HomeMy WebLinkAboutResolution No. 1003F', RESOLUTION OF INTENTION ITO. /me 3 A RESOLUTION 02 THE BOARD OF TRUSTEES OF THE CITY OF AZUSA, DECLARING ITS 1X - 2=10N 10 DMOVE PORTIONS OF ORANGE AVENUE, ELEVENTH STREET, AND TENTH STEM IN THE CITY OF AZUSA AND DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND MAKING THE EBPENSE THEREOF TO BE BORNE UPON A DISTRICT, AND �*:ETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF, \ The Board of Trustees of the City of Azusa do resolve as follows: Section 1. That the public interest and convenience require and that it is the intention of the Board of Trustees of the City of Azusa to order the follow- ing work to be done pursuant to and in accordance with the provisions of an Act of the Legislature of the State of California entitled, "AN ACT TO PROVIDE FOR WORK UPON STREETS; LAM? ALLEYS? QOURTS, PLACES, AND SIDEWALKS, AND FOR THE CON- STRUCTION OF SEWERS WITHIN MUNICIPALITIES," approved March 18, 1685, and known as "THE VROOMAN ACT;" and all acts supplementary thereto or amendatory thereof, to -wit: • The improvement of Eleventh Street, Tenth Street and Orange Avenue, all of which streets and avenue are shown and dedicated on the map of Azusa Heights Tract as recorded in Book 119 Page 49 of Maps and on the Map of Azusa as recorded in Book 15, Page 93 Miscellaneous Records of Los Angeles County; said streets and Avenue to be improved in the following manner to -wits • FIRST: That a cement curb be constructed along each line of the roadway of said Orangf Avenue, from the Northerly line of Crescent Drive to the Center line of Eleventh Street as shown on said map of Azusa•Heighte Traot,eaoept along such portions of said avenue upon which a cement curb has already been constructed and now is to the official line and grade, in accordance with and where shown upon the improve- ment plane, profiles and oross-sections No. 1064 and in further accordance with Specifications Nol 1055-B for the construction of cement curbs in the City of Azusa. SECOND: `y That a sidewalk, five(5) feet in width, be constructed along each line of the roadway of said Orange Avenue, from the Northerly line of Crescent Drive to the Center line of Eleventh Street as shown on said map of Azusa•Heights Tract, except aloAg such portions of said avenue upon which a sidewalk, five (5) feet in width, has already been constructed and now is to the official line and grade, in accordance with and where shown upon the improvement plane, profiles and cross-sections No. 1064 and in further accordance with specifications No. 1055-A for the construction of cement sidewalks in the City of Azusa. c I . i THIRD: That Trees be planted upon each line of the roadway of Orange Avenue from the er/y North' .4 of Crescent Drive to the South line of Eleventh Street, as shown upon sadd �aptbf,Azusa Heights Tract except upon such portions of said Avenue, upon which trees have already been planted, end now are to the official line and grade in accordance with and where shown upon the plane, prof ilea and oross-sectiono No. 1064 and in further accordance with Specifications No. 1055-C for the plant - Ing of trees upon certain streets in the City of Azusa. • FOURTH: That a cement sidewalk five (5) feet in width be constructed along each line of the roadway of said Eleventh Street from the Westerly line produced of Orange Avenue in Block C of said Azusa Heights Tract to the Easterly line of Azusa Ave- nue as shown on said Map of Azusa; except along such portion of said street upon which a cement sidewalk five (5) feet in width has already been constructed and now is to the official line and grade in accordance with and where shown upon the improvement plans, profiles and orose-sections No. 1055; and in further accordance • with Specification No. 1055-A for the construction of cement sidewalks upon cex tain streets in the City of Azusa. FIFTH: That a cement curb be constructed along each line of the roadway of said Ele- venth Street from the westerly line of Orange Avenue ae shown in Block C of said • Azuej Heights Tract to the easterly line of Azusa Avant as bhown on said Map of Azusa; except along such portions of said street upon which a cement curb has al- ready been constructed and now is to the official line and grade in accordance with and where shown upon the improvement plane, profiles and oroes-sections�No. 1055; and in further accordance with Specifications No. 1055-B for the construc- tion of cement curbs upon cattain streets in the City of Azusa. SURE: That trees be planted along each line of the roadway of said Eleventh Street from the easterly line of Orange Avenue as shown on said Map of Azusa Heights • Tract to the westerly line of Azusa Avenue as shown on the said Map of Azusa; except along such portions of said street upon which treea of like varieties have already been planted and now are to the official line and grAde and are planted in accordance with and where shown upon the improvement plane, profiles and arose - sections No. 1055; and in further accordance with Specifications No. 1056-C for the planting of trees upon oeMin streets in the City of Azusa. SEVENTH That a cement sidewalk five (5) feet in width be conetruoted along each line 1E 7�V-/o d 3 of the roadway of said Tenth Street from the westerly line of Azusa Avenue to the center line of Pasadena Avenue as shown upo# the said Map of Azusa; except along such portions of said streets upon which a cement didewalk,five (5) feet in width,has already been constructed and now is to the official line and grade in accordance with and where shown upon the improvement plane, profiles, and cross-sections No. 1056; and in further accordance with Specifications No. 1055-A for the constru- ction of cement sidewalks, upon certain streets in the City of Azusa. • Eighth: That a cement curb be constructed along each line of the roadway of said Tenth Street from the westerly line of Azusa Avenue to the center line of Pasadena Avenue as shown upon the said Map of Azusa; except along such portions of said streets upon which a cement curb has already been aonstructed and now is to the official line and grade in accordance with and where shown upon the improvement plans, profiles and cross-sections No. 1056; and in further accordance with Specifications No. 1055-B for the construction of cement curbs upon certain streets in the City of Azusa. Ninth: • That trees shall be planted along each line of the roadway of said Tenth Street from the easterly line of Azusa Avenue as shown on said Map of Azusa to the westerly line of -Pasadena Avenue as shown on said Map of Azusa, except along such portions of said street upon which trees of like variety or varieties have already been planted and now are to the official line and grade and are • planted in accordance with and where shown upon the improvement plane, profiles and cross-sections No. 1056 and in further accordance with Specifications No. 1055-C for the planting of trees upon certain streets in the City of Azusa. Section 2. AND MEREAS SAID contemplated work and improvement, in the opinion of the Board of Trustees, is of more than local or ordinary public benefit, said Board hereby makes the expense of said work and improvement chargeable upon a district, which district said Board hereby declares to be the district benefited • by said work and improvement, and to be ass&ssed to pay the costs and expenses thereof; which said district is bounded and described as follows; ASSESSMENT DISTRICT NO. A-7. Beginning at the southwest corner of lot 16 of Block H of said Azusa Heights Tract thence north in a direct line to the northwest corner of lot 3 of Block C of said Tract, thence northeasterly in a direct line to the southwest corner of lot 9 of Tract Be. 8161, as recorded in Book 128, page 20, Records of Los Angeles County, thence easterly in a direct line to a point at the intersection of the q. north line of Eleventh Street and the east line'of lot 26, produced, of said Tract No. 8161, thence north in a direct line to the northeast corner of said lot26� thence easterly in a direct line to a point on the westerly line of Lot 8 of Tract No. 6506 as recorded in Book 97, pages 7 and 8, Records of Los Angeles County, sAid point being 10 feet south of the northwest corner of said lot S. thence south in a direct line to the northwest corner of lot 10 of said Tract No. 8506, thence easterly in a direct line to the northwest corner of lot 20 of said Tract • Pio. 85069 thence northerly in a direct line tothe northwest corner of lot 16 of said Tract No. 8506, thence easterly in a.direct line to a point on the east line of Azusa Avenue 260 feet north of Eleventh Street, thence south in a direct line to the northwest corner of lot 13 of Block 4, of said Map of Azusa, thence easterly in a direct line to the northeast corner of said lot 13, thence southerly in a direct line to the northeast corner of lot 19 of said Block 4, thence easterly in a direct line to the southeast corner of lot 18 of Mock 3 of said Map of Azusa, thence southerly in a direct line to the northeast corner of lot 24 of said Block 39thence easterly in a direct line to the north east • corny of lot 12 of Block 2, of said Map of Azusa, thence northerly in a direct line to the southeast corner of lot 6 of said Block 2, thence easterly in a direct line to a point on the west line of lot 3, 15 feet north of the southwest corner of saidt lot 3 of Block 85 of said Map of Azusa, thence southerly in a direct line soil • to the northwest corner of ss&d lot 10 of Block 859 thence southwesterly in a direct line to the southeast corner of lot 43 of the Orange Land Tract, as recorded in Book 12, page 65 of Maps Records of Los Angeles County, thence westerly 1n a direct line to the southwest corner of said lot 43, thence northerly in a direct line to the southwest corner of lot 48 of said last mentioned Tract, thence westerly in a direct line to the southeast corner of lot 1 of Block 14 of She said Map of Azusa, thence southerly in a direct line tothe southeast corner of lot 6 of said Block 14, thence westerly in a direct line tothe southeast corner of lot 6 • of Block 12 of said Map of Azusa, thence northerly in a direct line to the southeast corner of lot 1 of Block 5, of said Map of Azusa, thence westerly in a direct line to the southeast corner of lot 13 of said Block S. thence southerly in a direct lineto the southeast corner of lot 18 of said Block 5 of said Map of Azusa, thence westerly in a direct line to the southwest corner of lot 16 of said Block 6, thence northerly in a direct line to the southwest corner of lot 15 of Block 6 of said Map of Azusa, thence northwesterly in a direct line to the southwest direct line to the southeast corner of lot 17 of Block I of said Azusa Heights Tract, thence westerly along the are of a curve, concave to the noltheast, sw curve being the northerly line of Cresent Drive to the southwest corner of lot 16 of Block H of said Azusa Heights Tract, being the point of beginning. The basis of bearings used in this • description is Orange Avenue north, as shown on said Map of Azusa Heights Tract. Reference is hereby made to Map No. 3064-A showing Assessment District No. A-7 approved and adopted by the Board of Trustees by Resolution, J'aly 5, 1927, and now on file in the office of the City Engineer. Section 3. That all of the work aforesaid shall be done to the official grade as shown on said plans Nos. 1064, 1055, and 1056, and in accordance with Specifications Nos. 1055-A, 1055-B, and 1055-C for the construction of sidewalks, curbs, and the planting of trees, respectively, upon certain streets in the City • of Azusa. Section 4. The plane, profiles, cross-sections, and specifications referred to in this resolution are on file in the office of the City Clerk of said City. Said Plans, Profiles, Cross-sections, and Specifications are hereby refereed to • for a more particular description of said work and are made a part hereof. Section 5. Notice is hereby given that serial lbonde to represent unpaid assessments, and bear interest at the rate of seven per cent per annum, will be issued hereunder in the manner peovided by the improvement bond act of 1915, the last installment of which bonds shall mature fourteen years from the second day of July next succeeding ten months from their date. Section 6. The Street Superintendent shall post notice of'the work, as • required by law, and shall cause said notice to be published once in the Pomo- tropics Section 7.
