The City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council does hereby find and deter- mine that application for the following special use permit was duly made in writing, that the same was set for hearing before the Planning Commission, that due notice of said hearing was duly given, that upon said public hearing being held, the Planning Commission made its findings and report to the City Council to theeffect that the said special use permit should be granted subject to certain conditions which are hereafter incorporated herein, and that the proposed use will not be a menace to or en- danger the public health, safety or general welfare. SECTION 2. Having reviewed the report and recommenda- tions of the Planning Commission, the City Council does hereby confirm the action of the Planning Commission and does hereby grant a special use permit for the excavation and removal of rock, sand and gravel; operation of a rock plant; rock crusher plant; and operation of a ready -mix concrete plant upon the property described in Exhibit A attached hereto and by this reference made a part hereof, subject to the following conditions, the violation of any of which shall be grounds for revocation of this special use permit by the City Council, to -wit: 1. Prior to the commencement of any operation hereunder, an 8 -foot high concrete slab fence shall be erected on the westerly boundary from the southwest corner 600 feet north; the remainder of the perimeter shall be fenced as specified by County of Los Angeles Ordinance No. 5307. 2. All rock -crushing operations shall be underground; and all operations shall be conducted in compliance with all requirements of the Air Pollution Control District. 3. No blasting shall be used. 4. The area between the fence and surrounding. roads shall be landscaped and maintained. 5. Access roads shall be hard surfaced and maintained. 6. Access from Fish Canyon Road shall be limited to the first 200 feet north from Huntington Drive. 7. There will be no asphalt plant, either hot -mix or cold -mix, permitted, 8. Waste material excavated shall be used for land reclamation purposes. 9. Permittee shall carry on a program of land reclama- tion to the end that when the property's usefulness as a gravel pit has been exhausted, it shall be available for other useful purposes. 1 2 3 4 5 6 7 8 9 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 10. All operations on the site shall be limited to the hours between 6:00 A.M. and 10:00 P.M. of any day. 11. No crusher shall be located on the site closer than 800 feet to the westerly boundary line of the site. 12. The City of Azusa shall have the right to use any roads on the site or leading to the site for any municipal waste disposal purpose. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall transmit a certified copy thereof to the applicant for said special use permit:. 1956.
