HomeMy WebLinkAboutResolution No. 1925RESOLUTION NO. 1925 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA AUTHORIZING AN EXCEPTION AND VARIANCE UNDER ORDINANCE ,#342 AND APPLICABLE TO THAT PART OF LOT 55 SUB. #2 AZUSA LAND AND WATER COMPANY LYING NORTH OF PACIFIC ELECTRIC RAILWAY. The City Council of the City of Azusa does resolve as follows: WHEREAS a petition for exception and variance has been duly filed with the City Planning Commission by Associated Pipe and Engineering Company applicable to the following real property situate in the bity of Azusa, Los Angeles County, California, and described as being that part of Lot 55 Subdivision #2 Azusa Land and Water Company, lying north of the Pacific Electric Railway and WHEREAS said petition prays for an exception and variance as to aforesaid property enlarging to M-2, that part of said property designated in said Ordinance #342 as,M-1, and enlarging to M-1 that easterly part of said property, consisting of the easterly 300 feet thereof, designated in said Ordinance #342 as C-3, the granting of which petition has been recommended to the City Council by the City Planning Commission of said City, and WHEREAS the City Council of said City of Azusa has found and does hereby find, determine and declare that no further notice of the filing of said petition or of the hearing thereof is necessary or required, any further notice being hereby dispensed with, and WHEREAS said exception and variance is/are hereby found and determined necessary for the preservation and enjoy- ment of the substantial property rights of the petitioner therefor and is/are not materially detrimental to the public welfare or injurious to the property or improvements in the zone or district in which said property lies or injurious to the property or improvements in other zones or districts: NOW THEREFORE be it resolved that an exception and variance be and the same is/are hereby ordered and made permitting the location, erection, use, operation and maintenance on and in said property, by the present owner or owners thereof or by his or their heirs, executors, administrators, lessees, grantees, successors or asdigns,•of any building, structure or improvement permitted under the classification of Zone M-2 - General Manufacturing District as the uses of said Zone M-2 are set forth and defined in said Ordinance $342 and any amendments thereof, which said exception and variance shall apply to that part of hereinbefore described property as is now designated M-1 An? -said Ordinance #342, and of any building, structure or improvementpermitted under the classification of Zone M-1 Light Manufacturing District, as the uses of said Zone M-1 are set forth and defined in said Ordinance ##342 and in any amendments thereof, which said latter exception and variance shall be applicable to that part of said hereinbefore described property as is in said Ordinance ##342 designated 0-3 and which comprises the easterly 300 feet•of said property; provided however that this resolution shall not be construed or be held to authorize or to permit the location, erection, use, operation or main- tenance of any building, structure or improvement or the carrying on of any activity in or on said property, which is or may be detrimental to other property in the neighborhood or to the welfare of the owners or occupants of such other property or detrimental to the health, peace or welfare of the City of Azusa or of any of its inhabitants. BE IT FURTHER RESOLVED -that the Mayor shall sign this resolution and the City Clerk shall attest same and certify to the passage and adoption thereof. Raymond J. L , Mayor of the ` City of Azusa.
