HomeMy WebLinkAboutResolution No. 1745RESOLUTION NO. 1745- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AUTHORIZ- ING AN EXCEPTION OR VARIANCE UNDER SECTIO14 16 OF ORDINANCE N0. 342 IN FAVOR OF ALBERT H. MILLER AND HELEN B. 1?ILLER, husband and wife as joint tenants, APPLICABLE TO LOTS91 10 11 and 12 and the South 2i feet of LOT 8 IN BL06K 11 of AZUSA. The City Council of. the City of Azusa does resolve as follows: - WHEREAS Albert H. Miller and Helen B. Miller, owners of Lots 9, 10, 11 and 12 and the South 22 feet of Lot 8 all in Block 11 of Azusa, in the City of Azusa, County of Los Angeles, State of California, as per map recorded in Book 15, Pages 95 and 96, Miscellaneous Records in the Office of the County Recorder of said County, have heretofore filed their verified petition with the City Planning Commission of the City of Azusa requesting an exception or variance under Section 16 of Ordinance No. 342 of said City known as the Zoning Ordinance, so as to permit the construction, erection and maintenance of not lessthan three duplex (double) residence units on aforesaid lands with accompanying garages, improvement of grounds and the like, the granting of which petition has been recommended to the City Council by said City Planning Commission, and WHEREAS it appears to the City Council that the immediate neighborhood to the South, East and West of aforedescribed property, as well as the Southerly portion of the property described in said petition, is either unimproved and grown up with weeds or is unsightly because of the poor character of the small buildings thereon; that notice has been given to interested parties as to the pendency of this applica- tion for exception or variance and that no further or other notice is necessary, any further notice being hereby dispensed with, and that the granting of said petition for exception or variance and the permit therefor are necessary for the preservation and enjoyment of the substantial property rights of the petitioners and are not materially detrimental to the public welfare or injurious to the property or improvements in the zone or dis- trict in which the aforedescribed property lies or injurious to the property or improvements in other zones or districts; - 1 - - _ *a « - NOW THEREFORE BE IT RESOLVED that the aforesaid petition for exception or variance be and the same is hereby granted and that an exce ption or variance be and the same is hereby made in favor of Albert H. Piller and Helen B. Miller husband and wife as ,joint tenants, or either of them, or their heirs or successors in interest or title and in favor of any other owner or owners hereafter siezed of aforedescribed property, as to Lots 9, 10, 11 and 12 and the South 22 feet of Lot 8 all in Block 11 of Azusa as aforesaid, which excep- tion or variance is and shall be under Section 16 of Ordinance No. 342 of said City, which ordinance is known as the Zoning Ordinance, so els to permit the construction, erection, main- tenance and operation of not less than three (3.) duplex (double) residence units on aforesaid lands with accompanying garages, improvements of grounds and the like, with a set -back or front yard on the San Gabriel Avenue frontage of said property of approximately 23 feet, the Southerly unit of which said buildings may face to the North with the rear within approxi- . mately 5 feet of the Southerly line of Lot 12 along Ninth Street, with a wall along Ninth Street approximately six feet at the intersection of the alley on the Southwest corner of said properties and extending Easterly along the Ninth Street side graduating down to approximately four feet at the South- east corner of said properties and a low wall of approximately tuofeet with proper openings along San Gabriel Avenue, garages or a six foot wall being authorized on the rear of said propertied with other walls approximately six feet in height or decorative structures in and about same, all of substantial construction. BE IT FURTHER RESOLVED that aforesaid improvements on the properties covered by said Petition will be a material benefit to the surrounding properties and serve to clean up an eye -sore and detriment which has existed in that neighborhood for many years. BE IT FURTHER RESOLVED that the plans and speci- fications presented by petitioners shall be and the same are hereby ratified and approved and the petitioners are granted an exception or variance under Section 16 of Ordinance No. 342 as aforesaid for the erection, construction, maintenance and operation of duplex (double) residence units on said properties on any of the lots comprising said properties, spaced and walled and located in substantial conformity with the spacings shown on said plans and specifications as applicable to Lots 11 and 12 in said Block 11, or in accordance with the terms of this Resolution. BE IT FURTHER RESOLVED that the Mayor of said City shall sign this Resolution and the City Clerk shall attest same and certify to the passage and adoptio hh e V. A. OWENS Mayor of the City of Azusa.
