RESOLUTION NO. 161
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA, LOS ANGELES COUNTY, CALIFORNIA, RELATIVE
TO THE STORAGE AND CONSTRUCTION YARD USED AND
MAINTAINED BY THE LOS ANGELES COUNTY FLOOD CONTROL
DISTRICT IN THE NORTHWESTERLY SECTION OF SAID CITY
OF AZUSA AND AS TO THE FENCES AND GATES ENCLOSING
SAME.
The City Council of the City of Azusa does resolve as
WHEREAS for some years the Los Angeles County
Flood Control District has maintained and
used a storage and work yard at the end of
Tenth Street in the northwesterly section of
the City* of Azusa, and is about to discontinue
the use and maintenance of same; and
WHEREAS in the maintenance and use of said
storage yard it has been necessary for the Flood
Control District and the County to make certain
changes in the terrane of said yard, which changes
should be eliminated when the said yard is given
up by the Flood Control District and said premises
restored to their original condition; and
WHEREAS the fences and gates enclosing said
yard have been in place for some years and are
of practically no value except for use by some
public body in the City of Azusa due to the fact
that the expense of removing said fences and gates
to points outside the City of Azusa would be likely
to be greater than the second hand value of said
fences and gates; and
WHEREAS the City of Azusa has a reservoir
in which it stores its domestic waters and well
properties which it uses in supplying domestic
waters, all of which are in need of additional
fences; and
WHEREAS the regulations of the County Health
Department and the orders of said department are
such that additional fencing should be placed around
the reservoir and well properties of said City of
Azusa, in order to protect same as domestic water; and

WHEREAS the City of Azusa is without funds
to go on the market and purchase fencing for the
purpose of enclosing its reservoir and well
properties, but is nevertheless in immediate need
of said fences; and
WEREAS the City of Azusa is in -position to
render a service to the said Mod Control District
and the County of Los Angeles by way of going
upon said work and storage yard at the time same
is given up by the Flood Control District, and
cleaning up the same and restoring said premises
to the condition to which the said premises should
be put in, upon the surrender of same by said
district, which said service rendered by the City
of Azusa would be and is comparable to the fair
and actual value of said second hand fences and
gates:
THEREFORE, BE IT RESOLVED that the Board of
Supervisors of Los Angeles County and of said
Los Angeles Flood Control District as well as
s&id county be, and the same are hereby, respect-
fully petitioned and requested by the City of
Azusa and by the City Council thereof to turn
over and convey to the said City of Azusa the
fencing and gates enclosing the work and storage
yard heretofore used and maintained by the Los
Angeles County Flood Control District at the end
of 10th Street in the Northwesterly section of
said City of Azusa, in return for and in con-
sideration of which the City of Azusa shall clean
up and restore the premises heretofore occupied
by said Flood Control District as a work and
storage yard.
BE IT FURTHER RESOLVED that the Mayor and
the City Clerk of the City of Azusa be, and the
same are hereby, instructed and directed to
sign, execute and deliver on behalf of said City,
all such proper papers as are or may be requisite
in order to carry out the terms of the foregoing
resolution and to evidence any contracts or con-
veyances in carrying out the terms of any conveyances
or agreements thereunder.
BE IT FURTHER RESOLVED that the Mayor shall
sign this resolution, the Clerk attest the same
and certify to the passage and ado tion thereof.

I do hereby certify that the foregoing resolution
was regularly adopted by the City Council of the City
of Azusa at a special meeting of said Council held
pursuant to law and to the rules of said Council,
in the regular council chambers of said City Council
of said City on September 22,1938, and that the same
was passed and adopted by the following vote of the
Council:
