BERKEBILE UNDER AND BY VIRTUE OF HIS EMPLOYMENT UNDER RESOLUTION NO. 947, DULY ADOPTED AND APPROVED ON THE 19TH DAY OF. JANUARY, 1927. The City Council of the City of Azusa do re- solve as follows: WHEREAS, under and by virtue of Resolution No. 947, entitled "A RESOLUTION OF. THE BOARD OF TRUSTEES OF THE CITY.OF,AZUSA EMPLOYING, AUTHORIZING AND DIRECT ING THOMAS A..BERKEBILE TO RECOVER, BY ACTION AT LAW OR IN EQUITY OR BY SETTLEMENT, THE CLAIM OF THE CITY OF AZUSA AGAINST BANK OF AMERICA, PARAMOUNT MOTORS CORPORA- TION OF THE PACIFIC, F. S. LACK L. W. COFFEE AND OTHERS, RE LOTS ELEVEN (11), TWELVE (12i, TWENTY-SIX (26) AND ' TWENTY-SEVEN (27') OF SUBDIVISION NO. 2 OF AZUSA LAND AND WATER COMPANY, ACCORDING TO MAP RECORDED, IN BOOK,43, PAGE 94, MISCELLANEOUS RECORDS IN THE OFFICE OF -THE COUNTY RE- CORDER OF LOS ANGELES COUNTY, CALIFORNIA; AND FIXING • THE COMPENSATION OF SAID THOMAS A. BERKEBILE THEREFOR", duly adopted by the Board of Trustees of said City of. Azusa and approved by the President of said Board on. the 19th day of January, 1927, Thomas A. Berkebile was employ- ed to and did secure a compromise and settlement of the rights and claims of the City of Azusa in and to Lots Eleven (11), Twelve (12), Twenty -sig (26) and -Twenty-seven (27) of Subdivision No. 2 of Azusa Land and Water ;Company, • according to map recorded in Book 43, Page 94, Miscellan- eous Records in the office of the County Recorder of Los Angeles County, California, as against Bank of America, Paramount Motors Corporation of the Pacific, F. S. Lack,' L. W. Coffee and others; WHEREAS, the said Thomas A. Berkebile secured a settlement as against said Bank of America, Paramount Motors Corporation of the Pacific, F. S. Lack, L. W. Coffee and others for the sum o3 Forty Thousand Dollars ($40,000), Ten Thousand Dollars ($10,000) of which was paid in cash and Thirty Thousand Dollars ($30,000) of which by the con- ditions of the said settlement is deferred in payment,and is to be paid in accordance with the terms of that certain agreement incorporated in and -made a part of Resolution No. 974, entitled "A. RESOLUTION OF THE BOARD OF TRUSTEES . • OF THE CITY OF AZUSA.EFFECTING SETTLEMENT WITH D. CORNELIUS SMITH AND BERTHA A.'SMITH, HIS'WIFE, L F. S. LACK, .W._ COFFEE$ R. E. CLAPP AND PARAMOUNT MOTORS CORPORATION OF THE PACIFIC AND AUTHORIZING THE PRESIDENT OF SAID BOARD AND THE CITY CLERK OF'SAID CITY, FOR AND ON BEHALF OF SAID CITY TO EXECUTE, APPROVE, RATIFY AND CONFIRM CERTAIN DOCUMENTS", duly adopted by the Board of Trustees of said city and ap- proved by the President of said Board on the 11th day of April, 1927; 'and WHEREAS, said Thomas A. Ber kebile has already re- ceived his compensation for the Ten Thousand Dollars ($109000) in cash already paid the City Of Azusa by.and urd er said settlement,and the remainder of.his compensation under and by virtue of the terms of said Resolution No. 947 is to be paid as and when the said Thirty Thousand Dollars (030,000) deferred payment, or any portion or portions there- Oft are paid to the City of Azusa;. NOW; THEREFORE, BE IT RESOLVED AND DECLARED that said Thomas A. Berkebile, under and by virtue of the terms of said Resolution No. 947, is entitled to and shall receive from and be paid by the City of Azusa as the balance of his compensation for the making of said settle- ment a sum or•sums.of money equal to fifteen per cent. (15P of the said Thirty Thousand Dollars ($30,000), unpaid bal- ance due to the City of Azusa from the said Bank of America, Paramount Motors Corporation of the Pacific, F. S. Lack, L. W. Coffee and/or others or any of them under the said agreement contained in said Resolution No. 9741 if, a's and when the said Thirty Thousand Dollars ($30,0005 is paid to the City of Azusa.
