HomeMy WebLinkAboutResolution No. 2906aG0& RESOLUTION NO. 2906 U 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY CALIF - 3 ORNIA)AUTHORIZING A VARIANCE UNHR ARTICLE 19 OF ORDINANCE NO. 409, AS AMENDED, AND 4 APPLICABLE TO LOT 86 OF SUBDIVISION NO. 2, AZUSA LAND AND WATER COMPANY, LOCATED AT 5 600 EAST EIGHTH STREET IN THE CITY OF AZUSA. 6' 7 8 The City Council of the City of Azusa does resolve as follows: 9 WHEREAS, San Gabriel Properties, Inc., a corporation, is 10 the owner of Lot 86 in Subdivision No. 2, Azusa Land and Water Company located on Eighth Street in said City of Azusa; and 11 WHEREAS, said Lot is now located in Zone C-1 under the 12 Zoning Ordinance of said City; and 13 WHEREAS, San Gabriel Properties, Inc., a corporation, has hereto filed a Petition for Variance under Article No, 19 14 of Ordinance No. 409 of the City of Azusa, praying that the above described properties be changed from Zone 0_1 to Zone C-3 15 so as to permit the use of a part of said property for a Dry Cleaning establishment; and 16 WHEREAS, said petition has been heretofore filed with 17 the Planning Commission of said City and acted upon by said Planning Commission and all legal requirements with reference to 18 hearing thereon have been complied with and said Planning Commission after due hearing has filed its recommendation that 19 said application of San Gabriel Properties, Inc. be granted as requested; and. 20 WHEREAS, the City Council of the City of Azusa has found 21 and does hereby find, determine and declare that no further notice of the filing of said petition or the hearing thereon 22 is necessarily required; and 23 WHEREAS, said variance is hereby found and determined necessary for the preservation and enjoyment of the substantial 24 rights of the petitioner and is not detrimental to the public welfare or injurious to the property or improvements in the zone 25 or district in which said property lies or injurious to the 26 property or improvements in other zones or districts: NOW, THEREFORE, BE IT RESOLVED that a variance be and 27 the same is hereby ordered and made under Article 19 of Ordinance No. 409 of the City of Azusa, as amended, to Arthur J. Sanders 28 permitting the said Arthur J. Sanders personally to operate a Dry Cleaning establishment on said property, said variance not to 29 be transferrable and in the event that he, the said Arthur J. Sanders terminates business at that location, said variance shall 30 be null and void and said properties revert to its original 31 zoning, namely to C-1. F. J. TOCHARNHR ATTOWNRY AT LAW 130 W.
