HomeMy WebLinkAboutResolution No. 930RESOLUTION OF INTENTION 140. �3 0 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF AZUSA DECLARING ITS INTENTION TO IItiPROVE SUNSET AVENUE AND THE ALLEYS IN BLOCKS 28-29-36 AND 37 IN THE CITY OF AZUSA, CALIFORNIA. The Board of Trustees of the City of Azusa do resolve as follows: SECTION 1. That the public interest and convenience require iand it is the intention of the Board of Trustees of the City of Azusa to order the following work to be done and improvement to be made in said City to -wit: FIRST: That a cement sidewalk, five (5) feet in width and a cement curb be constructed upon each line of the road way of said Sunset Avenue, as shown on the map of Azusa Heights Tract, as recorded in Book 11, Page 49, of Maps, Records of Los Angeles County from a line drawn across said Avenue parallel to and twelve 112) feet north of the southerly line of Eleventh_ Street, as shown on said map to a line drawn across said Avenue parallel to and twelve 112) feet south of the north line of Crescent Drive, as shown on said map, except any portions of said Avenue upon which a cement sidewalk five (5) feet in width and a cement curb have already been constructed and are to the official line and grade, in accordance with and where shown upon the improve- ment Plans, Profiles and Cross-sections No. 1051 and in further accordance with specifications Numbers 1051-A and 1051-B for the construction of cement sidewalks and curbs res- pectively upon certain streets'in the city of Azusa. SECOND: That an oiled macadam pavement, two (2) inches in depth and of a width of twenty (20) feet, except as otherwise shown on the plans,be constructed upon the alleys in • Blocks 29 -and 36, Map of Azusa, as recorded in Book 15, Page 93, Miscellaneous Records of Los Angeles county, from a line drawn across said alley, from the northwest.corner of Lot 31 of said Block 29, to the northeast corner of Lot 30 of said Block 29, to a line drawn parallel to and 22 feet south of a line drawn across said alley, from the southwest corner of Lot 33 of said Block 36, to the southeast corner of Lot 32 of said Block 36, as shown on said map of Azusa; including portions of the Foothill Boulevard and of Sixth Street as shown on the Plans, Profiles and Cross-sections, except any of said work . already done or cement concrete pavement already constructed, which is to the official line and grade in accordance with and where shown upon the improvement Plans, Profiles and Cross- sections Numbers 1052 and in further accordance with Specifica- tions No. 1051-C for the construction of oiled macadam pave- ment upon certain alleys in the City of Azusa. (, • THIRD: That an oiled macadam pavement, two (2) inches in depth,and of a width of twenty (20) feet except as other- wise shown on the plans, Profiles and Cross-sections be con- structed u. -,on the alleys in Blocks 28 and 37, LTap of Azusa, as recorded in Book 15, Page 93, I,iiscellaneous Records of Los Angeles County, from a line drawn across said alley, from the northwest corner of Lot.26.of said Block 28 to the northeast corner of Lot' _25.of said Block 28 of said Map, to a line drawn' parallel to and twenty-two (22) feet south of a line drawn across said alley from the southwest corner of Lot 33 of said Block 37 to the southeast corner of Lot 32 of said Block 37 as shown on said Map of Azusa, including portions of the Foothill BouloYard and of Sixth Street as shown on the Plans, Profiles and Cross-sections, except any of the work already done or 0 0 cement concrete pavement already constructed, which is to the official line and grade in accordance with and where shown upon the Improvement Plans, Profiles and Cross-sections No. 1052 and in further accordance with Specifications No. 1051-C for the construction of oiled macadam pavement upon certain alleys in the City of Azusa. SECTION 2. TIE ASSESSIf,ENT DISTRICT. AND, WHEREAS SAIDeontemplated work and improvement, in the opinion of the Board of Trustees, is of more than local or ordinary public benefit, said Board hereby makes the expense of said work and improvement chargeable upon a district, which district said Board hereby declares to be the district benefited by said work and improvement, and to be assessed to pay the costs • and expenses thereof; which said district is bounded and describ- ed as follows: ASSESSI]EiTT DISTRICT i•:0. A-3 'WHEREAS, there are different classes of work to be done upon streets and alleys that are not contiguos the Board of Trustees hereby declares the assessment district to consist of two divisions, to be known as Division Ido. 1 and Division No. 2, of -ssessment District Ido. A-3, and that each division is that portion of the Assessment District No. A-3 benefited by the work done within that portion of the said District and to be assessed to pay the costs and expensesthereof; DIVISION NO. 1. is described as follows: Beginning at the northeast corner of Lot 4 of Block "A" of said Azusa Heights Tract as recorded in. Book 11, Page 49, of Plops Records of Los Angeles County, thence west along the southerly line of Eleventh Street, three hundred eighty (380) feet to the northwest corner of Lot 3, Block "B" of said Tract, thence South along the westerly line of said Lot 3, one hundred and forty (140) feet to the southwest corner of said Lot 3, thence continuing south along the'eenter line of the alleys in Blocks,"B" and "I" of said Tract and along said Center • line produced across intervening streets, eight hundred and ninety (890) feet to the northwest corner of Lot 18 of Block "I" of said Tract, thence continuing south one hundred forty-six and six one -hundredths (146.06) feet along the westerly line of said Lot 18 to the southwest corner of said Lot 18,thence south- easterly along the are of a curve concave to the northeast and having a radius of two thousand eight hundred and sixty-five (2865) feet, said curve being the southerly boundary line of Lots 181 19 and 20 of said Block "I" of said Tract, one hundred fifty and thirty-six one hundredths (150.36) feet to the south- east corner of said Lot 20, thence easterly two hundred and thirty (230) feet to the southeast corner of Lot 17 of Block "J" of said Tract, thence north one hundred and fifty (150) feet to the northeast corner of said Lot 17 of Block "J", thence continu- ing north,. eight hundred and ninety (890) feet along the center line of the alleys in • Blocks"J" and "A" of said Tract and along said center line produced across intervening streets to the south- east corner of said Lot 4, of Block "A" thence north along the easterly side of said Lot 4, one hundred and forty (140) feet to the point of beginning. DIVISION 110. 2. is described as follows: Beginning at the northwest corner of Lot 14, Block 37 of the Ilap of Azusa as recorded in Book 15, Page 93, Miscellaneous Records of Los Angeles County, thence south along the westerly line of said Block 37, six hundred (600) feet to the southwest corner of Lot 32 of said Block, thence east along the southerly lines pro- duced of Blocks 37 and 36, six hundred and eighty (680) feet to the southeast corner of Lot 33 of said Block 36, thence north along the easterly lines produced of . -2- said Block 36 and Block 29, one thousand three hundred forty-eight and sixty-seven one hundredths (1348.67) feet to the northeast corner of Lot 31 of said Block 29, thence south 690 22' 20" west seven hundred twenty-six and fifty-eight one hundredths (726.581 feet along the northwesterly lines produced of Blocks -.29 and 28 of said map of Azusa,thence south along the westerly line produced of said Block 28, four hundred ninety-nine and two one hundredths (499.02) feet to the point of beginning. Excepting therefrom in said Assessment District No. A-3 so much of said land as may be within the lines of any public • street or alley; The basis of bearing used in this description is Azusa Avenue north, as shown on said I,iap of Azusa. Reference is hereby made to Map and Plan No. 1055, sheets 1 to 8 inclusive of Assessment District No. A-3, now on file in the office of the City Engineer. SECTION 3: Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of Seven (76A) per cent per annum will be issued hereunder in the manner provided by the Improvement Bond Act of 1915, the last installment of which bonds shall mature fourteen (14) years from the second day of July next succeeding -ten months from their date. Said bonds shall be issued in accordance with the provisions of an act of the Legislature of the State of Calif- ornia, entitled, "An act to provide for the issuance of im- provement bonds to represent and be secured by certain assess- ments made for the cost of certain work and improvements made. in and upon streets, avenues, lanes, alleys, courts, places and sidewalks within municipalities, and upon property and rights of way owned by municipalities, to provide for the collection of such assessments, the sale of the property affected thereby • and for the payment of the bonds so issued." Approved June 11, 1915, and known as the "Improvement Bond Act of 1915" and all acts supplementary thereto or amendatory thereof. SECTION 4: All of said work shall be done in accord- ance with the plans and specifications heretofore adopted for doing said work and now on file in the office of the City Clerk. Notice is hereby given that on Monday, the 6th day of December, 1926, at 7:30 o'clock P. M., in the council.chamber of the Board of Trustees of said City, any and all persons having any objections to the proposed work or improvement may appear before said Board and show cause.why said proposed improvement should not be carried out in accordance with this resolution. The Clerk shall cause this Resolution of Intention to • be published twice in the Pomotropic, a weekly newspaper, pub lished and circulated in said City and hereby designated for that purpose by the Board of Trustees, there being no daily news- paper -published in said City. The Street Superintendent shall cause to be conspicu- ously posted along the line of said contemplated work and im- provement and along all the open streetswithinsaid district above described and in front of all the r.poperty liable to be assessed, notices'of the passage of this Resolution of Intention, in the time, form and manner required by-law. -3- • • Except as hereinabove otherwise provided for the issuance of said serial bonds, all of the herein proposed work shall be done .in pursuance of an Act of the Legislature of the 6tate of California, designated the "Improvement Act of 1911", approved April 7, 1911, and amendments thereto.
