusa as per map recorded in
Book 57 Page 64 of Haps in the office of the County Recorder of
10 said County bounded and described as follows, to—wit:
11 I Beginning at the northeast corner of said
Lot 2; tnence due south along the east line
12 of said Lot 2, 325.00 feet; thence westerly
parallel with the south line of said Lot 2,
13 377.5 feet, more or less, to the northwesterly
line of said Lot 2; thence northeasterly
14 along said northwesterly line of Lot 2 to the
15 point of beginning.
16 WHEREAS, the Luthern Church of Azusa also has an
interest in said property and is contemplating the construction
17 and erection of a church and parish and other out—buildings on
18 said premises which at this time are vacant and unimproved; and
WHEREAS, said owners nave heretofore filed a petition
19 for exception and variance under article/9 of Ord1nanee No. 409 of
the City of Azusa together with a plot plan snowing the location
20 of proposed buildings and facilities together with a list of all
property owners within a range of 300 feet from said above
21 described property, wnich application requests a change of zone
from R-1 to R-3
22 ;and
WHEREAS said petition has been considered by the
23 Planning Commission of the City of Azusa and all legal, requirements
24 with reference to hearing thereon have been complied with and the
Planning Commission after due hearing has filed its recommendation
25 that said application for a variance be granted as requested; and
WHEREAS the City Council of the City of Azusa has found
26 and does hereby find, determine and declare that no further notice
of filing of said petition of the hearing thereon is necessarily
27 required; and
28 WHEREAS, such exception and variance is hereby found and
determined necessary for the preservation and enjoyment of sub -
29 stantial rights of the petitioner and is not materially detrimental
to the public welfare or injurious to the property or improvements
30 of the zone or district in which said property lies or injurious
31 to the property or improvements on other zones or districts.
NOW, THN,REFURE, BE IT RESOLVED that an exception and

variance be and the same is hereby ordered and made under Article
19 of Ordinance No. 409 of the City of Azusa permitting the
erection of a church, parish hall and other out -buildings thereon
be granted and that the variance as requested is hereby granted
from Zone R-1 to Zone R-3.
BE IT FURTHER RESOLVED that the Mayor shall sign this
Resolution ana the City Clerk attest the same and certify to the
passage and adoption thereof.

I,' M. A. Hynes, City Clerk of the City of Azusa, Los
Angeles County, California, do hereby certify that tie foregoing
Resolution was duly and regularly adopted by the City Council of
the City of Azusa at'a regular meeting of said City Council held
in the regular Council Chambers of said City Council in said City
on October 3, 1949, and that the same was passed and adopted by
the following vote of the Council:
AYES: Councilmen: Nasser, Ortuno, Memmesheimer,
Malone, Jumper
NOES: None
ABSENT: None
