A RESOLUTION OF THE -CITY COUNCIL OF THE CITY OF
AZUSA REJECTING ALL BIDS RECEIVED FEBRUARY 191
1940 FOR THE IMPROVEKENT OF CERTAIN PORTIONS OF
SECUND STREET, THIRD STREET, FOURTH STREET, AND
SOLDANO AVENUE WITHIN SAID CITY, AND DECLARING
THAT THE WORK CAN BE PERFORKED MORE ECONOMICALLY
BY DAY LABOR AND WITH THE CITY'S EQUIPIoMNT UNDER
THE SUPERVISION OF THE SUPERINTENDENT OF STREETS
The City Council of the City of Azusa does hereby resolve
as follows:
WHEREAS, the City Council did on the loth day of February,
1940 receive bids for the grading, excavation, filling, shaping, and
rolling sub -grade and shoulders of earth where required, and the
construction upon the existing macadam pavement and the graded areas
of asphaltic concrete (pre -mix) pavement upon certain portions of
Second Street, Third Street, Fourth Street, and Soldano Avenue within
said City as more particularly described and set forth in the
instructions to bidders and specifications on file in the office of
the City Clerk; and
WHEREAS, all of said sealed bids or proposals presented
for the performance of said work were publicly, opened, examined
and declared at the time and place designated in the "Notice to
Contractors," and the persons, firms or corporations who submitted
bids or proposals, and the total amount of said bids were as follows:

1NfMEAS, the City Council did on the 5th day of February,
1940 request the Superintendent of Streets to make an estimate of
cost for the performance of said work by day labor and using City
owned equipment, and the purchase of material required for said work,
based upon the price at which the City heretofore advertised for
bids and awarded a contract therefor, under the supervision of said
Superintendent of Streets; and
V4MEAS, the said Superintendent of Streets, did in com-
pliance with said request, make such an estimate of cost, dated
February 7, 1940, and filed the same with the City Clerk of said
City, and in which estimate said Superintendent of Streets declared
that the work aforesaid could be performed for the total sum of
ti?2,563.50; and
IMEREAS, on the aforesaid estimate, the City Engineer of
said City, wrote the following in confirming said estimate of cost:
" February 9, 1940. I have checked over the above
estimates and it is my opinion, based upon costs of
several similar jobs, that the Street Department
under the supervision of the Street Superintendent
can perform the work mentioned at the prices given
and for the total amount stated,

IVHEREAS, the City Council has duly and carefully considered
and analyzed the bids received and made a comparison with the estimate
of cost submitted by the Street Superintendent and confirmed by the
City Engineer, which total estimate of cost of the Superintendent of
Streets is $399.00 less than the lowest bid submitted, namely, that
of A. B. Adair, and has duly considered the fact that in addition to
affecting a saving in total cost, it also will make it possible to
engage local experienced labor, now out of employment, in the con-
struction of said work rdnen performed -by the City,

NOW, THEREFORE, BE IT RESOLVED, that in view of all of the
foregoing conditions and considerations, this City Council hereby
rejects any and all bids or proposals submitted for said work, and
declares and determines that in its opinion the work in question may
be performed more economically by day labor and the materials and
supplies furnished at a lower price in the open market and that it is
to the best interests of the City by reason of economies affected
and benefits derived by local labor to perform all of said -work by
the City under the supervision of the Superintendent of Streets, and
it is hereby ordered that said work be performed in said manner.
The City Clerk of said City is hereby instructed and autho-
rized to return any and all certified or cashierts checks, which were,
attached to the respective bids or proposals, to all of the respective
bidders, mailed to the addresses given on the respective proposals
submitted, and also to notify the lowest bidder, A. B. Adair, of
the passage of this resolution.

I, M. A. Hynes, City Clerk of the City of Azusa
do hereby certify that the foregoing Resolution No..14147 was duly
and regularly adopted by the City Council of the City of Azusa,
signed by the Mayor, and attested by the City Clerk , all at an
adjourned regular meeting thereof held on the 20th day of February,
1940, and that the same was passed by the following vote, to -wit:
