HomeMy WebLinkAboutResolution No. 13711 1 RESOLUTION NO.. 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 4 AZUSA RELATIVE TO ALL UNSOLD LOTS IN BLOCKS NUUBERED 1 to 20, INCLUSIVE, TRACT NO. 8507,'in the CITY OF AZUSA, LOS ANGELES 5 COUNTY, CALIFORNIA. 6 7 RESOLVED that the Bank of America, National 8 Trust & Savings Association, be and it is hereby authorized to 9 convey to Assets Reconstruction Corporation, Ltd., the real 10 property referred to in Resolution No. 1370 of the City Council 11 of the City of Azusa and described in the Agreement dated Decem- 12 bar 4, 1933, between Assets_ Reconstruction Corporation, Ltd., 13 and the City of Azusa, subject to the terms and conditions of 14 said Resolution and Contract, which Contract and certified copy 15 of which Resolution shall be recorded simultaneously with the 16 conveyance of Bank of America, National Trust & Savings Asso- 17 ciation, to Assets Reconstruction Corporat1gn,.Ltd., 18 19 20 '1 hereby certify that the foregoing Resolu 21 tion is a true and correct copy of a Resolution duly and regu2 22 larly passed and adopted by the City Council of the City Of 23 Azusa, California, at a special meeting held on the 12th day of 24 December, 19339 by the following vote of the Council:- 25 AYES: 26 NOES: 7i 27 ABSENT: 28 29 CITY CLERK OF THE CITY OF AZUSA so 31 APPROVED THIS ! �T DAY OF DECEMBER, 1933. 32 OF THE CITY OF AZUSA. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 2°j 24 • i1�ti-1 0 • • 00 CERTIFIED COPY OF RESOLUTION WHEREAS a certain agreement was made and entered into by and b6tween the City of Azusa and Assets Reconstruction Corporation,Ltd.,on the 4th.,day of Decem- ber,1933,reference being hereby made thereto,wherein and whereby it was agreed that "either by deed or by contract of sale or purchase",meaning conveyance of lots setout and described in said agreement,eentered into and delivered shall be deemed a conveyancen,and, WHEREAS it is desired that said meaning of a conveyance shall include the words "let or leasee; NOW THEREFORE,BE IT RESOLVED,THAT the following language in defining a conveyance as incorpor- ated as a part of the afore mentioned agreement being in words and figures.as follows --neither by deed or by con- tract of sale and purchase, (it being agreed that a con- tract fo sale and purchase entered into and delivered, shall be deemed a conveyance" --shall be changed to read and include,or in other words the following words shall become a part thereof --neither by deed,contract of sale and purchase and /or LET OR LEASE",( it being agreed that.a contract of sale and purchase entered into and de- livered,and/or to let or lease shall be deemed a convey- ancee,and it so ordered that said words filet or lease" shall be included as an amendment to said agreement; BE IT FURTHER RESOLVED ,that Assets Recon- struction Corporation,L.td.,by its Vice President,E.A.Eig- ginson,.or: its Assistant Secretary,Al£red Dean Burck,both being hereby duly directed and authorized to so act,here- by instructs that a certified copy hereof be filed with the City of Azusa,whereupon the same shall be deemed an1j: ameddment to the extent as herein provided of said agree- ment herein referred to,as duly passed by the directors of said Corporation on the 12th.,day of December,1933.
