HomeMy WebLinkAboutResolution No. 2762Al 4n �� RESOLUTION NO. 2762 3 _ A RESOLUTION OF THE CITY COUNCIL OF THE CITY .OF,AZUSA$ LOS ANGELES COUNTY, CALIf69NIA,.ORDERING THE VACATION OF THE STREETS AND ALLEYS SITUATE IN `TRACT 8507 IN THE CITY OF AZUSA, AS HEREINAFTER DESCRIBED, AND AS DESCRIBED ,JN ORDINANCE NO,. 462 OF SAID CITY ADOPTED - BY THE CITY,COUNCIL OF SAID CITY MARCH 16, 1953. :. The City Council -of the City of Azusa does resolve as follows' Section 1. WHEREAS .in accordance with the provisions of the Street Vacation Act of 1941 as amended., the City Council of• the City of Azusa did on March 16, 1953 pass and adopt its „ Ordinance of Intention No. 462, declaring its intention to vacate those streets and alleys and portions thereof situate in Tract 8507 of.the,City of Azusa which said streets and alleys and portions thereof are hereinafter described; and . WHEREAS said Ordinance of Intention No. 462 has,been duly published.ia the manner prescribed by law for the publication of ordinances of said city, and'aotices of street vacation duly posted -conspicuously along the, .lines of the streets and alleys or parts thereof proposed to be vacated, in the form, place, time and manner required.by 'law;,,: 'and WHEREAS,this council has, at the hearing designated by said Ordinance of Intention, heard all of the evidence offered and submitted in relation,to the prop.ose'd vacation of said streets and alleys and portions thereof: NOW THEREFORE this City Council of the City of Azusa hereby finds from all the evidencesubmitted, that the streets and alleys and•portions thereof described in said Ordinance of Intention No. -462 and hereinafter described, are unnecessary for present or prospective public.street purposes; and this said City Council hereby, orders that said streets and alleys and portions thereof so herein described be and the same are hereby vacated for public street purposes and which said streets and alleys and portions thereof hereinbefore referred ;to and by the terms of this order vacated are located in the City of Azusa, County of.Los Angeles, State of California, in,Tract No. 8507 of Azusa as per map recorded in Book 102 at pages 78 to 80 inclusive, of Maps Records in the Office of the County Recorder of said Los Angeles County, and are designated and described as followsviz: (a) The alley lying west of Irwindale Avenue in said.Tract 8501'and running north and south in or approximately mid -way between the easterly•boundary line at Irwindale Avenue and the westerly bounda.ry line at Motor Avenue in Block 4 of said Tract 8507, which -4. ..V fi- alley runs -from .Gladstone Street also known as Broadway and also formerly known as Dalton, on the sou'thpto the northern'.boundary of said Block 4 at Roosevelt Street on .the north. (b) All streets and all'eys ofsaid Tract 8507 lying easterly of Irwindale' Avenue excepting Gladstone Street also known as Broadway and formerly known, as Dalton, on the south and First Street on the north,. and also excepting, that part of Paramount. Street in said Tract 8503, running from Irwindale Avenue on the west, easterly to the.. west line of the intersection of Van Ness Avenue and Paramount Street in said Tract, and.also excepting that part ,of M'c'Kinley Street in said Tract 8507, running from Irwindale Avenue on the west, easterly to, the westline`o`f.the intersection of Van Ness Avenue' an& McKinley Street in said. 'T'ract _ RESERVING HOWEVER,,and this Council finds and determines that the public convenience and necessity require that there shall be and is hereby r'es'erygd,.,by said .City; an easement'im that part of Paramount Street being hereby vacated, for the purpose of maintaining, therein a public utility water line; provided, however, that the sforesaid'eag..ement shall be held for naught and considered vacated and atiandoned-,,at any time., by the substitution therefor of a different easement or easements of a width of not to exceed ten feet,, and the construction of sakd_.public utility water line in said substituted easement or in such part thereof as is nec to'furnish adequate water service essary , which said substitution shall be without expense to said. City. Section 2. THE MAYOR of said.City of Azusa is hereby directed ti o.sign.this Resolution and Order and. the City Clerk is hereby directedto attest same and certify to the passage and the adoption .thereof, and tocause.a certified copy of this Resolution and Order 'attested by the City Clerk under the seal of the City of Azusa to be recorded in the office of the County Recorder of Los Angeles County; California.
