HomeMy WebLinkAboutResolution No. 1441jp'1 J 0 00 0 O to RESOLUTION NO. /-#1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA; ORDERING THE VACATING, CLOSING AND ABANDONING FOR PUBLIC STREET PURPOSES, EXCEPT AS HEREIN OTHER- WISE PROVIDED, OF A CERTAIN PORTION OF THE ALLEY IN BLOCK 20 WITHIN SAID CITY. WHEREAS, the City Council of the City of Azusa, Los Angeles County, California, did on December 17, 1934, duly pass and adopt its: Resolution No.1-431 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, DECLARING ITS INTENTION TO CAUSE TO BE VACATED, CLOSED AND ABAN- DONED FOR PUBLIC STREET PURPOSES A CERTAIN PORTION OF THE ALLEY IN BLOCK 20 WITHIN SAID CITY", and WHEREAS, the Superintendent of Streets of said City, pur- suant to and as provided by said Resolution, did on s, 19359 complete the, posting of the NOTICES OF PUBLIC WORK and did cause such notice to be published in the Azusa Herald and Pomo- tropic on the following dates, to -wit: D% _4' 2q0 1934 S" 4,110" Its 1930, and WHEREAS, no objections or protests have been made or filed to said proposed work or improvement within ten days after the expiration of the time of the publication of said notice and have not at any other time been filed or made, and WHEREAS, this is the next meeting of said City Council after the expiration of ten days after the expiration of the time of publication of said notice, NOW, THEREFORE, the City Council of the City of Azusa. does resolve as follows: Section 1. That the public interest and convenience re- quire and the City Council of said City having acquired juris- a.y_ 90 • •• diction as required by law so to do, does hereby order that the following described property in said City be vacated, closed and abandoned for public street, highway and alley purposes, to -wit: The southerly portion of the alley in Block 20 within said City, to crit: Beginning at the northeasterly corner of Lot 39 in said block, thence southerly along the west- erly line of said alley twenty-five (25) feet more or less to an intersection with the southwesterly prolongation of the south- easterly line of lot 13 in said block, thence northeasterly along said prolongation to the southwesterly corner of said lot 13, thence northerly along the easterly line of said alley to an intersection with the easterly prolongation of the northerly line of said lot 39, thence westerly to the point of beginning. Section 2. That.it appears that there are no damages, costs or expenses occasioned by or arising out of the vacating, closing and abandoning of said property for public street, high- way and alley purposes and that no assessments are necessary and that therefore no commissioners need be or are to be appointed for the purpose of making assessments of benefits or damages. Section 3. Any provision of this Resolution to the con- trary notwithstanding, the City reserves and shall have the right to use, and/or to permit and/or grant the right to use the property to be vacated, closed and abandoned for the transmis- sion of water, gas, electricity, telephone service, and similar uses, by poles, wires, pipes, conduits, ditches or other similar means. Section 4. The Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof. Approved and adopted this -4th day of February, 1935.
