HomeMy WebLinkAboutResolution No. 1928RESOLUTION NO. 1928 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, RELATIVE TO SEWERS AND SEWER CONNECTIONS SERVING THE PROPOSED SUBDIVISION, TRACT NO. 13736, BEING A PORTION OF LOTS 50 AND 71 OF SUBDIVISION NO. 2, AZUSA LAND AND WATER COMPANY. WHEREAS, it is proposed to subdivide a portion of Lots 50 and 71 of Map of Subdivision No. 2, Azusa Land and Water Company, as per map thereof recorded in Miscellaneous Records, Book 43, at page 94, Records of Los Angeles County, California; and WHEREAS, it is intended by the owners of said property to construct buildings on the lots within said subdivision which must be provided with facilities for the disposal of sewage therefrom in order to protect and preserve the public health, and which necessitates the construction of sanitary sewers to convey said sewage to the existing main outfall sewer along First Street; and WHEREAS, the development of this portion of the City will be of general public benefit to the City as a whole; and WHEREAS, it has been the policy of the City in the past to share a proportionate part of the expense of the construction of sanitary sewers and appurtenances with the property owners, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Azusa that the public interest, necessity and convenience requires for the preservation of the health of said City the construction of sanitary sewers in and along the respective streets of said proposed subdivision to be known and designated as Tract No. 13736, and that the streets in which said sewers shall be construct- ed, the proportionate costs thereof to be borne by the subdividers and/or owners of said property and the City of Azusa, and all other matters relating to the performance of the work and time and amount of payments shall be as follows: 1. Sanitary sewers shall be constructed in and along the following streets: (a) Third Street from Angeleno Avenue to Vernon Avenue. (b) Second Street from Angeleno Avenue to Vernon Avenue. (c) Unnamed Street located between First Street and Second Street and parallel to said streets from the easterly line of said Tract No. 13736 to Vernon Ave. (d) Vernon Avenue from Third Street to the existing main outfall sewer in First Street. 2. All engineering, inspection, supervision and testing of materials necessary and required for the design and construction of said work shall be performed by Paul E. Kressly, City Engineer of the City of Azusa, or by his authorized agents or representatives. 1�, 3. All construction of the work, purchase of materials, furnishing of labor and equipment, superintendence, etc. shall be performed by the City of Azusa or its authorized agents or representatives, and the total cost of any part or all of said work shall be the actual cost expended by the City for wages and salaries for labor and superintendence, supplies and materials furnish- ed, regular rental rates for City-owned equipment, engineering, and all other costs and expenses incidental to the performance of said work plus ten (10) per cent to cover costs of liability and compensation insurance, and overhead office expenses. 4. The subdividers and/or property owners shall pay the entire cost-of the following work to be constructed: (a) All 6 -inch diameter house connection sewers from the, existing main outfall sewer along First Street to the southerly curb line of said First Street to serve Lots 17 to 21, both inclusive, at a total preliminary estimated cost of $74.00. (b) All 6 -inch diameter house connection sewers from the existing main outfall sewer along First Street to the northerly curb line of said First Street to serve Lots 22 to 34, both inclusive, at a total preliminary estimated cost of $622.00. 5. The subdivider's and/or property owners shall pay 50% of the total cost and the City of Azusa shall pay 50% of the total cost of constructing sanitary sewers and appurtenances in and along the streets more particularly described herein under heading, numbered, 1, and the total cost of constructing house connection sewers from the above mentioned sewers to the nearest curb line of the respective streets to serve Lots 35 to 101, both inclusive, at a total preliminary estimated cost of $120680.28. 6. The City of Azusa will not proceed with the purchasing of the materials and/or the construction of the work until the subdivider's and/or owners of the property have paid to the City of Azusa the entire estimated cost for the work enumerated under 4 (a)and 4 (b), namely, the sums of $74.00 and $622.00 or a total of $696.00; and 50%.of the entire estimated cost for the work enumerated under 5, namely, 50% of $12,680.28 or $6,340.14, making a grand total to be paid to the City for all work to be constructed of $7,036.14. 7. After the work has been completed, the City of Azusa shall furnish to the subdivider's and/or property owners an itemized statement of the total cost of all materials and supplies, labor, rental of equipment, and and all incidental costs and expenses, including engineering, inspection and supervision, expended by the City of Azusa for the construction of said work plus ten (10) per cent for liability and compensation insurance, and overhead office expenses, and if such costs are less than the amounts hereinbefore estimated to be paid by the subdivider's and/or property owners, the City of Azusa shall refund such difference. Like- wise if the said amounts are more, than the subdivider's and/or property owners shall pay to the City of Azusa such difference. In either case, any such payments shall be made within thirty (30) days from the date of said itemized statement. 8. The work constructed shall at all times be the sole and exclusive property of the City of Azusa, and said City shall operate, repair and maintain the same at its own expense. 9. The subdivider's and/or property owners shall by letter addressed to the City Council of the City of Azusa consent to and approve in writing all of the terms and conditions hereinbefore mentioned, if acceptable, before the City will proceed with the construction of said work.
