HomeMy WebLinkAboutResolution No. 18651 2 3 4 5 e 7 s 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 0 0 RESOLUTION NO. 1865 RESOLUTION OF THE CITY COUNCIL, CITY OF AZUSA, CALIFORNIA, INSTRUCTING THE CITY CLERK IN RESPECT TO PROCEEDS FROM SALES BY THE CITY OF CITY OWNED PROPERTY ACQUIRED BY TAX DEEDS. THAT, WHEREAS, the City of Azusa is now engaged in a com- prehensive program to restore to a tax paying basis all tax deeded property situated within the City; and WHEREAS, as an integral part of such program, properties acquired by the City by tax deeds have heretofore been sold by the City and will hereafter be sold; and WHEREAS, the City in order to accomplish the purposes heretofore set forth has employed by written contract John F. Bender an attorney at law, to do all necessary acts to accomplish such purposes; and WHEREAS, in addition thereto, the City has heretofore ex- pended from the general fund considerable moneys to accomplish the restoration of such properties to a tax paying basis and will here- after be required to expend additional sums; and WHEREAS, it is the opinion of this Council at this time the City Clerk should be given instructions in respect to the pro- ceeds heretofore received by the City from sales already made of tax deeded properties, and be given instructions in respect to the proceeds that will hereafter be received'by the City from future sales of such properties. NOW, THEREFORE, the City Council does hereby resolve, authorize and instruct as follows: First: That the City Clerk is hereby authorized and instructed that all moneys heretofore received by the sale of City owned real properties acquired by the City by tax deed, and all moneys that may hereafter be received by the City from the sale of such properties, shall be deposited in the General Fund of the City. 1. 1 Second: That immediately the City receives the full 2 purchase price of any parcels of property heretofore sold or 3 hereafter sold, the City Clerk is authorized and instructed to pre - 4 pare a warrant in favor of John F. Bender, said warrant to be in 5 the amount as provided for in that certain agreement heretofore made 8 and entered into by and between the City and said John F. Bender 7 as now on file in the office of the said City Clerk, and to present 8 said warrant to the City Council for action thereon. 9 Third: That the balance of all such moneys received and 10 deposited in the General Fund shall remain in the General Fund to 11 reimburse the City for its costs expended in respect to such proper - 12 ties; for reimbursement to the City of City taxes levied against 13 such properties so sold, and for reimbursement to the City of all 14 advancements made by the City in respect to the payment of any and 15 all special assessment liens levied against such properties. 18 Fourth: That the above instructions to the City Clerk 17 shall remain in full force and effect until further order of this 18 C ounc i l . ,,pp 19 Passed, approved and adopted this b day of �y,,°�, 20 1945, 21 22 23 11 Cali 24 I ATTEST: 25 28 2. a. a, uitiy 27 28 29 30 31 32 2. a. a,
