RESOLUTION NO. 2929
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA,
REINSTATING ALBERT L. KENDRICK AS CHIEF OF
POLICE OF THE CITY OF AZUSA AND DIRECTING THAT
HIS UNPAID SALARY AS ORDERED BY THE COURT BE
PAID.
The City Council of the City of Azusa does resolve as
follows;
WHEREAS, there has been pending in the Superior Court of the
State of California in and for the County of Los Angeles, a
certain action No. 617 301 wherein Albert L. Kendrick was
Petitioner and the City Council of the City of Azusa and others,
Respondents, in which action the Court found and adjudged that
the discharge and dismissal of the petitioner, Albert L. Kendrick
from his position as Chief of Police of the City of Azusa was and
is null and void and of no effect and that he is entitled to be
restored and reinstated to such position and to the payment of
salary as such Chief of Police from July 6, 1953 to November 30,
1953; and
WHEREAS, the said Superior Court has directed a Peremptory
Writ of Mandate to the City Council of the City of Azusa, Martha
M. Johnson, Stephen Barry, Jr., Anthony M. Ortuno, Hickory S.
Jackson and Louis G. Memmesheimer as members of the City Council
of the City of Azusa and James Miller as City Clerk and Stephen A.
Skidmore as City Treasurer, commanding the said City Council and
Its members as follows, to -wit:
1. Immediately restore and reinstate petitioner,
Albert L. Kendrick to his position as Chief of
Police of the City of Azusa;
2. Immediately cause to be paid to petitioner Albert
L. Kendrick the sum of $2412.60 as salary due him
as Chief of Police of the City of Azusa from the
6th day of July, 1953, to and including the 30th
day of November, 1953;
and
WHEREAS, the said above entitled Court has commanded the
Respondents to make known to the Court that they have complied wi
the Writ of Mandate:
THEREFORE, BE.IT RESOLVED that the said Albert L. Kendrick be
and he is hereby restored to his position as Chief of Police of
the City of Azusa, effective as of December 22, 1953, and
BE IT, FURTHER RESOLVED that the said Albert L. Kendrick be
paid the sum of $2412.60 salary due him as Chief of Police from
the 6th day of July, 1953 to and including the 30th day of
November, 1953 and that James Miller, City Clerk, is hereby
directed to issue the warrant of the City of Azusa in said sum
to the said Albert L. Kendrick and that Stephen A. Skidmore as
City Treasurer immediately accept and honor said warrant and pay
the same in said sum.

1 BE IT FURTHER RESOLVED that P. J. Tacharner, as City
Attorney, be and he is hereby authorized and directed to make a
2 return to the above Court that the Writ of Mandate hereinhas
been honored and complied with.

BE IT FURTHER RESOLVED that the Mayor of said City of Azusa
4 shall sign this Resolution and the City Clerk shall attest the
same and certify to the passage and adoption thereof.

15 I hereby certify that the foregoing Resolution was duly and
regularly adopted by the City Council of the City of Azusa at a
16 regular meeting of said Council of said City held in the regular
Council Chambers of said City Council in said City, December 21,
171953, and that the same was passed by.the following vote of the
Council;
