HomeMy WebLinkAboutResolution No. 11921* 0 4W, RESOLUTION NO.1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF CERTAIN PORTIONS OF ORANGE AVENUE AND CERTAIN OTHER STREETS AND -AVENUES IN SAID CITY. - - - - - 0 - - - - - Pursuant to the provisions of the Improvement Act of 1911 and the amendments to.said Act, the City Council of the City of Azusa does resolve as follows: SECTION I That the public interest and convenience require and it is the intention of the City Council of the City of Azusa, California, to order the following described work and improvement in said.'City, to -wit: 1. That that portion of Orange Avenue lying between the westerly line of said Orange Avenue and a line twenty-one (21) feet easterly of and parallel with said westerly line of Orange Avenue, and extending from the southerly line of Sixth Street to the northerly line of Fifth Street; that portion of Orange Avenue lying between the easterly line of said Orange Avenue and a line twenty-one (21) feet westerly of and parallel with said easterly line of Orange Avenue and extending from the southerly line of Sixth Street to the northerly line of Fifth St3teet; that portion of Sixth Street lying between the southerly line of said Sixth Street and a line seventeen (17) feet northerly of and parallel with the said southerly line of Sixth Street, and extending from a line twenty-one (21) feet westerly of and parallel with the easterly line of Orange Avenue to a line seventy-five (75) feet easterly of and parallel with the easterly line of said Orange Avenue; that Lemon Avenue lying between the westerly line of said 1. Lemon Avenue and a line seventeen (17) feet easterly of and parallel,with said westerly line of Lemon Avenue, and extending from the northerly line of Fifth Street to a line 375 feet northerly of and parallel with the said northerly line of Fifth Street; that portion of Lemon Avenue lying between the easterly line of said Lemon Avenue and a line seventeen (17) feet westerly of and parallel :with said easterly line of Lemon Avenue, and extending from the northerly line of Fifth Street to a line 288 feet northerly of and parallel with the northerly line of said Fifth Street; that portion of Louise Avenue lying between the westerly line of said Louise Avenue and a line seventeen (17) feet easterly of and parallel with the westerly line of said Louise Avenue and extending from the northerly line of Sixth Street to a line 452.98 feet northerly of and parallel with the northerly line of said Sixth Street, and that portion of Louise Avenue lying between the easterly line of said Louise Avenue and a line seventeen (17) feet westerly of and parallel with said easterly line of Louise Avenue and extending from the northerly line of Sixth Street to the southeasterly line of the Atchison, Topeka and Santa Fe Railroad Company's right-of- way, be improved by certain grading, by the construction of certain cement concrete curb, cement concrete sidewalk and cement concrete driveways. 2. All of the.foregoing.work and improvement is fully set forth, delineated and described on plans, profiles, cross-sections and detail drawings, designated, I'P1an No. 8 (New Series); on file in the office of the City Clerk of said City, heretofore approved by the City Council of the City of Azusa on the day of December, 1929,'by Resolution No. / and.in "Specifica- tions No. 3 (New Series)", adopted by Resolution No. of the City Council of the City of Azusa, and on file in the 2. office of the City Clerk of said City. The said plans, profiles, cross-sections, detail drawings and specifications are hereby referred to for the full and detailed description of the said proposed work and improvement. 3. The grades, to which the work provided. for shall be done and the improvement made upon those portions of the streets herein- before described, which are provided for in this Resolution, are the grades shown on the profiles therefor on file in the office of the City Clerk of said City, to which said profiles reference is hereby made for the description of said grades. SECTION II. NOTICE IS HEREBY GIVEN that serial bonds to represent unpaid assessments and bear interest at the rate of seven (7) per cent per annum will be issued hereunder.in the manner provided by the Improvement Bond Act of 1915, the last installment of which bonds shall mature fourteen (14) years from the 2nd day of July next succeeding ten (10) months from their date. SECTION III That the contemplated work and improvement hereinbefore mentioned is, in the opinion of said City Council, of more than local or ordinary public benefit and the expense of said work and improvement is made chargeable upon the district hereinafter described and said City Council does hereby declare said district to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which district is bounded and described as follows, to -wit; 3. Beginning at.the northeasterly corner of Lot 11, of Tract,No. 7448, as per map thereof recorded in Book 73, pages 38 and 39, Records of Los Angeles County, California; thence south- westerly along the northwesterly line of said Lot 11, and along the southeasterly line of the Atchison, Topeka and Santa Fe Railroad Company's right-of-way to its intersection with the northerly pro- longation of the westerly line of Lot 2, of Tract No. 7875, as per map thereof recorded in M.B. 111, pages 12 and 13, Records of Los Angeles County, California; thence southerly in a direct line to the northwesterly corner.of the last mentioned Lot 2; thence southerly in a direct line -to the southwesterly corner of Lot 10 of the aforesaid Tract No. 7875; thence southerly along the south- erly prolongation of the westerly line of the last mentioned Lot 10 to its intersection with the southerly line of Sixth Street; thence easterly along the southerly line of Sixth Street to the northwesterly corner of Lot 13, of Tract No. 6604, as per map thereof recorded in Book 74, page 12, Records of Los Angeles County, California; thence southerly in a direct line to the southwesterly corner of the last mentioned Lot 13;.thence westerly in a direct line to the northwesterly corner of Lot 14, cf the aforesaid Tract No. 6604; thence southerly in a direct line to the northeasterly corner of Lot 28 of the aforesaid Tract No. 6604; thence westerly in a direct line to the northwesterly corner of the last mentioned Lot 28; thence northerly along the easterly line of Lemon Avenue to its intersection with the easterly prolongation of the northerly line of Lot 4, of the aforesaid Tract No. 6604; thence westerly in a direct line to the northwesterly corner of the last mentioned Lot 4; thence southerly in a direct line to the southwesterly corner of Lot 8, of the aforesaid Tract No. 6604; thence easterly along the northerly line of Fifth Street to a point, which point is 150 feet easterly of the easterly line of Orange Avenue; thence 4. northerly along a line, which line is 150 feet easterly of and parallel with the easterly line of Orange Avenue, to its inter- section with the center line of Sixth Street; thence westerly along the center line of said Sixth Street to its intersection with the southerly prolongation of the easterly line of Lot 1, of the aforesaid Tract No. 7448; thence northerly in a direct line to the place of beginning, excepting therefrom any lands forming any part of any public street or alley. The above description is general only. A plat or map, No. 9 (New Series), of said Assessment District, adopted by Resolution No. //9/ of the City Council :of said City, indicating by a boundary line the extent of the territory included in the proposed district, is on file in the office of the City Clerk. Reference is hereby made to said plat or map for a further full and complete description of the said assessment district. The said map or plat so on file shall govern for all details as to the extent of the said assessment district. SECTION IV. NOTICE IS HEREBY GIVEN that on Monday, the 6th day of January, 1930, at 7;30 o'clock, p.m. in the Council Chamber of the City Hall of the said City of Azusa, any and all personshaving any or objections to the proposed work or improvement,the grades/to the extent of the assessment district, or both, may appear before the said City Council.and show cause why said proposed improvement should not be carried out in accordance with this Resolution. SECTION V. The Azusa Herald, a weekly newspaper printed, published and circulated in the City of Azusa, is hereby designated as the newspaper in which this Resolution of Intention shall be published and for the publication of all other notices, resolutions, orders or other matter required to be published by the provisions of 5. the Improvement Act of 1911, hereinbefore referred to, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two (2) insertions in the said newspaper in the manner and form required by law. The City Council does not deem it advisable that the Clerk mail copies of the Notice of Improvement to owners, or reputed owners, and she is not required to mail the same. SECTION VI. The Street Superintendent of said City shall, after the adoption of said Resolution of Intention, cause to be conspicuously posted along the lines.of said contemplated work or improvement, and along all the open streets within the hereinbefore described assessment district, notices of the passage of this Resolution of Intention, in the manner and form required by law. SECTION VII Except as hereinbefore stated, all the proceedings for the aforesaid work and improvement shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California designated as the "Improvement Act of 191111, approved April 7th, 1911, and Amendments thereto.
