HomeMy WebLinkAboutResolution No. 460RES11UTION OF INTENTION NUJbER410 q(00 A RESOLUTION OF THE BOARD OF TRUSTFES OF THE CITY OF AZUSA, DECLARING ITS INTENTION TO IIMOVE`A PORTION OF DALTON AVENUE IN THE CITY OF AZUSA, AND DETERMINING THAT SERIAL BONDS SHALL BE ISSUED TO'REPRESENT THE COST TMMEOB, The Board of.Trustees of the City of Azusa, do resolve as follows: Section 1, That the public interest and convenience require, and it is the intention icf the Board of Trustees of the City of Azusa, State of California, to order the following street work to be done in said City of Azusa, to -wit: FIRST: That a cement sidewalk, five (5) feet in width be constructed along each side of Dalton Avenue, from the southerly property line of Eleventh Street to a line L' 0 0. 1'93 across•said'Dalton Avenue,'between the:southeast corner of Lot 4, Block_ 19,' Map 'of ,Azusa,, -,as per"Map thereof recorded in Book 15, page 93 of -Miscellaneous Records of Los Angeles County, State of California,-and,the southwest corner of Lot 16 Block 18 of said map of Azusa; and also that a cement sidewalk five (5) feet in width.be constructed along each side of Dalton Avenue from a line drawn across gaid,Dalton Avenue, between the Northeast corner of Lot 37, Bloch 30 of said Map of Azusa, and the Northwest corner of Lot 22, Block 18 of said map of Azusa, to the northerly line of Second Street in said City, in accordance with the plans, profiles, and cross-sections numbered B "40 and B 410, and in further accordance with specifications -No. 10 of said City, (except along such portions of said Dalton Avenue, upon which a cement sidewalk five (5) feet in width had already. been constructed and now is to the official line and grade in accordance with and where shown upon the improvement plans, profiles, and cross-sections Nos. "B40 and "B41", and in further accordance with Specifications No. 10 for the con- struction of cement side -walks in the City of Azusa). SECOND: That a cement curb, Class "B", be constructed along each side of Dalton Avenue, from the southerly line of Eleventh Street to a line drawn across said Dalton Avenue, six (6) -feet, northerly from and parallel with the northerly'line of Ninth Street; and also that a cement curb, Class "B", be constructed along each side of Dalton Avenue from a line drawn across said Dalton Avenue between the northeast corner of Lot 37, Block 30 of said Map of Azusa, and the Northwest corner of Lot 22, Block 18 of ` said -Map of Azusa, to a line drawn across said Dalton Avenue six (6) feet northerly from and(,.Wallel with the northerly line of Centre Street; and also that a cement curia, Class "B", be constructed along each side of Dalton Avenue, from a line drawn across said Dalton Avenue parallel with and Seventy- five (75) feet southerly from the south line of Centre Street to the northerly line of Second Street in said City, in accordance with the plans, profiles and cross- sections Nos. "B-40" and.°B-W' and in f4rther accordance with specifications No. 12-of said City, (except along such portions of said Dalton Avenue upon whihh said cement curb has already been constructed ar4d now is to the offigial line and grade in accordance with and where shown upon the im- provements plans, profiles, and cross sections Nos. "B40" and "B-410, and in further accordance with Specifications No. 12, for,the construction of cement curbs in the,City of Azusa.) THIRD: That a cement curb, Class "C", be constructed along both sides of Dalton Avenue, from a line drawn across said Dalton Avenue six (6) feet northerly drom and parallel with the northerly line of Ninth Street to a line drawn across said Dalton Avenue between the Southeast corner of Lot 4, Block 19, of said Map of Azusa3p and the Southwest corner of Lot 15, Block 18, of said 14p of Azusa, and also ,that a cement curb, Class "C", beiconstructed along both sides of said Dalton Avenue from a line drawn across said Dalton Avenue six,(6) feet bortherly from and parallel with the northerly line of Centre Street to a line drawn across said Dalton Avenme Seventy8five (75) feet southerly from and parallel with the southerly line of Centre Street in said City, in accordance with and where shown upon the improvement plans, profiles, and cross-sections No. "B-40" and "B-41" and in further accordance with specifications No. 16 of said City, except along such portions Af said Dalton Avenue Upon which a cement curb, Class "c", has hlreadrr been con- structed and now is to the official line and grade, in accordance with and where shown upon the improvement plans, profiles, and cross-sections No. "B-40" and No. "B-41", and in further accordance with specifications No. 16 for the construction of cement curbs in the said City of Azusa,. Section 2. FIRST: The said Board of Trustees find that the following described Lote, pieces or parcels of land liable to be assessed, to pay the costs and expenses of ,the proposed work or improvement, to -wit: - 19'5 All*of Lots,'numbered 19 29 31-42-�50 60 7, and 46, 47, and 48 of Bloek';30, on.said Bap of Azusa, the title to w4ioh is vested in the City of,Azusa;'a municipal corporation are devoted to public use: to-wit:,Public Park purposes, and the Board of Trustees of said City hereby declaresand determines that said lots, pieces or parcels of land shall be included in the assessments to be made to cover the cost and expenses of said improvements. SECOND: The Board of Trustees declares that that portion of the cost and expenses of said public work or im- provements to be assessed against the lots, pieces or parcels of land, described in subdivision 1 of section 2 of this Resolution, shall be payable by the said City of Azusa out of the General Fund of said City. Section 3. That the Board of Trustees of the City of Azusa determines that.serial bonds shall be issued to re- present assessments of twenty-five ($25.00) dollars or over for the cost of said work or improvement; said serial bonds shall extend ober a period ending nine (9) years from and after the second dap of January next succeeding the date of said bonds, and an even annual proportion of the principal stm thereof shall be payable by coupon on the second day of January of every'year,after their date until the whole is paid; and the interest shall be payable semi-annually, by -coupon, o6 the second day of January and July, respectively, of each year, At the rate of seven .(7) per cent per annum on all sums unpaid, until the whole of said interest and principal are paid. Said bonds shall ve issued in accordance with the provision of an Agit of the Legislature of the State of California, entitled, "AN ACT TO PROVIDE FOR-WORIi IN AND.UPON STREETS, AVEINES, LANES, ALLEYS, COURTS, PLACES, An SIDEWALKS WITHIN MUNICIPALITIES AND UPON PROPERTY AND RIGHTS OF WAY OWNED BY MUNICIPALITIES AND FOR THE ESTABLISHING AND CHANGING THE GRADES -OF ANY SUCH STRLIPTS, AVENUES, LANES, ALLEYS, COURTS, PLACES AND SIDEWALKS 1 -9C - AND PROVIDING FOR TH& ISSUANCE AND PAYMENTAY STREET IMPROVE° M NT BONDS TO 8$PRESENT CERTAIN ASSESSNENTS•FOR THE COST,TEME- OF, AND PROVIDING A METHOD FOR THE PAYMENT OY SUCH BONDS", approved April 7th, 1911,"and-alL acts supplementary thereto or amendatory thereof. Section 46 All improvement plans, profiles and cross sections hereinbefore mentioned are hereby made a part of this Resolution and are referred to for a more particular description of said work and made a part hereof. All specifications referred to in this resolution are on file in the office of the City Clerk of the City of Azusa. R All improvement plans, profiles, and cross-" ctions referred to in this resolution are on file in the office of the City Engineer of the City of Azusa. Section 5, The Superintendent of Streets of the City of Azusa shall immediately post or cause to be posted con- spicuously along the lines of said work and improvement, notices of the passage of this resolution of intention in the manner and form required by law. Section 6. The above Resolution is hereby designated and in all proceedings hereafter had thereunder shall be known and referred to -as Resolution of Intention No. 460. Section 7. The.City Clerk shall certify to the adoption of this resolution and shall_ cause the same to be published by two insertions in IMM POMOTROPIC", a weekly newspaper printed, published and circulated in the City of Azusa and hereby designated by the Board of Trustees for that purpose.
