HomeMy WebLinkAboutResolution No. 641RESOLUTION NO. 641 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF AZUSA, AUTHORIZING AND EMPOWERING FR-GDERICK BAKER, CITY ATTORNEY OF SAID CITY, TO ENTER INTO A STIPULATION IN THE CAUSE NOW PENDING BEFO!M THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AD FOR THE COUNTY OF LOS ANGELES, ENTITLED COUNTY OF LOS ANGELES, PLAINTIFF, VS, ALHAMBRA, ET AL., DEFENDANTS, No. B-89802. WHEREAS, the City of Azusa is named as a defendant in the action entitled County of Los Angeles, plaintiff, vs. The City of Alhambra, et al., defendants, No. B-89802; and 47 WHEREAS, it is deemed advisable that the said city join the stip- ulation hereinafter referred to; NOW, THEREFORE', BE IT RESOTVrI�, that Frederick Raker, City Attorney of the City of Azusa, be, and he is hereby authorized and empoyered on be- half of said city to sign and enter aoove entitled action in the said Superior Caurt, Adopted and approved this 7th day of February, 1921. Nva.s duly adopted by the Board of Trustees of the City of Azusa and signed by the president of said Board, at a regular meeting thereof held on the 8th day of February, 1921, ty ler Y. of�Azusa a 48 IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA, IN AND FOR THE COUNTY OF LOS ANGELES. --000-- COUNTY OF LOS ANGELES, No. B-89802 Plaintiff, STIPULATION FOR JUDGMENT -vs- AND WAIVER OF CLAIMS OR THE CITIES OF AIHAMBRA, DEMANDS AGAINST PLAINTIFF. at al., Defendants. ) --000-- IT IS HEREBY STIPULATED by and between the parties to the above entitled action through their respective counsel, tha-4&ur-et3, the counsel for each of the respective defendant cities having been duly authorized so to do by the governing bodies of the said defendant cities, that the defendant cities in the above entitled action, hereinafter named, may receive the several sums hereinafter set forth in full satisfaction of all claim or claims which the said cities may have as against the County of Los Angeles, or as against each other, or any or either of the other defendant cities in and to the sum of $38,343.85 tendered to the court by the plaintiff in this action. IT IS FURTHER STIPULATED that the County of Los Angeles, plain- tiff in the above entitled action, is hereby released and discharged from all claims or demands which the defendant cities (other than the cities in this stipulation hereinafter named), or any of them may have against the County of Los Angeles for any and all portion or portions of the said sum of $38,343.85 tendered to the court by the plaintiff in this action, or any other sum received by the county from the cities hereinafter named between the first day of October, 1919, and the 311t day of December, 1920, inclusive under and by virtue 6f the provisions of the motor Vehicle Act; that said sums to be received and accepted by the several cities, being as follows, to -wit; Azusa. . . . . . . . $ 437.00 Eagle Rock . 12.50 El Segundo . . . . . . . . 296.90 Hermosa Beach. 56.00 Huntington Park. 630.00 Sierra Madre 495.50 South Pasadena . . . . . . 15.00 Whittier. 236.00 Venice. 361164.95 TOTAL . . . . $38,343.85 AND IT IS FURTHER STIPULATED AND AGREED that the said defendant cities named hereinabove shall and will receive and accept the sums set opposite their respective names in full satisfaction of all claim ax claims which the said cities, or either of them, may have as against the County of Los Angeles, or as against any or all of the other sum received by the County of Los Angeles from the said cities, or either of them, between the first day of October, 1919, and the 31st day of December, 3.920, inclusive, under and by virtue of the provisions of the Motor Vehicle Act.
