HomeMy WebLinkAboutResolution No. 818262 ESOLUTION NO. 818 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF AZUSA, CALIFORNIA, ORDERING CERTAIN :90RY. TO BE DONE II1 THE CITY OF AZUSA. WHEREAS, the Board of Trustees of the City of Azusa, did on the 19th day of January, 1925, pass its Resolution of Intention No. 812 to order the hereinafter described work to be done and improvement to be made in said City which Resolution of Intention was duly and legally published as required by law, as appears from the affidavit of C. 0. Broxon; and WHEREAS, notices of the passage of said Resolution of Intention No. 812 headed "Notice of Improvement" were duly and legally posted along the line of said contemplated work and improvement and in front of all the property liable to be assessed therefor, and on and along each and every open street and highway in the assessment district in said Resolution of Intention, in time, form, manner and number as re- quired by law, after the passage of said Resolution of Intention, as appears from the affidavit of Joseph E. Lee, who personally posted the same, and who, upon the completion of the posting of said notices, forthwith filed said affidavit in the office of the City Clerk, making oath that he completed the posting of said notices on the 6th day of February, 1925; and rHMEAS, all protests or objections presented have been heard and disposed of in time, form and manner as required by law, and said Board of Trustees having now acquired jurisdiction to order the pro- posed improvement, it is hereby RE8071VD, that the public interest and convenience require the work herein described and the Board of Trustees of the City of Azusa hereby orders the following work to be done and improvement to be made in said City, to -wit: SECTION 1. That a cement curb %nd sidewalk five (5) feet wide be constructed along each line of the roadway of Ninth Street, from a line drawn across said Ninth Street from the northwest corner of Lot 26 of Block 22, to the southwest corner of Lot 24, Block 11, as per map recorded in Book 15, Page 93, Miscellaneous Records of Los Angeles County, to a line drawn across said Ninth Street from the southeast corner of Lot 37 of the Orange Grove Tract as recorded in Map Book 12, Page 65, to the northeast corner of Lot 1 of Block 17, as per map recorded in Book 15, ae 93, l:iiscellaneous Recor. of Los Angeles 263 County, excepting that portion of the south side of said Ninth Street from the Northwest corner of Lot 3 of Block 18 to the northeast corner of Lot 1 of Block 17 as per map recorded in Book lb, Page 93, Miscell- aneous Records of Los Angeles County, California, except along such portion of said Ninth Street upon which a cement curb and sidewalk five (5) feet wide has already been constructed and now is to the official line and grade, in accordance with the plans and specifications designat- ed in -Resolution of Intention No. 812. SECTION 2. That the Board of Trustees of the City of :':zusa, deter- mine that serial bonds shall be issued to represent assessments of twenty- five (25.00) Dollars or over for the cost of said work or improvement; said serial borAs shall extend over a period ending nine (9) years from and after the second day of January next succeeding the date of said bonds and an even annual proportion of said principal sun thereof shall be pay- able, by coupon, on the second day of January every year after their date until the whole is paid; and the interest sfiall .be payable semi-annually, by coupon, on the second days of January and July, respectively of each year at the rate of seven (7510) percent per annum on all stuns unpaid until the whole of said principal and interest are paid. Said bonds shall be issued in accordance with the provisions of an act of the Legislature of the State of California, entitled, "An Act to provide for the issuance of improvement bonds to represent and be secured by certain assessments made for the cost of certain vrork and improvements made in and upon streets, avenues, lanes, alleys, courts, places and sidewalks within municipalities and upon property and rights of way owner by municipalities, to provide for the collection of such-assessmenta, the sale of the property affected there- by and for the payment of bonds so issued". Approved June 11, 1923, and all acts supplementary thereto or amendatory thereof. 6ECTIOI1 3. The City Clerk is hereby instructed to post a notice of said work,together with the plans and specifications therefor, conspicuous- ly for five days on or near the council chamber door, of said City inviting sealed proposals or bids for doing the work ordered. Said Clerk is also directed to publish twice, a notice inviting such proposals, and referring to the specifications posted or on file, in the Pomotropic a weekly news- paper published and circulated in said City and hereby designated for that purpose. all proposals or bids shall be accompanied by a check payable to the City of Azusa certified by a responsible bank for an amount which shall 264 0 • not be less than ten per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two sureities, who shall justify, before any officer competent to administer an oath, in double the said amount, and over and above all statutory exemptions. Said sealed proposals or bids shall be delivered to the City Clerk of the City of Azusa, on or before 8 o'clock P. M., on the 16th day of larch, 1925, said time being not less than ten days from the time of the first posting and publication of the notice of said work and inviting sealed proposals, on which day and hour all pro- posals or bids will be publicly opened by said Board of Trustees of the City of Azusa. SECTION 4. The City Clerk is hereby instructed to certify to the passage of this :3esolution and thereupon the same shall be in full force and effect, from and after the date of its passage.
