HomeMy WebLinkAboutResolution No. 1068RESOLUTION OF INTENTION NO. / 0 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, DECLARING ITS INTENTION TO ORDER THE WROVEMENT OF PORTIONS OF AZUSA AVENUE, AND DECLARING THAT THE. nSPROVEMENT IS TO BE OF MORE THAN LOCAL OR ORDINARY PUB- LIC BENEFIT, AND THAT THE COST OF THE SAID n1PROVEMENT SHALL BE ASSESSED UPON A DISTRICT, AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF. The City Council of the City of Azusa do resolve as fdllows: Section 1. That the public interest and convenience require and that it is the intention of the City Council of the City of Azusa to order the following work to be done, to -wit: First: That twenty-two (22) ornamental lighting poste shall be con- structed along the east side of Azusa Avenue between the north line of First Street and the south line of Fifth Street and that twenty-two (22) ornamental lighting posts be constructed along the west line of Azusa Avenue between the north line of First Street and the south line of Fifth Street, together with the construction in said Azusa Avenue between the north line of First Street and the south line of Fifth Street of certain conduite, cables, wires, lamps, and appliances for the purpose of lighting with electricity, all that portion of said Azusa Avenue above described. Second: That in connection with the system for lighting the afore- said portion of Azusa Avenue, a transformer, a outout box, certain conduits, cables, an:. Anderson time switch, and other appurtenances and appurtenant work be constructed in Fifth Street between the center line of Azusa Avenue and the center line of the alley in Block 52 Map of Azusa. That said ornamental lighting poste shall be of Ferronite cast iron and that on all portions of streets and alleys above set forth the work to be done shall include all excavation, and the removal of all existing pavement, gutter, curb, sidewalks and other improvements made necessary by the work of installation to be done hereunder and all resurfacing of pavement, and replace- ment of gutters, curbs, sidewalks and other improvements made necessary by such removal together with work appurtenant to or incidental to any of the foregoing described items, also all other work and improvements shown on the plans.,and specifications hereinafter designated. That in the following descriptions the ex- pressions"station 39* 38Y�shall mean 3938 feet south of the south line of Fourth St. Thirds That cement concrete curbs be constructed along each line of the roadway of said Azusa Avenue between the center line of First Street and the northerly line of Broadway except between station 39 + 38 and station 39 + 95 on the east line and between station 39 t 80 and station 40 -t- 35 on the west line of said roadway and except along such portions of said avenue upon which a cement curb or curb wall has already been constructed and now is to the official line and grade in accordance with and where shown upon the -improvement plans, pro- files and orose-seotione. Fourth: That a six (6) inch cement concrete gutter three(3) feet in width be constructed along each line of the roadway of said Azusa Avenue between the south line of Fourth Street and the northerly line of Broadway except be- tween station 38 t 50 and station 41 + 10 on the east line and between station 38 t 60 and station 41 -t' 10 on the west line of said Avenue in accordance with the improvement plane, profiles and orose-seotions. Fifth: That six (6) inch cement concrete cross -gutters six (6) feet in width be constructed along each line of the roadway of said Azusa Avenue at each cross street intersection of said Avenue with First, Second, Third and Fourth Streets and along each line of the roadway of said Avenue at the termination of Paramount Avenue (proposed) in said Azusa Avenue in accordance with and where shown upon the improvement plane, profiles and orose-seotions. Sixth: That an eight inch reinforced cement concrete pavement forty-two (42) feet in width, except as otherwise shorn on the plans, be constructed upon the roadway oT said Azusa Avenue from the south lire of Fourth Street to the north line of Broadway except between station 39-1` 56 and station 40-} 10 in accordance with and where shown upon the improvement plans, profiles and cross-sectione. Seventh: That six (6) inch oiled macadam pavement be constructed between the center line of Fourth Street and the south line of Fourth Street and between the gutter lines and the property lines produced of said Azusa Avenue at each intersection with First, Second and Third Streets; said macadam to be used for the purpose of' mak- ing smooth union between the new concrete pavement and the old macadam or cress streets, said work to be in accordance •,:ith the plans and profiles thereof. eighth: That a reenforced cement concrete bridge be constructed between station 39-1- 58 and station 40 + 10 of said Azusa Avenue across the channel of the Little Dalton 'Nash in accordance with and whore shown upon the improvement plans, profiles and cross-sections. 17inth: That safety appliances or life net, so called, shall be installed on the approaches of said bridge in accordance with the plans and detail drawings thereof. .Tenth: That the four (4) foot corrugated iron pipe culvert existing on the crest curb line of Azusa Avenue at station 39-e 70 shall be removed to a position six (6) .feet west of its prosent position and the earth fill abovo it replaced and the roadway reconstructed as shorn on the plans. A connection shall also be made betseer to said iron pipe culvert and the box culvert to be constructed upon the west side of said Avenue in accordance with and where shown upon the improvement plans and drawings thereof. Eleventh: That cement box culverts be constructed between station 38-t- 50 and station 39 t 20 on the east side of said Azusa Avenue and between station 38 + 60 and station 391- 56 on the west side of said Avenue in accordance with the plans and detail drawings thereof. Twelfth: That domestic water connection (or "taps") be made at each lot or parcel of lard not already provided with outlets from the city water mains, in accord- ance with the improvement plans, profiles and cross-sections. Thirteenth: That four (4) traffic lanes each ten (10) feet in wid.th be painted on the finished pavement, parallel to the center line of said Azusa Avenue, from the .south line of Fourth Street to the north line of Broadway. The boundaries of said lanes to be'stripes six (6) inches in width. Fourteenth: That a six (6) inch cast iron water pipe be constructed across said Azusa Avenue eighty (60) feet in length at each of the intersections of First, Second, Third and Fourth Streets with said Avenue in accordance with and where shown upon the improvement plans, profiles and cross-sections. Fifteenth: That cement concrete storm drains be constructed between station 37 + 70 and station 38 -f�50 on the east side and between station 37 -f"55 and station 36 + 60 on the west side of said Azusa Avenue in accordance with the plans, profiles and drawings thereof. Sixteenth: That concrete man -holes be constructed upon said Azusa Avenue at its intersection with First and Third Streets as shown on the plans and drawings thereof. Seventeenth: That a four ',(4' inch water pipe be installed upon said Azusa Avenue between the north line of First Street and the north line of Broadway with two: (e) inch transverse water pipe connections at intervals of tone hundred ((100)) feet upon said Avenue and with necessary valves, fittings and man-4oles as shown upon the plans and drawings thereof and in accordance with the specifications. That all of the aforesaid work and improvement is to constructed at the grades shown on and in accordance with plans 1074, 1075, 1075-B, 1076, 1076-B, 1066 and 1067 on file in the office of the City Engineer and in accordance with specifications numbers 1074-0 and 1074-E on file in the office of the City Clerk and said plans and specifications are hereby referred to for the full and detailed descriptions of said work or improvement and for the description of the grades at which the work shall be done. The City Council hereby orders that $24,000.00 be paid out of the general fund of said City of Azusa to defray a portion of the costs and expenses of the construction of the bridge across the Little Dalton wash,the pavement of street intersections and of a portion of the pavement to be constructed between the center line of Fourth Street and the north line of Broadway; and the Superintendent of Streets, in making up the assessment herein provided for the costa and expenses of said work, shall first deduct from the whole cost and expenses such part thereof as is hereby ordered to be paid out of the municipal treasury as aforesaid. ,Section 2. AND, WHEREAS, said contemplated work and improvement, In the opinion of the City Council, is of more than local or ordinary public benefit, said City Council hereby makes the expense of said work and improve- ments chargeable upon a district, which district said Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which said district is bopBded and described as follows: ASSESSMENT DISTRICT Beginning at the northwest corner of Lot 1 Block 63 Map of Azusa as recorded in Book 15 Page 93 Miscellaneous Records of Los Angeles County, thence southerly in a direct line to the southeast corner of Lot 23 of the Mountain View Extension Tract, as recorded in Book 12, Page 104 of Maps, Records of Los Angeles County, thence continuing southerly in a direct line to a point on the southerly line of Lot 8, two hundred feet east of the southwest corner of said Lot 8 of Block C of Subdivision No. 1 Azusa Land and water Company as recorded in Book 16 Page 17 Miscellaneous Records of Los Angeles County, thence westerly along the northerly line of Broadway in a direct line to the southwest corner of Lot 8 of the Azusa Foothill Citrus Company Tract as recorded in Book 5 Page 30 of Maps, Records of Los Angeles County, thence northerly in a direct line to the northwest corner of said Lot 8, thence easterly in a direct line to the southwest corner of Lot 3 of said last mentioned tract, thence northerly in a direct line to the northwest corner of said Lot 3, thence easterly in a direct line to the southwest corner of Lot 12 of Block B of said Subdivision No. 1, thence northerly along the westerly line of said Lot 12 produced in a direct line to a point of intersection with the southerly line of Fourth Street produced westerly, said point of intersection being seven hundred and sixty (760) feet west of the northwest corner of Lot 13 of Block 59 of said Map of Azusa, thence easterly in a direct line to the northwest corner of Lot 1 Block 60 of said Map of Azusa, thence northerly in a direct line to the southwest corner of Lot 24 of Block 44 of said Map of Azusa, thence easterly in a direct line to the southeast corner of Lot 48 of Block 45 of said Map, thence southerly in a direct line to the northeast corner of Lot 13 of Block 61 of said Map, thence easterly in a direct line to the point of beginning. Reference is hereby made to map and plan number 1077 of the Assessment District heretofore adopted and on file in the office of the City Engineer. Section 3. Notice is hereby given that serial bonds to represent un- paid assessments, and bearing interest at the rate of six (6) per cent per annus will be issued hereunder in the manner provided by the "Improvement Bond Act of 1915," the last installment of which bonds shall mature fourteen (14) years from the second day of July next succeeding ten months from their date. Section 4. Reference is hereby made to license agreement of Western Lighting Company for price on King Company's Ferronite ornamental lighting posts to be installed hereunder and for price of General Electric Company's lighting units to be installed hereunder. Said license agreement is on file in the office of the City Clerk and is dated iyze. Section 5. Notice is hereby given that on Monday, the 1'9,Ah, day of '/yq rcii , 1928 , at 7:30 p.m. in the council chamber of the City Council of said City, any and all persona having any objections to the pro- posed work or improvement or to the extent of the district to be assessed or both may appear before said board and show cause why said proposed improvement should not be carried out in accordance with this resolution. The Clerk shall cause this Resolution of Intention to be published twice in the Azusa Journal, a weekly newspaper published and circulated in said city and hereby designated for that purpose by the City Council, there being no daily newspaper in said city. 1 The Street Superintendent shall cause this resolution to be con- spicuously posted along the line of said contemplated work and improvement and along all the open streets within said district above described notices of the passage of this Resolution of Intention, in the time form and manner required by law. ° Except as hereinbefore otherwise provided for the issuance of said serial bonds all of the herein proposed work shall be done in pursuance of an act of the legislature of the State of California designated the "Improvement Act of 1911" approved April 7, 1911, and amendments thereof.
