A RESOLUTION OF -FE CITY COUNCIL OF THE CITY OF

WHEREAS it ri.l'_ be necessary for the City of
Azusa in the near future to acquire additional orator for
domestic use of its citizens; and
WHEREAS there is a probability that the princi-
pal water bearing lands in the North part of the San
Gabriel Basin Brill be acquired by third persons and will
not therefore be available for purchase by the City; and
7-1HEREAS if such lands are purchased by third
parties, it would bo necessary for the City of Azusa in
the rear future to purchase water bearing lands -further
to the South :!hich would make the -.-rotor so acquired -lore
expensive for all future time by reason of the fact that
it would be necessary to pump the crater from the South
v. -ells to the North end of the City;
THEREFORE, BE IT RESOLVED by the City Council of
the City o; Azusa that the Ci-�y obtain an option from
Hurray S. Vosburgj Roydon Vosburg and ueith !iosburg vrho
at present own the lands lyint; adjacent to the lands or,
which the 'ity's pumping plant is n.ovr,located, for five
acres of :nater bearing land described as follovrs:-
A portion of Lot 66 of Subdivision 11o. 2,
Azusa Land & water Company, being 5 acres
in a square form, the Southerly bcundry line
being the North side of Eleventh Street and
the 7:esterly Boundry line being the Vies" line
of Lot 66, Subdivision No. 2 Azusa Land E:
;'tater Company.
said option to contain and provide for the follc-aing
conditions of sale and purchase, to -wit: -
That said hurray S. Vosburg, Roydon Vosburg
and Keith Vosburg :;ill uarantee that said
lands shall produce at least 175 'rIinerst
inches of '.2.ter, a miners' inch being that
anount of crater flowing through a one inch
square oponing under a four inch pressure
and said flo:., to be continuous, in which
event the City will pay for said lands the
sum of $2,000.00 per acre;
That if said water bearing land produces only
between 150 and 175 inches miners' measurement,
of water, the City shall pay the sura of $1500.00
per acre;
That if said land after being tested produces
less than 150 :ainers inches of :titer, the City
shall have the option of either cancelling said
purchase and declaring it terminated or may if
it -:rishes, select another five acres belonging
to said Murray S. Vosburg, Roydon Vosburg and
Keith Vosburg, for the purpose of testing ovt
its water caracity and if found sufficient, to
substitute those five acres for the five acres
herein specifically described;
That if the five acres herein described produce
less than 150 minersl inches of orator and if the
sale is by the City declared terminated, the said
Murray S. Vosburg, Roydon Vosburg and Keith Vos-
burg are to return to the City such sum or sums
of money as m-cy have been paid them on the pur-
chase price of saiu lands.

BE IT FLYTHER RESOLVED that the City of
Azusa deposit 2UO.00 in escrow to apply on the purchase
price of said lands in the First National Ban}: of Azusa,
interest to be paid on said escrow deposit until the
escrow is terminat"
BE IY FURTHER RESOi,VED that the Mayor and
the City Clerk be authorized to obtain such option upon the
terms herein set forth and that they are further authorized
to sign all necessary papers to complete the said option
in the name of the City and place the sane in escrow in said
First National Bank

I hereby certify that the foregoing Resolu-
tion was duly and Iogaliy adopted by the City Council of
the City of Azusa at a regular meeting held January 16,
