HomeMy WebLinkAboutResolution No. 835RESOLUTION NO. 835 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF AZUSA, CALIFORNIA, ORDERING THE WORK ON NINTH STREET. The Board of Trustees of the City of Azusa, do resolve as follows: WHEREAS, the Board of Trustees of the City of Azusa, did on the fourth day of May, 1925, pass its Resolution of Intention No. 832 to order the hereinafter described work to be done and improve- ment to be made in said City, which Resolution of Intention was duly and legally published as required by law, as appears from the affidavit of C. 0. Broxon now on file in the office of the City Clerk of said City; and WHEREAS, notices of the passage of said Resolution of Intention No. 832 headed "Notice of Improvement" were duly and legally posted along the line of said contemplated work and improvement and in front of all the property liable to be assessed therefor, and on and along each and every open street and highway in the assessment district described in said Resolution of Intention, in time, form, manner and number as required by law, after -the passage of said Resolution of In- tention, as appears from the affidavit of Joseph E. Lee, who personally posted the same, and how, upon the completion of the posting of said notices, forthwith filed said affidavit in the office of the City Clerk, making oath that he completed the posting of said notices, on the twentieth day of May, 1925; and, WHEREAS, all protests or objections presented have been heard and disposed of in time, form and manner as required by law, and said Board of Trustees having uow acquired jurisdiction to order the proposed improvement; IT IS HEREBY RESOLVED, that the public interest and con- venience require the work herein described and the Board of Trustees of the City of Azusa hereby orders the following work to be done and improvement to be made in said City, to -wit: That a cement curb and a sidewalk five (5) feet wide be constructed along each line of the road- way of Ninth Street from a line drawn parallel to and sixteen (16) feet west of a line drawn across said Ninth Street from the northwest corner of Lot 26 of Bloc]: 22 to the southwest corner of Lot 24 Block 11 as per map recorded in Book 15, Page 93, Miscellaneous Records of Los Angeles County, to a line drawn parallel to and sixteen (16) feet east of a line drawn parallel to and sixteen (16) feet east of a line drawn parallel to and sixteen (16) feet east of a line drawn across said Ninth Street from the Southeast corner of Lot 37 of the Orange Grove Tract as recorded in Book 15, Page 93 Miscellaneous Records of Los Angeles County, California, except along such portion of said Ninth Street upon which a cement curb and a sidewalk five (5) feet wide have already been constructed and now are to the official line and grade; in accordance with the plans and specifications designated in Resolution of Intention No. 832. The City Clerk is hereby instructed to post a notice of said work with the plans and specifications therefor, conspicuously for five days on or near the council chamber door, of said City, inviting sealed proposals or bids for doing the work, ordered. Said Clerk is also directed to publish twice, a notice inviting such proposals, and referring to the specifications posted or on file, in the Pomotropic, a weekly news- paper published and circulated in said City and hereby designated for that purpose. 0 293 All propots or bids shall be accompanied by a check payable to the City of Azusa, certified by a responsible bank for an amount which shall not be less than ten per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two sureties, who shall justify, before any officer competent to administer an oath, in double the said amount, and over and above all statutory exemptions. Said sealed proposals or bids shallbe delivered to the ex - official clerk of the Board of Trustees of said City, on or before 7:30 o'clock P. M., on Ivionday the Sixth day of July, 1925, said time being not less than ten days from the time of the first posting and publication of the notice of said work and inviting sealed proposals, on which day and hour all proposals or bids will be publicly opened by said Board of Trustees of the City of Azusa. The City Clerk shall certify to the passage of this Resolu- tion and thereupon and.thereafter the same shall be in full force and effect. Adopted this 15th day of June, 1925. MORGAN J.
