A .RESOLUTION- OF THE BOARD'OF TRUSTEES :OF -THE -
CITY; -OF:
THE"CITY•OF AZUSA OVERRULING - THE;- PROTEST TO THE OPENING AND.
- INiPROVELiEnTT OF PARAMOUNT AVENUE '•WITHIN -?THE 'CIT�i:O�' AZUSA;
`AS:'PROPOSED:AND' CONTEMPLATED. BY.ORDINANCE'.N0. 258- DULY
PASSED AND. APPROVED ON THE 7TH;DAY OF'SEPTEMBER,,19.26. ..f
The Board of: True tees of the City, of: Azusa do
resolve. as follows;
-� WHEREAS, the; Board of -Trustees -of the'City:of
Azusa did on the 7th day.of September, 1926-, by Ordinance '
No.•258' declare its intention.to•order.the:laying out,
opening and"extending of -Paramount. 'Avenue for a uniform
width of sixty_(•6O) feet from its present easterly termina-
tion in Piedmont'Avenue to the .westerly line of,Azusa.Avenue`=
in the City of -Azusa, describing' the land necessary and con=.
venient-to betaken:therefor and.specifying the boundaries:•. -
of the district to.be benefited by.said improvement and to -
be assessed
obe'assessed to;pay the expense thereof-;
WHEREAS, the Street Superintendent,of the City.of
Azusa did -thereupon -cause notice of.the adoption of'said
ordinance to be published and posted in the manner required.
by law;
WHEREAS_; the -City Clerk of the. City of Azusa.has
mailed to each 'property owner :in the assessment district in'.
said.ordinance, described a.postal card containirg'a.notice -;
1n`'the manner required by law;.
WHEREAS, but one written protest -has been -file&,
against said proposed improdement and_no protest"has. been'
filed against the extent of .the said-assessment..district- .
and, whereas, the protest filed against the said proposed
improvement alas by the owner .of but fourteen hundred -( 1400)
feet of'.the total frontage 'of the /property fronting "on
streets or parts of streets.within the said ease asment,dis-
trict;
WHEREAS, more than .ten .(,10). days- have' elapsed
..since the meetingof'the'.Board of Trustees of said city a.t .
Which a time for the hear.ing.of certain•protests was:fixed,
and notice of the time of -:said. hearing has been published by
'two (2) insertions in the• "Pomotropic"',' a weekly "r_ewspap'er
of general circulation established, printed and publi-shed'_
in the City of Azusa, .there being no daily newspaper estab
lished, printed or published therein; c
..WHEREAS, the hour. of 8;00 o`clock..P. M. on this.
the 15th- day' -of November,..1926; was the day and hour set for
• the hearing; of said protest"- and
WHEREAS, at the said time set",for the ssid,hearirg
of the aaid:protest the said Board -of Trustees proceeded "t,o
hear the same, -and the said protest having been heard and..
duly" considered and. the said Board. •of Trustees 'tieing. by-law
required to pass thereon;
NOW, THEREFORE ,'BE:IT,AND IT. IS HEREBY RESOLVED
by.the Board of Trustees -of the City.of Azusa that the, said :,
protest against. said. proposed layir_g,out, opening and
extending of Paramount Avenue, as contemplated in said-
' Ordinance No. 258, . is signed by..th a owners • of less than
a majority of the frontage of the property fronting on .
streets or_parts.of streets .within the assessment district
described in said ordinance and that -the said protest is.
insufficient; and
BE - I JURTRER AND. IT IS HEREBY RESOLVED,by-the.
said Board of Trustees that the said protest to the said
�.. laying out, opening and extending'of Paramount Avenue, as
contemplated by said Ordinance No.'258, be and the same
is hereby overruled and denied. .
.I hereby certify that the foregoing.resolution
was duly adopted by the Board of Trustees of the City of
Azusa at a regular meeting held November 15th, 1926, by
the following vote of the Board -
